Madam Speaker, this is the fourth time that this issue has been brought before Parliament. The situation is urgent, especially for those who are being preyed upon. Clearly it should not be a partisan issue. I know it is June and I know it is a difficult time, but, sadly, here today partisanship is now playing in on this bill that could be saving the lives of those who are being preyed upon in developing countries. We need to stop waiting around and get this done.

I am really disappointed to see how things are playing out today. This is exactly the sort of bill that should get cross-party support and all sides of the House should be able to and can agree that we have to do more about this and that this has to be stopped, not at some distant time in the future but right now. There have been opportunities today to advance that, so it is very disappointing. The victims of this crime simply cannot wait any longer.

Here in Canada, we are way behind in dealing with this issue on organ trafficking. We look at other countries, such as Spain and Norway and Taiwan, that have passed similar pieces of legislation to tackle this issue. Europeans have a convention entitled, “Council of Europe Convention against Trafficking in Human Organs”. We have to start catching up with the rest of the world by acknowledging the problem and taking action to fix it. The international community must come together on this issue. Canada needs to be a leader and establish clear conditions that will cut off the organ-trafficking industry's profits and the illegal businesses.

While most organ trafficking occurs abroad, measures must and can be implemented to ensure Canadians on long organ donation lists are not perpetuating this brutality by purchasing trafficked organs out of desperation. While we debate this bill to stop international organ trafficking, I do want to take time today to commend my colleague and good friend from Calgary Confederation for taking great action here at home and in this House that I know will address many domestic needs for organs. I am aware it just received royal assent. His bill, C-316, would deal with tax records being used for an organ donor registry. It is a highly commendable proposal that can be part of the solution to increase the supply of safe, legal and consensual organ donations, in an ethical way that respects human rights. This will have a real impact on people's lives here in Canada. I am honoured to continue to work with my colleague and to be a part of supporting his proposal, both his bill from the last Parliament and the bill that just passed.

The NDP really wants to ensure that this bill is passed swiftly and that those who have been harmed by this illicit trade are given the justice that they deserve. To support this, we must do more domestically to encourage ethical, safe organ donations, including giving Canadians more options to be able to sign up to the organ donation registry.

Organ harvesting and trafficking abroad is a horrific crime against humanity. It must be stopped. Canada can and must begin the process of fixing this injustice by passage of this bill.

Again, I am disappointed today that partisan politics have come into play. We support dealing with this horrific crime of organ harvesting and trafficking abroad.

Mr. Speaker, as you know very well because it was mentioned numerous times today, this bill got its second chance in this Parliament when my name was drawn first in the private member's bill lottery. It was you, Mr. Speaker, who drew my name out of a hat, so I owe you big time. I thank you sincerely.

This was first introduced in the last Parliament as Bill C-316 and it passed unanimously at all stages. Unfortunately, it died in the Senate when the 2019 election was called. Here we are today with Bill C-210. It also enjoyed the same unanimous support at all stages. Hopefully an election will not be called before the Senate has the opportunity to pass this into law, assuming it passes in the House next week.

There are so many people I need to thank, I do not even know where to begin. First and foremost is my assistant, Terence Scheltema. His help throughout this whole process has been immense and I cannot thank him enough. Of course, I also thank the member for Oakville North—Burlington, the member for Vancouver Kingsway and the member for Courtenay—Alberni, who kindly helped on my behalf to ensure unanimity and a quick passage.

I thank my colleagues on the health committee, who went above and beyond to ensure that the organ donation question would be on the front page of the income tax form. It was clearly identified at committee that they wanted this question on the front page of the income tax form, along with the Elections Canada question. I thank them sincerely for that. I thank the 20 members from all parties who seconded my bill and the ones who spoke on this bill throughout the entire process.

There are also some people behind the scenes who made this bill a reality and did some of the heavy lifting and careful navigation through this process. I need to thank procedural clerks Marie-France Renaud, Caroline Massicotte and Isabelle Dumas, and legislative counsel Nathalie Caron and Sylvie Bednar. As well, I want to thank three government staff, in particular, for their non-partisan assistance and co-operation: ministerial assistants Janick Cormier and Christina Lazarova, as well as parliamentary assistant Christopher Lalande.

As I have mentioned before in the House, my inspirations for this bill were Karen Korchinski and my late friend Robert Sallows. I pray the day will never come when Karen will need that liver transplant, but if it does, then perhaps the chances of her getting one will be that much better. Robert Sallows is a double lung transplant recipient who sadly passed away just before my Bill C-316 passed in the House in 2018. We need to get this bill passed so that we can finally tell Robert we finished the job for him. He fought so hard to help others also get a second chance at life. We need to finish this for him.

Finally, I want to thank the many Canadians who shared their personal stories with me along this journey. Some were tragic and some were remarkable, but all of them came from the heart. Let us not delay this any longer. Everything that needs to be said has been said. It is time to get Canada's organ and tissue procurement system on track and give hope to the thousands of Canadians awaiting transplants.

Mr. Speaker, it is a huge honour to rise today to speak to Bill C-210.

I want to start by sharing a story with my colleagues in the House of a fellow Vancouver Islander, Paul Underhill. Paul lives with cystic fibrosis. This past April he completed a five kilometre run and a five kilometre walk to commemorate the double lung transplant he received 10 years ago.

Paul was raising awareness for BC Transplant who say that there are more than 700 people currently on a wait-list for an organ transplant in British Columbia. Around 5,500 British Columbians are alive today because of organ donation. In the past year alone, 451 lives were saved because of organ donors.

Paul stated:

I want people to realize how much of an impact it can have. Just two minutes out of your life to register and you can literally save a life.

Inspired by Paul and the stories of others, some not so fortunate, I am honoured to rise today to speak to this bill. The bill was tabled by my good friend from Calgary Confederation, who has been determined on this bill. In the last Parliament, he tabled Bill C-316, which I was honoured to be a seconder of, and also worked with my Liberal colleague from Oakville North—Burlington on this bill. This bill should not be a partisan issue. When it comes to saving lives, lives that could be saved through the help of others, we should be working collectively together. Again, I want to thank my good friend from Calgary Confederation for his determination to see this through.

Bill C-210 allows the federal government to coordinate with provinces and territories to allow Canadians to register as an organ and tissue donor through their federal tax filing. We know Canadians are currently dying, as I stated, on wait-lists because our organ donation rate is unacceptably low. At present, only 20% of Canadians have joined their province's organ and tissue registry. This is unacceptable.

At the end of 2018, the most recent year of available data, there were 4,351 people across Canada on a waiting list for an organ transplant, including 2,890 who were active on that list. In total, 223 people died while waiting for a transplant. In order to meet this demand, improved coordination across provinces and territories is critically needed.

As New Democrats, we believe that we must make every possible effort to ensure that every Canadian who needs an organ or tissue transplant receives it. One donor could save up to eight lives and benefit more than 75 people, and yet at 18 donors per million people, Canada's current donation rate puts us in the lower third of developed countries.

Allowing Canadians to register as an organ and tissue donor through their tax returns would help increase registration rates, improve consent rates and help build a donation culture in Canada.

As New Democrats, we support the adoption of presumed consent or an opt-out system for organ and tissue donation. We understand that such an approach would make a huge difference in the number of organs available to save lives.

One potential concern that has been raised in association with the bill is the unauthorized sharing of personal information. However, individuals would still be required to consent to the sharing of that information before the agency would share that information with other levels of government for the purpose of being added to an organ and tissue donor registry. That is covered.

In the previous Parliament, the Standing Committee on Health undertook a study on organ donation in Canada. It met with key stakeholders. This bill aligns with long-standing advocacy and legislative work of New Democrats around organ donation. In February 2016, the MP for Edmonton Manning, whose own son has been the recipient of three donated livers, reintroduced a private member's bill calling for a national registry. Similar bills had previously been introduced seven times, by a Liberal and two New Democrats. Lou Sekora tabled it. New Democrat Judy Wasylycia-Leis tabled it. Another New Democrat, Malcolm Allen, in 2009 and again in 2013 tabled it.

Unfortunately, in the last Parliament, the Liberal caucus voted to defeat the member for Edmonton Manning's bill. This bill aligns with long-standing advocacy and legislative work, as I have cited, of New Democrats around organ donation. The bill is essentially a critical piece to creating a pan-Canadian organ donor registry, and it needs to be pushed forward.

The previous bill, Bill C-316, which passed in the House of Commons, went to the upper house where it stalled and died in the past Parliament. It is shameful that people's lives are being lost because of politics.

The Liberals, again, previously killed the pan-Canadian registry without studying it. The push for a rapid implementation of a pan-Canadian data and performance system for organ donation needs to be moved quickly, and we are offering our non-partisan support for this sensible proposal.

The Liberals saw this pass, it went to the Senate and they had ample time to implement the contents of the bill that could have saved lives. I urge the government for quick passage and for all members of Parliament to support the bill and get it to the upper house. I urge the upper house to pass this and give it royal assent quickly, because people's lives are at stake and the sense of urgency could not be greater.

I want to talk, more important, about some stories, but I will get to that in a second.

As New Democrats, we have consistently advocated for the adoption of a presumed consent or opt-out system for organ donation. It is an approach that would make a huge difference in the number of organs available to save lives. Unlike our current opt-in system, an opt-out approach would automatically register all citizens for organ donation unless they chose to indicate otherwise.

I will speak a bit about countries with opt-out systems that consistently record higher donation rates than opt-in countries like ours. Indeed, this approach has helped to make Spain a world leader in organ donation, which the previous speaker just spoke about, over the last 25 years. In Austria, the donor rate quadrupled after instituting opt-out legislation, and similar regulations in Belgium doubled kidney donations. The most important success of this system has been that it has led to organ donation being routinely considered when a patient dies, regardless of the circumstances of death.

I have heard from many people, stories of Canadians who have donated organs, and they inspire me.

Meghan Walker, a good friend of mine from Parksville, reached out to me last night to share her story. She donated her liver to her best friend, Michelle, saving her life. Michelle has two young children. She had one before the transplant and one since the transplant. She has a loving family, and that organ donation kept her alive. It saved her life.

