Industry committee  No. That is what is counterfeit on this—the CSA brand, plus “Westinghouse”.

Industry committee  We have. We've charged the individual in this case.

Supt Ken Hansen

Industry committee  That's the individual, yes. When I said “individual”, I meant the person who was making it.

Industry committee  These came from Canada. They're one of the exceptions to the rule.

April 25th, 2007Committee meeting

Supt Ken Hansen

Industry committee  I don't think they've appeared yet. The charges have been laid, but I don't think they've been sentenced yet. As a matter of fact, I'm sure they haven't been sentenced yet.

Supt Ken Hansen

Industry committee  That's part of the reason for the working group. We've got so many government departments involved that we have to determine what we need in terms of legislation and resources.

Industry committee  They could be going anywhere, yes.

Industry committee  It's not mom and pop for the most part, because you need a network to distribute these things. The only thing you would see produced very easily by one or two people would be something like DVDs or CDs. You can do that. If you have 100 burners, for example, you can put them in a room and start burning copies and selling them across the Internet.

Industry committee  I can answer some of that. We have started a public awareness campaign working with the private sector. We've produced four different posters that are going up at airports and bus stops and so on. They've been distributed across the country over recent months. We've done a lot of media interviews.

Industry committee  I know that overall in 2005 there were about 700 charges laid, using both the Criminal Code and the Copyright Act. I didn't bring the breakdown with me and I can't recall exactly offhand. There were also some charges laid by police force jurisdiction that wouldn't be included in those statistics.

Supt Ken Hansen

Industry committee  The penalties are very low. It's very rare that you'll see jail time. I don't think I've ever seen a case in which somebody got more than a year.

April 25th, 2007Committee meeting

Supt Ken Hansen

Industry committee  I can't recall a single case that got more than a year, even on multiple charges.

April 25th, 2007Committee meeting

Supt Ken Hansen

Industry committee  That would be the sentencing. Most of the time it's a fine.

April 25th, 2007Committee meeting

Supt Ken Hansen

Industry committee  Most of the time it's a fine. We've sometimes seen $200,000 or $300,000 fines with repeat offenders--but again, it's not a deterrent, because they're making more money than this.

April 25th, 2007Committee meeting

Supt Ken Hansen

Industry committee  I'm not familiar with any in consumers' rights. We have worked with the private sector—the Canadian Anti-Counterfeiting Network and several other companies, including the 2010 Olympic committee, etc.—to raise awareness. Through our website and the posters, we're trying to educate the public, but it's very difficult; I've been dealing with this for quite a while and sometimes I can't tell.