Lorelie Rozzano from Nanaimo recently shared a story with me through my childhood friend, Bonnie Bartlett. It is about her daughter, Shannon McIntosh, who received a transplant. She told me this story, which I will share. She said, “I'll never forget hearing my daughter needed a liver transplant and that she only had a few months to live. I watched my daughter waste away as she fought to hold on. Then came the call. It was bittersweet. What brought us hope brought sorrow to another family.” This is too often the case.

She went on to say, ”On February 1, 2021, Shannon got her new liver. One day later, she was standing. A week later, she was walking around the hospital floor. Four weeks later, she was walking around the block. Eight weeks later, she was walking ten thousand steps at a time. Now I can barely keep up with her. Through the process, Shannon learned her donor was a young person. She cried when she heard that. There are no words big enough to describe our gratitude to the donor's family. I hope to meet them one day and to say thank you in person. Their decision to be an organ donor gave our family the most precious gift of all, the gift of life.”

Shannon, Michelle and Paul would not be here without donors, without the people who had the goodwill to put their names on these lists. Many others overlook that, but would like to be donors. We need to fast-track this legislation, because we know thousands of people are not as lucky as Shannon, Michelle and Paul. This is an opportunity for us to stand united.

Again, I want to thank my friend from Calgary Confederation for using his slot in the draw, he was first this time for parliamentarians, and for his determination to see this through. Let us get behind him, let us get behind all those people on those waiting lists and let us save some lives and work together.

Madam Speaker, I am here today to speak to Bill C-210. This bill would change the Canada Revenue Agency Act to allow for people in Canada to sign up for organ donation on their income tax form.

I want to thank the member for Calgary Confederation for bringing forward this bill for a second time. As this is National Organ and Tissue Donation Awareness Month, it is important that this is the debate we are having at this time.

This is a hard one to talk about because of the emotional nature of this process. Currently, we know that there is a provincial and territorial jurisdiction. This means, sadly, that someone could be in desperate need in one province or territory and have no way to access organs that people have identified they want to donate. This means that people cannot get their second chance.

As a New Democrat, I fundamentally believe that we must make every possible effort to ensure that every Canadian who needs an organ or tissue transplant receives it. This is so important, and I support this because it allows people, while they are doing their taxes, to check another box, to show that this is something, if they were in the saddest circumstances, they would be able to provide.

We know that one donor could save up to eight lives and benefit more than 75 people. That is a tremendous generosity. Yet, at 18 donors per million people, Canada's current donation rate puts us at the lower third of developed countries.

Allowing Canadians to register to donate their organs and tissues through their tax return would help increase registration rates. This would improve consent rates and also help to build a donation culture in Canada. If we think about this being something that we do once a year to review, it would give that opportunity for us to have conversations with our loved ones about the decisions we have made.

We know that across Canada people are dying on wait-lists because our organ donation rate is so low. At present, only 20% of Canadians have joined their province's organ and tissue registry.

This is such an important bill because it allows the federal government to coordinate with provinces and territories to allow Canadians to register as an organ and tissue donor through their taxes.

There is a lot of concern here, sometimes, about the bill with its unauthorized sharing of personal information. This would allow for individuals to be required to give consent.

In my riding, I have read multiple articles about constituents, or have talked to constituents themselves, who have talked to me about the gift that it is when they receive a transplant. What I hear from people, again and again, is how they do not take a moment of their life for granted, as a donor. The gratitude they have for the person who gave them their second chance is incredibly powerful.

Not too long ago, I read about a constituent named Darvy Culleton, who received a double lung transplant. He was born with cystic fibrosis, a genetic disorder that affects the lungs and other major organs, and was told from a very early age that he would potentially only live until around the age of 29. When he was 29, he got his transplant, and now has married his wife, Megan, and they have a baby. Although he did not know much about his donor, he said that every day he lives with a deep and profound gratitude, one that is shared by his family.

In the last Parliament, the same legislation, then Bill C-316, was passed unanimously by the House of Commons. Unfortunately, it did not get passed through the second House, the Senate. In 2016, we know there was some concern that the Liberals brought forward about this bill, and it did not move forward in the way that it should have, because it was under provincial jurisdiction. I am very happy to see that people are coming together, understanding that this is the way we could make this work through the system.

I know that for New Democrats in this House, the opt-out system is something we are very supportive of. We know that countries that have an opt-out system, which means people are automatically put into the list unless they take themselves out of it, see record-high donation rates. This is part of the approach that has made Spain a world leader in organ donation over the past 25 years. We know that in Australia the donor rate grew tremendously through the opt-out legislation that was put forward.

This is always a hard thing to talk about, because it is really about a sad situation that leads to somebody else having an opportunity. I want to thank the member for bringing it forward. I want to thank all the people across Canada who put their names forward to be organ or tissue donors. I want to stand in solidarity with the people who live life because somebody else was generous with theirs.

Madam Speaker, I want to say hello to all of my colleagues. I am very pleased to see them again after the two weeks that we spent in our ridings.

The debate on Bill C-210 is timely because National Organ and Tissue Donation Awareness Week is set to take place from April 18 to 24. This bill seeks to amend the Canada Revenue Agency Act.

First, the bill would authorize the Canada Revenue Agency, or CRA, to enter into agreements with the provinces and territories to collect, via the income tax return, the information required to establish or maintain an organ donor registry. Second, the bill would authorize the CRA to disclose that information to the provinces and territories that have entered into such an agreement.

Just as a reminder, this bill was first introduced in 2016 by our colleague from Calgary Confederation as Bill C-316. Unfortunately, it did not get past first reading in the Senate. This iteration of the bill has a new number, but the contents are the same. As such, the Bloc Québécois's position on this bill remains unchanged. Quebec is just fine with Bill C-210, and the Bloc Québécois fully supports it.

However, as I have already told my House colleagues, it is highly unlikely that Quebec would sign an agreement with the CRA because it already has its own tax return. It is also no secret that the Bloc Québécois is fighting for a single tax return managed solely by Revenu Québec, so why delegate to the CRA a health matter that Quebec is perfectly capable of handling and that is under its exclusive jurisdiction?

Basically, the Bloc Québécois supports this bill because we believe it will benefit the inhabitants of other provinces and territories where the CRA administers the tax system.

We have absolutely no issue with allowing the CRA to collect and share information related to organ and tissue donation. If the Quebec National Assembly were to sign an agreement with the CRA, we would fully respect that decision. Quebec is free to sign or not sign an agreement, and my tone would be completely different if we were to assume otherwise.

According to the most recent data from the Canadian Institute for Health Information, in 2019, 3,084 whole organs were transplanted into 3,014 recipients. This includes 1,789 kidneys, 610 livers, 212 hearts, 404 lungs and 68 pancreases. This might seem like an odd list, but it demonstrates the magnitude of the situation. Furthermore, although the total number of transplants has risen quite dramatically compared to ten years ago, I would remind the House that there is still a significant gap between the number of transplants performed and the number of people on waiting lists. In 2019, of the 4,352 people waiting for a transplant, 249 unfortunately died before getting their surgery. This is appalling, and it could be described as a deadly wait. The governments of Canada, Quebec and the other provinces must do better, and everyone needs to do their part.

The COVID-19 pandemic certainly has not made things easier in that regard. In 2020, Transplant Quebec recorded a 20% drop in organ donation and transplantation activity, both in terms of referrals and actual donors and transplant recipients. Quebec is not alone. Other provinces and other countries have seen a similar decline. The pandemic is hitting us hard, but thanks to the tenacity and remarkable adaptability of our medical community in Quebec, things have returned to a semblance of normality in the past few months.

Before I go any further, I would like to take a minute to sincerely thank all the donors who have signed their card and consented to organ or tissue donation. I know that it is not an easy decision for everyone to make.

I also want to take this time to commend the work of doctors who specialize in organ procurement and those who perform the transplants. They do remarkable work. We can never say it enough. Thanks to them, 13,000 people in Quebec and Canada are living with a transplanted organ. It is amazing. However, we cannot rest on our laurels. We must do more, and Bill C-210 will help us do that.

As I mentioned before, this bill will probably not affect Quebec in any way because Quebeckers have their own tax return, and Quebec could collect the required information for its own registry if it wanted to. So much the better if Quebec does not have to do it and Ottawa manages this matter. However, the last time I checked, health is almost exclusively a provincial jurisdiction. In this great and beautiful Canada, geographical distance is a significant problem for the successful completion of transplants. In light of the fact that a transplant must be completed within 12 hours for a liver and eight hours for a lung, for example, it is obvious that the proper administration of registries is crucial. In my opinion, the provincial centralization of data collection and registry maintenance is a win-win proposition.

That said, I would like to share some more thoughts about this bill. This amendment to the Canada Revenue Agency Act is truly a step in the right direction, but there is no evidence to show that it will have a direct, noticeable impact on the number of deceased donors, so long as we do not do more to promote awareness and education of organ and tissue donation. I remind the House that there is still a significant gap between the number of people who say they are in favour of organ donation and those who explicitly consent to it. I signed these papers when I turned 18 because I had a teacher at the end of high school who told us about the importance of organ donation.

I do want to commend the Government of Nova Scotia, which officially adopted an opt-out system in January. This system is the complete opposite of the opt-in system that exists in the rest of North America. Quebec has been considering this issue for some time now. I would be interested in seeing how this system unfolds with our maritime neighbours. I think it could be very worthwhile. I remind members that there is no data to establish a clear link between the implementation of an opt-in system and an increase in the number of transplants.

That has been demonstrated by Spain, which is a leader in this medical field. The opt-in system expands the pool of deceased organ donors, but that is only useful if we have the appropriate and necessary infrastructure. One of the keys to reducing the gap is to increase investments in medical infrastructure related to organ donation and transplants. There is no point in having more donors if there is a lack of trained staff or if the registry is not administered properly.

Another key is awareness, and I have a special interest in that. In addition to family refusal, there is also a widespread belief that minimal effort will be made to save the lives of those who agree to be organ donors. We need to counter this type of misconception through education and awareness.

I want to take this opportunity to recognize the work of an organization in my riding in Quebec called Chaîne de vie. Chaîne de vie's team of health and education professionals have been visiting high schools across Quebec since 2007 to educate young people between the ages of 15 and 17 about organ and tissue donation. This tremendous work does not just raise awareness among youth. It also encourages family discussion—

Mr. Speaker, I am pleased to rise today to speak to my private member's bill, Bill C-210, at third reading. For those who may not be familiar with Bill C-2l0, it is a proposal that would allow Canadians to indicate their interest in being an organ and tissue donor through their annual tax forms. Right now the tax forms can only be used for the collection of taxes. The bill would create a legal exemption, just like that made to Elections Canada, to allow for its important question of organ donation to be added to the tax form.

The bill was unanimously supported at both second reading and at committee. The bill was also my bill, Bill C-316, in the last Parliament where it was also unanimously supported, however unfortunately, it died in the Senate. It did get a second decent life in this Parliament when I won the PMB lotto. I was picked as number one, so I resurrected the bill.

It is very timely that we are speaking about the bill today as April is Organ and Tissue Donation Awareness Month. It is also two weeks away from the tax filing deadline in Canada, so it is ironic to be speaking here today on this. If we have any hope of getting these changes to the tax form implemented in time for the next year, the 2021 tax year, we need to move the bill through both the House and the Senate before the summer. If we miss that deadline, the Canada Revenue Agency will not be able to implement the required changes for yet another year. We just cannot let that happen.

I want to convey my sincere thanks to all parties in the House for showing such strong support and offering genuine co-operation to move this proposal forward. Members' unanimous support and unwavering support at every stage has been heartwarming and shows we really can pull together for Canadians. I specifically want to thank all my colleagues from all parties on the health committee, both currently and in the past when I served on the health committee, who have been vocal, determined and dedicated supporters of the bill.

I also want to thank the government for the allocation of funding in the past fall economic statement to facilitate the implementation of this legislation. Governments do not often commit funding ahead of legislation passing, especially when it is for a private member's bill from an opposition member of Parliament. That funding is very much appreciated and it signifies a shared will to see the bill pass.

I want to bring out the matter that came up at committee. First of all, for this initiative to be most effective, the question on organ and tissue donation needs to be placed on the front page of the tax form. The committee members made this very clear to the CRA. In fact, they specifically voted down the idea of suggesting that the CRA had latitude to move it to some back page in oblivion. Parliament has spoken and it wants this on the front page along with the existing Elections Canada question.

I was pleased that individuals from the CRA have acknowledged that this is a priority of Parliament and committed to putting this on the front page. I implore the folks at the CRA to dig deep and push forward to make sure that we get this done as soon as possible. Their work will have life-changing consequences.

One other aspect I want to spend a few minutes on is something that the bill does not directly address, but is a significant problem here in Canada. This is the reason we have Organ and Tissue Donation Awareness Month. Research has shown that as many as one in five potential organ and tissue donors have their final wish overturned by their family at the time of death. That is 20% of families overturning the wishes of their deceased loved ones. This decision by their families is robbing those in need of a life-saving transplant of a chance to live. It is robbing their loved one of their final wish. This is unconscionable and it has to change.

We can do better and we must do better, and that is why it is so important to talk to family members about final wishes when it comes to organ and tissue donation.

I have met with many people who have allowed the donation of organs and tissue of their deceased loved ones, and every single one of them without exception has said that it was an essential part of their grief and healing process. The ability to find some good in a time of utter grief is profound and everlasting. They want other families to know that sharing a loved one makes accepting the loss so much easier. Their loss has purpose, and their gift has brought unimaginable relief and joy to another family in need. That is the legacy to leave for a loved one.

We have our own reasons for supporting this legislation. Some of those reasons are closer to home for some members than others. Some members themselves or their family members have medical conditions, which means that they know one day they may require a life-saving transplant. Other members in the House are able to love, laugh and live with loved ones because they received a life-saving transplant and are still here with us today. No matter the reason for supporting this bill, it is very much appreciated.

I want to start off by saying hi to everyone. It's good to be back in a HESA committee meeting. I served for five years with you guys and I miss it, but I'm now on the public accounts committee, so that's quite interesting as well.

Mr. Chair, as all of you are aware because I sent you a document indicating my thoughts on the amendments here, in short I cannot support the proposed changes. It changes the scope and it changes the spirit of the bill, which is to get the initiative front and centre on the income tax form.

I want to talk a bit about the bill and the fact that it would not infringe on the provincial responsibilities of managing donor lists. It would just support their existing work.

My proposal is so simple and it could be implemented so quickly. The federal government, via the CRA, already successfully shares, every day, with the provinces and territories via these encrypted networks with strong privacy and reliability safeguards. The existing infrastructure is already in place so there would be virtually no cost to the CRA. The CRA, as you guys know, already shares dozens of data fields on information on every taxpayer with the provinces and territories. This would simply be one more data exchange.

The actual proposal by Mr. Sorbara, in my mind and in many people's minds, would change the scope of the entire bill. It would take it off where you can see it, which is right on the front page of the T1 form. By moving the question off the main income tax return, it becomes a footnote of irrelevance, and the effectiveness is dramatically reduced to the point of being basically pointless. These amendments would allow CRA to put the question somewhere less obvious and it could even be as obtuse as asking people to file a separate form, which nobody would do.

This issue came up in the last Parliament, in the HESA committee, and all the parties were clear that they wanted the question to be on the front page. The CRA was also clear about their ability to do this, as requested and expected by the members of Parliament.

I want to ensure today that the CRA hears loudly and clearly that the expectation of Parliament is to have this addition made on the front page of the T1 tax returns in all provinces and territories. This is déjà vu. We covered the same issue in the last Parliament. I testified at this health committee on the bill, which at the time was Bill C-316. I said that I wanted to ensure that the CRA hears loudly and clearly that the expectation of Parliament is to have this addition made on the front page of the T1 tax returns in all the provinces and territories. I also wanted it made clear that we expect people to have the option to tick a box on that front page, which would basically be a call to action.

I have to indicate also that the CRA was at the committee meeting and it was made clear to them. In fact, Sheila Barnard was at that meeting. She is with the CRA. She is responsible for the legislative changes affecting the T1 returns. She testified and stated that they had understood the intention of the bill to be on the annual tax return.

Mr. Frank Vermaeten, the assistant commissioner with the Canada Revenue Agency, was also there, and he was more direct in confirming his understanding on this issue. He stated:

The front page is certainly a crowded page, especially when you move into the French version of it. That being said, we believe we can put it in that first page. That would be our intention.

Even our colleague Sonia Sidhu discussed it at HESA. She commented, “You said it's possible that, on the T1 layout, we can have a tick box on the front page so it can't be missed.”

That is the point here. If we allow this question or process to be buried, it will be ineffective. I completely agree with her.

Mr. Chair, you also said:

In our discussion, we have talked about the importance of this data capture appearing on the first page of the T1, but it doesn't specify that anywhere in the bill. Is there a way to ensure that this happens?

The CRA, Mr. Frank Vermaeten, said:

I don't think there's a clear legislative way to ensure that this happens. As I indicated, it would be our intent to put it on the front page.

The CRA, then, indicated at the time that it can be done and that they were going to do it. All of a sudden, here we are again: déjà vu.

We have to simply ask ourselves the question: Does the amendment that MP Sorbara put forth strengthen the effectiveness of the bill and better improve the outcomes for those awaiting a life-saving transplant? I believe the answer is painfully obvious and I would strongly welcome your agreement, committee members, in this regard.

We have all worked so hard. I have worked so hard. Parliament has passed this unanimously, up to this point. We have worked hard to make sure that this initiative has been unanimously supported, just as it was in the last Parliament.

There are many people awaiting a life-saving transplant. They would be bitterly disappointed if we wasted this important opportunity and buried the question on some form in the back pages that nobody is going to fill out. Let's show all Canadians that we are united and determined in our desire to truly improve Canada's organ and tissue donation procurement system here in Canada. Please do not support the proposed amendments.

Chair, I will obviously be moving this amendment on Bill C-210, and then I wish to speak on it.

Thank you, everyone, for making yourselves available and hearing me out for a few minutes.

First, it's great to be here. It's great to be speaking on a bill that I know is very important to deputy Webber and is very important to MPs on all sides of the aisle. I'm very galvanized by that. It is within that spirit that I present this amendment. In my view, at the end of the day, it's about increasing the number of registered organ and tissue donors in Canada.

I have some prepared remarks for everyone. I thank you for the opportunity to join your committee today as we look at this legislation that seeks to promote a cause that, it's fair to say, all parliamentarians support—namely, increasing the number of registered organ and tissue donors in Canada. This is an extremely important issue to assist Canadians in desperate need. It is truly a matter of life and death. We need the best legislation possible.

I know we all support the intent of the legislation. I do personally, and I applaud the member for Calgary Confederation for his work and his desire to get this bill passed in the House and the Senate. I too am committed to advancing the bill's objective. That's why I'm advocating certain amendments to make Bill C-210 more workable for the Canada Revenue Agency so that it can be implemented as soon as possible. Hopefully, if Parliament can pass it quickly enough, it would be in for the 2021 tax-filing year. We need to ensure that the legislation proposes the most efficient and effective way for the Canada Revenue Agency to collect this information, and for the process to be efficient and useful for the provinces and territories, who are ultimately responsible and within their jurisdiction for organ and tissue donation.

As Parliamentary Secretary to the Minister of National Revenue, I've made it a priority to examine the legislation in great detail and to discuss it with experts at the CRA who would be asked to implement it. I truly believe this committee should hear directly from those professional experts at the CRA regarding this legislation, especially their experiences with the precursor legislation to Bill C-210 from the last Parliament, Bill C-316, and the CRA's interactions with the provinces and territories on that legislation that occurred.

Nevertheless, I am proposing a strongly recommended amendment to make the legislation more straightforward for the CRA to implement with the provinces and territories, and also to make it so that it can be implemented in the quickest fashion possible. This amendment does not change the objective of the bill, but rather the manner in which the objective will be achieved, to remove potentially significant roadblocks and time-consuming delays.

This simple amendment would do as such. Rather than having the CRA directly collect organ and donor consent on behalf of the provinces and territories, the CRA would collect and share the personal information of individuals wishing to become organ and tissue donors with their respective provinces and territories, which would then obtain direct consent. The amendment, accordingly, would remove references set out in proposed subsections 63.1(1) and (2) of the bill, which would make reference to returns of income filed under paragraph 150(1)?(d) of the Income Tax Act.

Rest assured that under this approach, a form would be included within the T1 return, both a paper format and in certified tax software, asking if the individual wishes to be sent information by their province or territory on becoming an organ and tissue donor. It should also be noted that the notice of assessment would still advise the individual that, in accordance with their request, their information has been forwarded to their province or territory as a potential organ and tissue donor. Once the information would be sent to the relevant province or territory, the province or territory would then be able to follow up with the individual on the actual consent to organ and tissue donation.

This is an important and appropriate role for provinces and territories to undertake, as it is within their jurisdiction as opposed to that of the Canada Revenue Agency. Legal requirements for donor eligibility and informed consent are very complex and vary greatly by jurisdiction in Canada, meaning different provinces and territories have different roles. By having provinces and territories play their proper roles in obtaining consent, we are not only respecting their jurisdiction, but equally important, we are removing an obstacle by eliminating the need for protracted negotiations and complicated agreements with each of the provinces and territories on legal requirements for collecting the proper consent.

With the amendment I am proposing today, our hope is that we would put the federal government in a position to reach swifter agreements with provinces and territories on a more straightforward, simple and efficient approach, which, I understand from CRA officials, might need only months instead of potentially years to achieve.

I repeat, we all want the objectives of Bill C-210 to become a reality, and sooner rather than later. However, for the CRA to meet the earliest window of the 2021 tax-filing year—next year's income earned, when you file your taxes in January to March or the period in 2021—the provinces and territories have to come on board. We need to create the quickest path to make that happen.

I would like to add that the approach taken here, for the MPs who have been elected from the beautiful province of Ontario, would be a similar approach to where information is collected for what's called the Ontario trillium benefit, where a separate page is provided in the tax package, whether it is online or in paper format, and where the information is then passed to the Province of Ontario.

I am confident that our amendment today will do that and make the member for Calgary Confederation's objective a reality, potentially—and most likely—saving the lives of thousands of Canadians.

Chair, thank you for the time today.

To the committee, I wish to again applaud deputy Webber for his efforts over the years in making the bill come to fruition and bringing it this way.

Madam Speaker, it is a real pleasure to stand in the House today and support Bill C-210, with great thanks to my hon. colleague from Calgary Confederation. I had the immense pleasure of serving with him on the health committee for a number of years. I cannot think of a finer parliamentarian and a more collegial, publicly minded representative than he. I am so pleased to support legislation that I know he has fought so hard to make a reality in this place.

This legislation would amend the Canada Revenue Agency Act to authorize the Canada Revenue Agency to enter into an agreement with a province or a territory regarding the collection and disclosure of information required for establishing or maintaining an organ and tissue donor registry in the province or territory. In short, what the act would do is allow Canadians to indicate on their tax return that they wish to have their information shared with a provincial or territorial organ and tissue donation program to help facilitate and expedite the donation of organs and tissues in the country.

Canada's New Democrats believe that we must make every possible effort to ensure that every Canadian who needs an organ or tissue transplant receives it. Just one donor can save up to eight lives and benefit more than 75 people, yet, at 18 donors per million people, Canada's current donation rate puts us in the lower third of developed countries. Allowing Canadians to register as an organ and tissue donor through their tax returns will help increase registration rates, improve consent rates and help build a donation culture in Canada.

This legislation was first introduced in the 42nd Parliament as Bill C-316. Despite passing unanimously in the House of Commons, Bill C-316 was one of several bills that unfortunately were allowed to die on the Order Paper in the Senate before the last election. By the way, the Senate also blocked legislation to give mandatory sexual assault training to federally appointed judges, implement the United Nations Declaration on the Rights of Indigenous Peoples and ban unhealthy food and beverages marketing directed at children.

However, this was a life and death matter. Canadians are currently dying while on wait lists simply because our organ and tissue donation rate is so unacceptably low. At present, only 20% of Canadians have joined their province's organ and tissue registry. Provinces like Ontario are taking steps to make it easier by asking about organ and tissue donations on health card and driver licence renewals, which has increased registrations. However, even when everything is in place, some 20% of families refuse to transplant a registered donor's organs and tissue.

In our recent study on organ and tissue donation at the Standing Committee on Health last Parliament, we learned that of the 4,500 Canadians on the wait list, 260 died waiting for an organ in 2016 alone. In order to better meet this demand, improved coordination across provinces and territories is needed.

Bill C-210 would allow the federal government to coordinate with provinces and territories to allow Canadians to register as an organ and tissue donor through their federal tax filing.

The act would align with the long-standing advocacy and legislative work of New Democrat MPs around organ and tissue donations. The bill is essentially a version of the previous proposal to create a pan-Canadian organ donor registry to coordinate and promote organ and tissue donations throughout Canada.

In February 2016, Conservative MP for Edmonton Manning, whose son had been the recipient of three donated livers, reintroduced a private member's bill calling for a national registry. That bill had been previously introduced seven times by both the Liberals and two New Democrats, Lou Sekora, Judy Wasylycia-Leis and Malcolm Allen.

Unfortunately, the Liberal caucus voted to defeat the member for Edmonton Manning's bill. The Liberals defended their decision to kill the bill, without study, by claiming that it was a matter that was under provincial jurisdiction and it was for that reason the bill was unsupportable.

Leaving that question aside, I want to quote from a couple of important stakeholders. The Kidney Foundation of Canada says, “In an environment where the supply of donor organs is so low and demands are so high, missed opportunities for donation are literally a matter of life and death. Donor organs are rare and precious and every opportunity needs to be pursued to ensure that no potential donation is missed or lost because it also means lost lives of those waiting for transplant.”

Dr. Philip Halloran, professor of medicine at the University of Alberta, said, “Donations in Canada are not performing at the standard that our colleagues in the United States are performing and there isn’t really any excuse except organization and accountability.”

I was therefore quite disappointed to see jurisdiction thrown out by the Liberals as being a barrier to facilitating organ and tissue donation.

Here are a few facts.

While 90% of Canadians support organ and tissue donation, less than 20% have made plans to donate. Unlike the United States, Canada does not have a centralized list of people waiting for an organ or tissue transplant.

The efficiency of donor registration varies greatly from province to province to territory. In the case where someone dies outside of the province where they are registered for organ and tissue donation, it is highly unlikely the hospital would be able to identify them as a donor. Online registration is available only in five provinces: British Columbia, Ontario, Alberta, Manitoba and Quebec.

Even if someone is registered as a donor, the family has the final say. As I pointed out, about one in five registered organ and tissue donors had their wishes overridden by family members, according to a 2016 report in the Canadian Medical Association Journal.

For every patient in Canada who does receive an organ transplant, there are two more on the wait-list. In the past 10 years, the number of deceased organ donors has gone up by 42%, so there is progress, but the number of people needing a transplant has also gone up at the same time. Over 1,600 Canadians are added to the organ wait-lists yearly.

Canada is the only developed country without national organ donation legislation, such as the U.S.'s 1984 National Organ Transplant Act, so it is time that parliamentarians united and addressed this very pressing need. We cannot let jurisdiction, difficulty, party interests and technicalities get in the way of doing what we all know is necessary: We must make it much more efficient and simple for Canadians, who overwhelmingly want to donate organs and tissue, to do so to save their family members and other Canadians.

It is my view that the best system of all is an opt-out system, where everyone is considered to be an organ donor unless they specifically opt out. This respects the rights of everyone who does not, for various reasons, whether religious, philosophical, health or any other reason at all, want to be an organ and tissue donor. There are many countries around the globe that have such a system, and what we see in those countries is that their rates of organ and tissue donations and transplants dwarf Canada's rates. This saves lives.

I hope that all parliamentarians can work together, support the bill, expedite it through this place and ensure that the Senate passes it as soon as possible. Let us do everything we can in this country to facilitate organ and tissue donation and transplantation as soon as possible.

Madam Speaker, we are here today to once again debate the bill to amend the Canada Revenue Agency Act with regard to organ donors. This bill comes from the member for Calgary Confederation, who first introduced it in 2015. It was known then as Bill C-316, and it went as far as first reading in the Senate in late 2018.

This bill seeks to authorize the Canada Revenue Agency, or CRA, to enter into an agreement with Quebec, a province or a territory to be able to collect from individuals via their income tax return the information required for establishing an organ donor registry. This bill also seeks to enable the CRA, if authorized by the individual on their income tax return, to share the information collected with the province or territory in which the individual resides under that agreement.

The Bloc Québécois does not have a problem with this bill and we support it. However, it is unlikely that the Government of Quebec will want to enter into an agreement with the CRA because Quebec already has its own income tax return and, as the Government of Quebec has said and continues to say, we want to implement a single tax return that would be managed by Quebeckers.

This bill does not actually have any bearing on what we want. Again, what is good for Quebec is good for the Bloc Québécois. That said, even if Quebec did want an agreement, we would not have a problem with sharing that information. Quebec is free to sign an agreement or not in this case because this bill does not commit Quebec to anything or limit it in any way. It is when the opposite is true that we strenuously object.

We are fine with letting the CRA collect information and provide it to those provinces that want to participate in such an arrangement. We actually think it makes sense because the CRA handles all the tax returns outside Quebec.

I would point out that the number of transplants performed in Canada has increased by 33% over the past 10 years. Even so, there is still an organ shortage. According to the latest data from the Canadian Institute for Health Information, or CIHI, 4,351 Canadians were on a transplant waiting list in 2018. That is a huge number. That same year, only 2,782 organ transplants were performed in Canada.

For example, the number of Canadians with end-stage kidney disease rose by 32% over the past decade, which partly explains the increased demand for organ transplants.

According to information from CIHI's Canadian organ replacement register, in 2018, there were 1,706 people who received one or two kidneys, 533 who received a liver, 361 who received lungs, 189 who received a heart and 57 who received a pancreas.

I want to thank all the donors who have signed their cards and have consented to organ and tissue donation. It is one of the most noble gestures a person can make, but one that is not easy, I admit. I also want to commend the work done by doctors who specialize in organ and tissue retrieval and those who perform transplants.

We need to do more, however. On December 31, 2018, there were 3,150 people waiting for a kidney, which represents twice the number of kidneys available, 527 waiting for a liver, 270 for lungs, 157 for a heart and 156 for a pancreas. We need to use every conceivable means of reducing this long waiting list.

In 2018, 223 people died while on a waiting list for transplant. That is obviously 223 too many. Every new initiative gives hope and can save a life or lives.

Our great sovereignist family was privileged to be able to count on one very courageous, generous and engaged supporter. Tomy-Richard Leboeuf-McGregor sadly passed away nearly two years ago on November 19, 2018, at the age of 32.

Tomy was born with cystic fibrosis, a serious, degenerative lung disease. Tomy's life not only changed but was actually saved when he received a lung transplant in 2013. Driven by a will to live, to give and to give back to others, he became very committed to the organization Living with Cystic Fibrosis, whose mission is to promote quality of life for people living with cystic fibrosis. He even served as its executive director.

Tomy was a staunch advocate for Quebec independence. He was active in the Parti Québécois and the Bloc Québécois. He ran for the Parti Québécois in 2014 and for Projet Montréal in 2017. One of his goals was to promote organ donation.

I want to say to him and his brother Jonathan, his partner Éric, his grandparents and his two sources of pride and joy, Alexis and his niece Sarah-Joan, that we proudly continue to be his voice and carry on his fight.

For all these rather emotional reasons the Bloc Québécois will be voting in favour of the bill introduced by our colleague from Calgary Confederation, which seeks to amend the Canada Revenue Agency Act with regard to organ donors, on behalf of all these people waiting for a transplant, their family and Tomy.

Mr. Speaker, it is an absolute honour to finally rise again in the House and speak on my private member's bill, Bill C-210.

I first introduced this bill four years ago almost to the day back in October 2016. Back then, it was Bill C-316, which passed unanimously at every stage of the process. Unfortunately, in spite of the widespread support for the bill, it died in the Senate when the 2019 election was called. It was incredibly disappointing, of course. A lot of people worked on this bill with me; stakeholders and friends back home. It was incredibly disappointing, but what can one do? It is just the way it is, the way the cookie crumbles, as my daughters would say, and one just has to move forward.

Fast-forward to December of last year to the private members' business, PMB, lottery date. I clearly remember watching the draw. The Deputy Speaker, the hon. member for Simcoe North, walked into the room with his robes on, and it was really quite formal. He sat in the chair, and there was a big cookie jar with all of our names inside. The Deputy Speaker stood up, picked out a name and, sure enough, it was mine. I was just elated. It was fantastic. Coming from Calgary, I yelled out a “yahoo” Calgary Stampede-style. It was a good feeling, and clearly a divine intervention. I knew then that I had to reintroduce this bill, and so Bill C-316 has now been resurrected as Bill C-210. Here we are today in second reading, and we have this rare opportunity to re-pass this legislation to hopefully and certainly save some lives.

For those who may not already know, I have been a long-time advocate of organ and tissue donation in Canada. In fact, several years ago, I passed a bill in the Alberta legislature as an MLA, which resulted in the creation of the Alberta organ and tissue donation registry. The bill also put in place some strong and robust education and awareness programs that have included adding donor hearts to our Alberta driver's licences.

The reality is that 4,600 Canadians are still awaiting a life-saving transplant, and we need to do more to find those critical matches to save lives. This is an issue that transcends political lines and offers us, as parliamentarians, the opportunity to make a difference in every corner of this country.

It is disappointing that while over 90% of Canadians say that they support organ donation, only 20% have actually registered on their provincial or territorial registries. Every year, this country sees hundreds of people dying waiting for a donor. Sadly, Canada has one of the lowest donation rates in the world. A single donor can save the lives of up to eight people, and a single tissue donor can help up to about 75 individuals.

My Bill C-210 proposes a very simple and effective method to increase the size of the organ donor base here in Canada. It would also help update existing databases but, most importantly, it would save lives. I am proposing that we use the annual income tax form to ask Canadians whether they would like to register as organ donors, and whether they consent to have this information passed to their provincial government for addition to its existing organ donor registries, and that is it. This is a very simple bill that would add the very simple question to our income tax forms. The federal government would simply collect the data and pass it on to the provinces.

We would not be encroaching on provincial jurisdiction because we would not be setting up a federal registry. That was already tried once in this House, back in 2015, by the hon. member for Edmonton Manning in his PMB. He wanted to create a national organ and tissue donation registry. It failed in this House, due to the fact that the government cited jurisdictional encroachment.

This bill would provide the information to the provinces. The provinces would use that information as they see fit. The provinces would still maintain their own lists. We would just be supplying them with that data.

The tax form, by law, is restricted to collecting data for the purposes of taxation only. That is why it is required to amend legislation to allow for this common sense approach to a national problem. I modelled my bill on the successful inclusion on the income tax form of the question that asks Canadians if they want Elections Canada to be kept informed of their current information. That question is on the first page of the form. My bill has been crafted in keeping with that successful precedent.

This proposal is so simple and could be implemented so quickly. The federal government, via the Canada Revenue Agency, already successfully shares data every day with all the provinces and territories via encrypted networks with strong and reliable privacy safeguards. In addition, the existing infrastructure at the CRA would support this change at virtually no cost. The CRA already shares dozens of data fields of information on every taxpayer with the provinces and territories and this would simply be one more data exchange. The income tax form is a way to update this information annually, via a legally binding document. Thus, it would allow for provincial lists to remain current and relevant year after year after year.

Before I go any further, I would like to thank the 20 members of Parliament from all parties in this House who have come forward to officially second my bill. That is a rare occurrence indeed; it has happened twice. It happened in my last bill as well, which was not successful.

This extraordinary non-partisan approach demonstrates how a sensible idea can bring us together as a House to improve the lives of Canadians. This collaborative approach also extended to the health committee. I served on that committee in the last Parliament, along with nine of my colleagues, one of whom is looking over here right now and giving me a big smile. They have been extremely supportive of improving the organ and tissue donation situation here in Canada.

The health committee conducted a study and tabled a report on organ donation with several recommendations. The committee specifically wanted to know what role the federal government could play in strengthening Canada's organ donation and transplantation procurement system. One of the key recommendations in that report deals directly with a debate that we are having here right now. If this bill is passed, it will fulfill that key recommendation.

I also want to thank the government for taking the rare and possibly unprecedented step of allocating funding for this initiative before it has even passed in this House. That is a fact. We have the will, we have the funding, and now all we need is our reapproval here in this House.

This is not a political issue. It is a human issue. Any one of us could be in need of donor organs or tissues at any time. Just asking the simple question could increase the number of donors. Donor registration jumped 15% in British Columbia when drivers were asked directly at licencing locations across their province if they wanted to be donors. They are also doing it in Alberta, as a result of a bill that was passed when I was an MLA there. Imagine what we could do on a national scale with the income tax form.

As I mentioned, the Canada Revenue Agency has already been allocated the funding for this purpose, but needs the law changed so it can proceed. While some methods used by provinces and territories, such as drivers' licences and health care cards, help register donors, none has as far a reach as the income tax form. The existing voluntary online method of registering is neither proactive nor fully effective. For example, those who move from one province to another rarely update their information. The income tax form approach overcomes these common problems.

Stakeholders have been universally supportive of the bill and the thousands of affected families with loved ones on waiting lists will welcome this additional help. One stakeholder, the Ontario Trillium Gift of Life Network, is the largest registry in Canada and its CEO, Ms. Ronnie Gavsie, said:

...we would support creating an opportunity for Canadians, when filing their income tax returns, to register their consent for organ and tissue donation.... The online income tax return becomes a gateway and an annual reminder to drive Canadians to organ and tissue donor registration.

We share with you the goal of substantially improving awareness of organ and tissue donation and improving health of Canadians by increasing the number of life-saving transplants.

I thank Ms. Gavsie for sending that.

Also, the federal agency responsible for organ donation is Canadian Blood Services and its vice-president, Dr. Isra Levy, said, “Just like our colleagues, we support a transactional touchpoint that will raise awareness, especially if it leads to the conversation.... But for sure this is to be welcomed.”

Elizabeth Myles of the Kidney Foundation of Canada wrote to the Prime Minister expressing the foundation’s support for this change. Dr. Amit Garg of the Canadian Society of Nephrology, a society of physicians and scientists specializing in the care of kidney disease, and Dr. Lori West of the Canadian Donation and Transplantation Research Program in Edmonton have also expressed their strong support for the bill. The list goes on. Support for this legislation reaches far and wide across the country and into every community.

In conclusion, we have the opportunity to leverage the resources of the federal government to help our provincial and territorial partners improve their registries. I hope we seize the opportunity and run with it. I and, most importantly, the 4,600 Canadians awaiting life-saving transplants hope we can count on all MPs for their support. We have shown leadership in the past by passing this bill unanimously at all stages, so I call on the members of this House to do the same. This bill got a rare second chance and I hope we can pass it so that people in dire need of the gift of life can get a second chance as well.

Hello, Minister. Thank you for being here today.

I have an important question to ask you about my private member's bill, Bill C-316, which would allow Canadians to indicate their intent to register as organ and tissue donors on their income tax forms.

Everyone on this committee supported it. We passed it unanimously in the House back in December and it is now in the Senate. I was also pleased that you and the government allocated funding as well for this implementation in your fall economic statement. The Canada Revenue Agency also says that if the bill is passed soon, they can get it on the 2019 income tax forms.

However, I am told by several senators, from all parties, that this bill might not pass because it has become a political football in the Senate. Senators do not have a problem with my bill, but they apparently are trying to use it to leverage other pieces of legislation, so it's a type of Mexican standoff. While I understand this happens in politics, we are now seriously risking losing a life-saving, sensible and affordable change to our tax forms, and of course, hundreds of Canadians will continue to die waiting for a life-saving organ.

Is there anything you can do, or are willing to do, to ensure that Bill C-316 can get passed?

Mr. Speaker, I will be brief as well.

In the week since we have debated this legislation, five more Canadians have died awaiting a life-saving transplant. Delays are costing lives at a rate of five per week.

Bill C-316 has been unanimously supported through a health committee study and it has been unanimously supported by all parties at second reading. The bill was unanimously supported by health committee when it reviewed it. Bill C-316 has had all-party unanimous support in every single vote it has faced to date.

In a moment, the Speaker will ask for a unanimous decision on the bill. If it passes on a unanimous voice vote, the changes will make the 2019 tax return. If someone forces a recorded vote, this will not take place until next year and we will miss that 2019 deadline. The changes will only be on 2020 tax returns. In that year, 250 Canadians will die waiting for a life-saving transplant.

Bill C-316 will be the last private member's bill debated in this chamber for a very long time.

Everything that needs to be said has been said. Everything I wanted to say I have said. There is nothing more really to be said.

Mr. Speaker, I am pleased to rise today to debate Bill C-316, an act to amend the Canada Revenue Agency Act with regard to organ donors, introduced by my colleague from Calgary Confederation.

My colleague's bill would authorize the Canada Revenue Agency to enter into an agreement with a province or a territory regarding the collection and disclosure of information required for establishing or maintaining an organ and tissue donor registry in the province or territory. With authorization from the taxpayer in their last tax return, the CRA could disclose to the province or territory the individual resides in the information collected under the agreement.

The NDP supports this bill. We firmly believe that we must take all necessary steps to ensure that every Canadian gets the organ or tissue transplant they need. This is not new to us. Since 2002, two NDP MPs on five occasions have introduced a bill to create a Canada-wide organ donor registry and to coordinate and promote organ donation across Canada.

This bill is essentially a weaker version of what we have been calling for for some time in order to allow anyone who needs a transplant to have access to the organs or tissues needed.

In this Parliament, the Conservative member for Edmonton Manning, whose son has received three liver transplants, had once again introduced a bill to establish a Canadian organ donor registry. Bill C-223 was debated in the House in 2016, but was defeated when the Liberal caucus voted against it. The health minister at the time, who is currently Minister of Indigenous Services, defended that Liberal Party decision by saying, “This is a matter that is under provincial jurisdiction, and it is for that reason that the bill was unsupportable.”

It is interesting that the Liberals claim to be the great champions of the provinces when it suits them, but then impose their decisions in other situations. That is another story.

That being said, we truly hope that this time the Liberals will support this new bill that essentially seeks to have the federal government collaborate with the provinces and territories to help them implement their own organ and tissue donor registry. What everyone in the House needs to realize is that Canadians registered on a waiting list to get an organ or tissue transplant are dying, in part because of our low donation rate.

Currently only 20% of Canadians are registered organ and tissue donors in their province or territory. Some provinces and territories are already taking steps to increase the number of registered donors, but, unfortunately, despite these initiatives, far too few people consent to have their organs or tissue removed and transplanted to people in need.

According to a recent study by the Standing Committee on Health, in 2016 alone, 260 out of 4,492 people registered on a transplant list died before getting the organ or tissue they needed to survive. These are our fathers, mothers, sisters, brothers and children. This has to stop. Losing one person is one too many.

The NDP believes that, by passing the bill, the federal government could help without interfering in provincial jurisdiction. I will say it again: if it is passed, the bill we are debating today will make it possible for the federal government to co-operate with the provinces and territories and make it easier for people to sign up to be organ donors.

Of course, special measures would have to be implemented to ensure that taxpayers consent to giving personal information to their province or territory of residence so they can be added to an organ donor registry, as it would otherwise not be possible to forward this type of information to other levels of government.

One donor can save up to eight lives and help more than 75 people by consenting to the harvesting of organs or tissue. Unfortunately, as I mentioned earlier, Canada is lagging behind when it comes to organ donation. In fact, Canada's donation rate of 18 donors per million people puts us in the bottom third of developed countries.

The objective of this bill is to increase the number of donors by making it possible for Canadian taxpayers to register with their province's or territory's organ and tissue donation registry by providing their consent on their income tax return.

This legislative change will improve the consent rate and promote a culture of organ and tissue donation in Canada. Many health professionals and organizations support this bill and additional incentives for people to consent to organ and tissue donation. All it takes is a little political will.

I would also like to take this opportunity to speak directly to everyone tuning in and strongly encourage them to sign up for organ donation using whatever procedure their home province or territory has in place and, most importantly, to discuss their wishes with their family members.

I really want to emphasize that last point because, unfortunately, even if a person has made the choice to be an organ donor, family members have the final say. According to a 2016 Ontario study in the Canadian Medical Association Journal, families vetoed the donor's wishes in one in five cases, which is huge.

I would also like Canadians to keep in mind what I said earlier, and that is that one donor can save up to eight lives and improve the quality of life of 75 people through tissue donation. What is more, age does not prevent people from becoming donors. In fact, the oldest organ donor in Canada was over 90 years old, and the oldest tissue donor was over 100. Medical history also does not prevent people from registering as donors. People with serious illnesses can sometimes donate their organs or tissue. Each potential donor is assessed individually.

If this bill is passed, Canadians will have a new way to consent to donating their organs and tissue. They will be able to do so via their income tax return and by consenting to allow their personal information to be shared with their province or territory of residence. If the bill does pass, I strongly encourage people to use this method. It will save lives.

I want to take advantage of this opportunity I have to address the House today to thank all those who work behind the scenes and who make us look good every day and to wish everyone an excellent Christmas break. With the subject of Bill C-316 in mind, I ask everyone to be very careful over the holidays, especially on the roads.

Madam Speaker, it is my pleasure to rise today to speak to Bill S-248, a Senate bill that was brought forward to the House by the Conservative member for Sherwood Park—Fort Saskatchewan. I know the member is passionate about this issue and has worked hard to bring this legislation to this point, so I thank him.

The RCMP has stated the obvious. It says that there are far more people in the world in need of a new organ than there are organs available. As in any market where a dollar can be made because demand far outweighs supply, people can turn to the black market to find what they need. When a person's life is on the line, the will to survive may override morals.

As members in the House may know, I have been a passionate advocate for finding improvements to Canada's organ and tissue donation systems. While 90% of Canadians support organ donation, just 20% are registered as organ donors. There are 4,500 Canadians desperate for a life-saving transplant, and 250 die each year before that life-saving transplant becomes available.

If we can increase the supply of organs, we can reduce or eliminate the desperation that leads people to take such drastic measures to save their own lives.

The problem of organ trafficking is not just a Canadian problem. The World Health Organization says that 10% of all organ transplants involved a trafficked organ. This is about 10,000 a year, every year.

The country of Iran stands alone in the world as the only nation with a legal organ trade. However, the trade is closely monitored and it has eliminated the wait-list for kidneys. However, I do not believe the end justifies the means either.

On a positive note, it has spurred the rate of donations from deceased donors in Iran. It is important to note that deceased donors are not paid.

Organ trafficking is a horrible phenomenon that can be crudely reduced to this: Rich nations take advantage of poverty in poor nations to satisfy their need for organs. A Harvard study showed that the main purchasing nations were the United States, Australia, the United Kingdom, Israel, Japan and, yes, Canada. We target nations in South America, Asia and Africa. In Indian alone, it is estimated that 2,000 kidneys are sold each year.

This trade is big business. Profits are estimated to be between $600 million U.S. and $1.2 billion U.S. per year.

Organ trafficking is done through what is generally known as “transplant tourism”. Those in need of a transplant travel to one of these poorer nations to undergo their transplant under the auspices of a vacation. There are even websites that offer all-inclusive transplant packages for these so-called tourists. A kidney transplant, for example, will mean a transplant vacation costing anywhere from $70,000 U.S. to $160,000 U.S. Canada does not have a law that prevents this.

While kidneys are the most commonly traded organ, it does not stop there. Other common transplants involve hearts, livers, lungs, pancreases and corneas. Human tissue is also illegally traded.

The trade involves three basic groups, according to the United Nations' global initiative to fight human trafficking: traffickers, who force or deceive victims into giving up an organ; victims who have their financial desperation used against them to give up their organs; and victims who are deceived into a medical procedure during which they have an organ removed without their prior knowledge.

Like any other illegal trade supported by organized crime, there are many layers of offenders. There are the recruiters, both for donors and recipients; the vulnerable people, who are the victims; the immoral medical people and facilities; the buyers; the facilitators; and more.

What do we do to address this problem? Of course, if we had enough donors in Canada, people would not be desperately mortgaging their homes or spending their retirement savings to get that life-saving transplant.

I do not blame people who are facing death for taking whatever steps they can to save themselves. They are just as much a guilty party in this trade as they are a victim of the trade. However, we need to take a stand on this issue if we are to stop it.

Before I go any further, it is important to clarify this would not prevent a truly informed and consenting person from donating an organ to someone in need. We are talking about unethically obtained organs.

Bill S-240 seeks to amend the Criminal Code to create new offences in relation to trafficking in human organs. It would also amend the Immigration and Refugee Protection Act to provide that a permanent resident or foreign national would be inadmissible to Canada if the Minister of Immigration, Refugees and Citizenship were of the opinion that he or she had engaged in any activities relating to trafficking in human organs.

We face an interesting problem in the world of illegally obtained organs. Unlike other contraband items, customs officers cannot just seize an organ at the border. How can we tell if that tourist coming back to Canada has the same heart he or she left with weeks earlier? It would be a very difficult crime to detect. In many ways, the only way to detect this activity would be when those Canadians would go to their doctor, who suddenly would notice they had surgical scars and signs of a new organ.

Section 240 of the bill would require health professionals to notify a designated authority of such activity for investigation. Anyone found guilty of contravening these new prohibitions would be subject to up to 14 years in prison. I have concerns about the kind of relationship this would set-up between doctors and patients, but there really is no other way to do this.

Where does that leave us today? There is a saying that I think is very appropriate here, “When all is said and done, there is often a lot said and little done.” There have been four bills before Parliament in the past 10 years on organ trafficking, but yet we stand here today and continue to talk. It is time we get something done instead. Until we take aggressive steps to stop organ trafficking, the practice will continue to victimize thousands more every year.

Let us get the legislation enacted before the next election. If we do not, the whole process would have to start all over again. What a waste of time and money that would be. Thousands more could be victimized in the process.

At the same time, let us pass legislation like Bill C-316, my bill, which would help eliminate the demand for organ trafficking. Let us also focus more effort on acting on the recommendations of the health committee to improve our domestic supply of organs and tissues. Let us better promote the registration of organ and tissue donors, so our supply will exceed our demand. Honestly, imagine a day when people come to Canada to get a life-saving transplant because we have too many available organs. Would that not be an amazing goal?

Again, I applaud the Conservative member for Sherwood Park—Fort Saskatchewan for putting the legislative proposal forward in the House. I look forward to voting in support of it.

My colleague, Mr. Webber, introduced Bill C-316, which was agreed to unanimously. We are all following this issue closely. Many of my colleagues and I would like this to be implemented as quickly as possible.

You raised another important topic. There has been an increase of $500,000 for the purpose of education and awareness-raising about the effects of cannabis, following its legalization last October.

How are you going to approach public education on cannabis? It's not about advertizing, but about providing information to young people and their parents Canada-wide. Young people will become adults, and they will be able to consume cannabis, or not. Before consuming cannabis they have to know what it is.

How do you intend to better inform the population on the adverse effects of cannabis, particularly young people of less than 25? It has been shown very clearly that cannabis has deleterious effects on young people. What are the next steps?

Madam Speaker, before I get to the topic of my late show question, I do have to say that it is disappointing this evening to again see the government talk out, and therefore deny, the opportunity to expedite a good private member's bill. Bill C-316 was debated tonight, and it would have been excellent if that debate had been allowed to collapse so that we could have ensured that it would meet the CRA deadline to get organ donor information included on tax forms. However, as we have seen on a number of occasions from this government, it insisted on filling the time and thus not allowing this good private member's to pass, even at the risk of the bill not now passing in time before the next election.

Nonetheless, I do want to address the issue of Christopher Garnier tonight. This issue has really captured the attention of Canadians. He is a person who received veterans benefits even though he never actually served in the Canadian Armed Forces. He received benefits related apparently to PTSD he acquired as a result of his commission of a terrible crime. The crime was the murder of Constable Catherine Campbell, who did serve her country as a volunteer firefighter and a police officer.

This obviously offends the sensibilities of veterans, as well as all Canadians, who were shocked to learn that someone who had committed a crime in Canada and never served in the Canadian Armed Forces was and is receiving benefits that are supposed to go to Canada's veterans. The government at the time did not provide meaningful answers. Subsequently, in response to our questions and advocacy, the Liberals have brought in policies that, hopefully, will prevent this kind of situation from happening again. Obviously, that is a positive step, but it remains the fact, as far as we know and have been told, that Mr. Garnier continues to receive those benefits.

Notwithstanding any policy changes in the future, I want to ask the parliamentary secretary about this specific case. Does he believe that Mr. Garnier should be receiving these benefits, which arise not from his service to this country, but rather from the apparent PTSD he got as a result of his terrible crime of murdering Constable Catherine Campbell? Does the parliamentary secretary believe that Mr. Garnier should still be receiving those benefits? Does he believe that? If he believes Mr. Garnier should not be receiving those benefits, then why will the government not act to ensure that in this specific case those benefits will not continue? If he does not believe that, maybe he should explain why he believes this person should still receive those benefits.

Again, should Christopher Garnier continue to receive benefits from Veterans Affairs despite never having served his country?

Madam Speaker, I am extremely pleased to rise today in support of Bill C-316. I would like to thank the member for Calgary Confederation for bringing this forward.

One of my friends once told me that the best speeches are given from the heart, that it is not about great notes or somebody who writes us a good speech. My speech today is coming from the heart. I am going to tell a little story about Nick. I did speak to Nick and I asked him if I could speak in the House on why this was so important and why it was important to him.

I first met Nick 21 years ago when he showed up at my door with my oldest son. He was an eight year old. As soon as he walked into the house, I noticed he was coughing. I asked him if had a really bad cold and he said, no, that he had a chronic disease called cystic fibrosis and because of that he had a hard time breathing and a lot of digestive problems. He explained the whole disease to me. Nick became a huge part of our lives. He was my son's best friend through his whole time growing up.

Nick's medication was kept in our cupboards. Oftentimes Nick would spend the night and he needed it to survive. Nick would come to the cottage with us and he would bring his breathing machine and his medications, but he never let it slow him down. There were a couple of times as Nick was growing up that he ended up in intensive care in the Halifax hospital because of his condition. A number of times we sat our son down, because they were very close, they had been friends since they were very young, and we told him we did not know if Nick would get out of the hospital. We had those conversations and we always knew it was a possibility. It was always really tough, when dealing with a young child and our own kids, trying to explain to them that this could happen.

Nick was amazing. He continued to beat the odds and he got out of the hospital both times. I remember when the Children's Wish Foundation asked him what his wish would be. Unfortunately, at that point in his life, he was very sick. He said that what he really wanted to do was make memories with his best friends. Therefore, Nick, my son and one of their other friends went to the big city for the weekend. The foundation gave them money to go shopping. They went to movies, ate steaks and they made memories. To this day, at 29 years old, when they get together, they still talk about it. It was just such a wonderful thing.

However, as everyone else was moving on, going to school and getting degrees, Nick was struggling more and more as he got older. Nick continued to go to university. He would oftentimes go for a semester and then have to take a semester off because he was too sick to continue. His dream was to become an architect. He continued to go to university and then he would take time off because of his health.

About a year and a half ago, Nick got very sick. I remember talking to him and him saying to me, “It's like I'm breathing through a straw”. If we think about that, how would that feel? Every breath we take and feeling like we are breathing through a straw.

Nick was put on the waiting list for a double lung transplant and he continued to deteriorate. One of the challenges for individuals who are that sick is having to deal with this. We live in a province that does not do transplants. Nick had to go to Toronto to have this transplant. His family needed $20,000 to be raised in our community in order for him to live there while he waited. Unfortunately, Nick ended up in intensive care on life support, waiting, because he was failing so badly.

However, this is a great news story. In July, Nick got a double lung transplant. It was a 10-hour surgery. He was on life support before the surgery. He is doing great. He is out of the hospital. He is back home. He says that he will never take for granted every breath he takes. One of the things he is also very cognizant of is that somebody else died in order for him to have the transplant.

It took almost two years for him to get a lung transplant. It is so important for us to sign donor cards and to ensure we have bills like this that will encourage more people to become donors so people like Nick are not left waiting for two years.

I am really pleased Nick is doing as well as he is. I want to thank the member opposite for the bill. It is very important that we continue to support these initiatives, that we continue to work with the provinces and territories and ensure we play a leadership role in transplants, ensuring they are available to people.

It would be great if there were some way we could also support people financially so the communities do not have to raise as much money to send people to places like Toronto for their surgeries.

Madam Speaker, it is a pleasure to rise to speak to Bill C-316. I want to start by congratulating the member for Calgary Confederation for bringing the bill forward to the House of Commons and doing it in a manner that sought the support and input of many Canadians, and members of the House as well.

The bill itself recognizes the value of organ and tissue donation and transplantation and the important role that plays in protecting the health and safety of Canadians. I think all of us at some point or other in our lives have known people who have been confronted with that situation, whether a family with a loved one who is on a wait-list, or someone else needing an essential organ or transplant for their future survival and ability to continue to live a good quality life, or a family that has to deal with the grief of losing a family member and is faced with a difficult decision at the time of their sudden death. That cannot be easy. I think we have all heard of many of these stories and situations.

The bill allows people to reflect upon their own lives and those of others around them. It gives them the opportunity to make a very important decision on what will happen to their organs and tissues upon their death, so those kinds of decisions are not left to others and family members at a time of tremendous grief.

My colleague, the member for King—Vaughan, who spoke earlier was very emotional in her speech, but was certainly able to relate to this particular situation in a way that many of us cannot. She talked about her own family and how this issue has hit the heart of it, with the emotional decisions and trauma of having a family member who might need an organ transplant at some point, and their reflections on that decision. Obviously, this bill will go to heart of what many Canadians and many families might face in this difficult situation they might face in the future.

We also know that the bill before us today is one of the pieces of legislation the Minister of Health and our government have been following through on in their mandate. The minister has been working with provinces and territories on this very legislation to try to facilitate some collaboration, some partnership, across the country when it comes to an organ and tissue donation and transplantation system that would give Canadians timely and effective access to the kind of care they need.

I think most of us who listened to our colleague from the NDP cite the statistics of the numbers of people currently on wait-lists for organ and tissue donations and transplantation and of those who have died waiting can agree that far too many people are still on those wait-lists.

We can also agree that far too many Canadians die waiting, waiting for organ and tissue transplants that are necessary for them to continue to live and have a good quality of life.

I do not think any Canadian wants that to happen. It is all our responsibility to allow for a system that will ensure more people become organ donors, that there is a system in place to allow those who need transplants to get them. It is all our responsibility as Canadians that if we can bring life to someone, we bring life to that person.

In my riding, I have a very close friend and a family that went gone through such an experience. The family was faced with the decision upon the death of its son, which was very sudden, on whether to donate his organs for transplantation. That was a difficult decision, one I cannot even imagine. At a time when his parents were already shocked, heartbroken and in despair, they made a decision that their son's organs would be donated and used for transplantation.

Just recently, they had the opportunity to meet an individual who received one of those organs, an individual who today is enjoying a good quality of life, bringing joy to his family, to his grandchildren, watching his grandchildren and his children continue to grow and be a part of their lives.

As difficult as it was for her, her husband and her daughter at that time, knowing that in some way their son had been able to give this gift of life helped them through what had been one of the most tragic and difficult situations in their lives. It has helped them look at grief in a different way.

It was probably a couple of weeks ago when I was listening to CBC Radio's The Current one morning. She was on the radio, talking about this situation and so was the recipient who had received the heart as part of that donation. It was one of the saddest yet most inspiring stories I had heard in a very long time.

I do not think any of us wish for any family to be placed in that situation. By allowing this as a question, as a part of the Canada Revenue Agency work that it does through the application process, in reaching out to all Canadians, creating that awareness and allowing Canadians to make that decision to become a donor, we not only give them a sense of comfort in the decision they make, but we give their families a sense of comfort as well. Hopefully, at the end of the day, we are able to bring light to more Canadians who need it.

I am happy to support Bill C-316. I know many members of the House will, including government members. I am proud of the fact that as a government we have already stepped up to do many of the things outlined in the bill. In addition, we have been able to invest more into research related to transplantation, this year it is $100 million additional, to ensure these transplantations are successful.

We are continuing to work with research agencies, with science, along with families to ensure we can improve the system of organ and tissue donation in Canada.

Madam Speaker, I am pleased to stand on behalf of the New Democratic Party of Canada. All my colleagues in our caucus and I offer our support to this important bill.

Canada's New Democrats believe that we must make every possible effort to ensure that every Canadian who needs an organ or tissue transplant receives it. We know that one donor could save up to eight lives and benefit more than 75 people, yet at 18 donors per million people, Canada's current donation rate puts us in the lower third of developed countries. Therefore, I particularly welcome this bill as an attempt to try to remedy that unfortunate state of events, because allowing Canadians to register as an organ donor through their tax returns will no doubt help increase registration rates, improve consent rates and help build a donation culture in Canada.

By way of background, Canadians are currently dying on wait-lists because our organ donation rate is so unacceptably and unnecessarily low. At present, only 20% of Canadians have joined their province's organ and tissue registry. Provinces like Ontario are taking steps to make it easier by asking about organ donations on health card and driver's licence renewals, which has increased registration. However, even with everything in place, some 20% of families refuse to transplant a registered donor's organs.

In its recent study on organ donation, the House of Commons Standing Committee on Health learned that of the 4,492 Canadians currently on the wait-list, 260 died waiting for an organ in 2016. In order to better meet that demand, improved coordination across provinces and territories is absolutely required.

Bill C-316, the bill before the House, allows the federal government to coordinate with provinces and territories to allow Canadians to register as organ donors through their federal tax filing. In this case, individuals would be required to consent to the sharing of their information before the agency would share that information with the provincial and territorial levels of government for the purpose of receiving information that hopefully would result in their being added to an organ donor registry.

I pause here to say that, in my view, it would be better if there was a box on everybody's tax return that taxpayers could check off to directly indicate they want to be a donor and the information would go straight to an actual organ donor registry. That is not what this bill does; however, in my opinion, it is worthy of support, because I think it will improve the situation, but I think that a more direct portal and a national registry is ultimately a better way to go.

Of course, this bill aligns with the long-standing advocacy and legislative work of New Democrat members of Parliament around organ donation. This bill is essentially a version of a previous proposal to create what I just referred to, a pan-Canadian organ donor registry, that would coordinate and promote organ donation throughout Canada. That bill had previously been introduced seven times both by Liberals and New Democrats. Judy Wasylycia-Leis, a New Democrat member of Parliament from Winnipeg, introduced a bill in 2002, 2003 and 2008. Malcolm Allen, who was a New Democratic Party member of Parliament from Welland, introduced a bill in 2009 and 2013. Unfortunately, of those five times that New Democrats have introduced bills to set up a pan-Canadian organ donation registry, neither the Conservative nor Liberal governments have ever taken up that excellent idea that would save lives.

I want to share some facts with members and any of the Canadian public who might be watching this debate.

While 90% of Canadians support organ donation in concept, less than 20% have made plans to donate. Unlike the United States, Canada does not have a centralized list of people waiting for an organ. The current Liberal government voted against a bill in 2016 that would have supported the creation of a national registry to align with the United States to help identify those wishing to donate an organ and those who need them.

That leaves us with a patchwork of provincial and territorial systems, the efficiency of which varies greatly from province to province. In the case where someone dies outside of the province where the individual is registered for organ donation, it is unlikely that the hospital would be able to identify the individual as a donor. This is one of the reasons that a centralized national registry is so much better.

Online registration is available in only five provinces: my province of British Columbia, Ontario, Alberta, Manitoba and Quebec. Even if someone is registered as a donor, the family always has the final say. In Ontario, about one in five registered organ donors have their wishes overridden by family members, according to a 2016 report in the Canadian Medical Association Journal.

To put this into perspective, for every patient in Canada who does receive an organ transplant, there are two more on the wait-list. In 2016, over 4,500 people were waiting for organ transplants, 2,800 organs were transplanted and, again, 260 people died waiting for a transplant that never came.

In the past 10 years, the number of deceased organ donors has gone up, but the number of people needing a transplant has also gone up. In fact, over 1,600 Canadians are added to organ wait-lists yearly. While most Canadians consent to donate after death, it is also possible to donate organs while one is still alive. Living donors who are the age of majority and in good health can donate a kidney, part of their liver or even a lobe of their lung. About 1% of Canadians who die in hospital donate an organ, but 99% do not, which works out to about 18 per million, about half the rate in countries such as Spain, which is 34 per million, and the United States at 26 per million.

I want to talk about the presumed consent system, because that is why countries like Spain and other European countries have organ donation and transplant rates that are twice as high as Canada's. It is because they have moved to a presumed consent system, which means that every citizen is presumed to consent to be an organ donor unless they choose otherwise. Individual choice, of course, is respected, but it vastly increases the pool of people who are available for organ donation.

The truth is, as I said earlier, over 90% of Canadians agree with the concept of organ donation, but it is difficult or confusing for them to know how to do that, and so most of those wishes go unexpressed. However, if we changed our system to a presumed consent system, we would have the best of all worlds. We would still respect individual choice for those who, for a variety of reasons, do not want to donate, but we would vastly increase the number of organs and tissue available for donation and hence save the lives of so many more Canadians who are waiting for an organ transplant.

It is funny that Canada is the only developed country without national organ donation legislation such as the 1984 U.S. National Organ Transplant Act. The comments that I am making were borne out repeatedly when we studied this bill at committee, and I will read some of the comments we received from people with respect to a national database.

Dr. Norman Kneteman, professor and director, Division of Transplant Surgery at the University of Alberta said that:

...the Canadian Transplant Registry that CBS has built is in place; the computer system exists. The challenge is how we get the information into it. In Canada, all the reporting and transplant and donation in our history has been voluntary, and because of that, it's full of defects; it's not reliable. We have to get beyond that, and we need to be thinking about how we are going to fund the activity of getting the information into the database so the professionals, the researchers...have something to work with.

The Kidney Foundation of Canada backed that up. It said:

Currently, there is a lack of data concerning missed donor opportunities in Canada, which stems from inconsistency in the frequency, methods, and scope of data collection between jurisdictions. Furthermore, this data is not centrally accessible to patients on the waitlist, researchers, clinicians, administrators, or policy makers. Current Canadian approaches to measurement and reporting of potential donor identification and referral are fragmented and lack consistency, timeliness and accessibility of information.

It is rare that one can identify a policy response to a problem that is so obvious and achievable. We need a national organ donor registry in this country. We need a presumed consent system in this country. Why? It is because those two policy initiatives have been identified by all the stakeholders and all the experts. We know that it will increase organ and tissue donation in Canada and save lives. The New Democrats will continue to work towards those ends.

Madam Speaker, first, let me thank the member for Calgary Confederation for introducing his private member's bill and for his tireless and passionate work on this issue. His personal commitment to this and the co-operative way he has worked with MPs from all parties has moved members of the House, as demonstrated by the unanimous all-party support Bill C-316 received at second reading.

I would also like to acknowledge the member forEdmonton Manning for his early advocacy on this issue and his private member's bill and, more recent, Motion No. 189, organ and tissue donation, brought forward by the member for Thérèse-De Blainville.

Our government understands that organ and tissue donation and transplantation is an important part of our health care system that relies on the generosity of Canadians to give the gift of life. We know many Canadians, when approached, are willing to be a donor, however, reaching them to get that consent is hit and miss.

We all recognize that more work is needed to address the chronic shortages of organ and tissue donations for transplantation across the country. It goes without saying that transplants not only save lives, but also drastically improve the quality of life for the recipients. In some cases, transplants are the only treatment for end-stage organ failure.

The Canadian Transplant Society notes that more than 1,600 Canadians are added to organ wait-list every year. In 2017, more than 4,333 people were waiting for transplants across Canada. That same year, 2,979 organs were transplanted.

Over the past decade, the number of deceased organ donors has gone up by 42%, so that is good news. While that is encouraging, unfortunately, the number of people needing a transplant has also gone up during that same time. In many ways, we are not making progress and many people are continuing to suffer.

Hundreds of Canadians could no longer wait, and did not get a transplant in time. In 2017, 242 people died while waiting for a transplant.

As our population ages, the need for transplants will only increase. Any one of us could one day find ourselves in need of a donation. As I have mentioned before in previous debates on the bill, and I am sorry, I am getting a little emotional, my sons have a very rare genetic condition resulting in serious heart disease. The only option currently for my eldest when his heart fails to pump effectively is to have a heart transplant. I am hopeful for more options in the future through cardiac and transplant research. However, we must do more to ensure Canadians have timely and effective access to the care they need.

That is why the government is standing in support of Bill C-316. By working together, we can improve the organ and tissue donation and transplantation system and ensure that Canadians have timely and effective access to that care.

Bill C-316 would enact a provision that would authorize the Canada Revenue Agency to enter into an agreement with a provincial or territorial government to collect information required for establishing or maintaining an organ and tissue donor registry in the province or territory.

Specifically, the CRA would collect and share personal information for individuals who wish to receive information from their provincial or territorial government on becoming an organ or tissue donor. A memorandum of understanding with the willing provinces and territories would need to be signed so the CRA could share information from potential donors. To this end, the CRA would work diligently with provincial and territorial governments to put these agreements in place.

Canadians can be assured that we are committed to improving the organ and tissue donation and the transplantation system.

In the meantime, people need to know that registering to donate is not complicated and that registration can be done at any time. We know one organ donor can potentially save as many as eight lives and a tissue donor can improve the quality of life for up to 75 people. This is the gift of life, not only for the individuals with the serious health problems who are direct beneficiaries, but also for their family members and loved ones.

I want to mention again the significance of this gift of life, as we saw in the Humboldt disaster. I am sure people have heard the stories by the member opposite.

I have my own story in my own community. A vibrant, loving young mother, an inspired teacher, suddenly lost her life when she suffered a stroke. She had signed up to be a donor and was able to give the gift of life and improve the outcomes for eight other people. Out of one family's pain came joy for eight other families who were forever grateful for her final act of kindness.

Living donors who are at the age of majority and in good health can donate a kidney, part of a liver and a lobe of a lung and continue to lead full and rewarding lives. We know that one donor, as I said, can potentially save up to eight lives and improve the quality of life for up to 75 people. Lives are transformed through these miracles.

Canadians can count on this government to continue to improve the organ and tissue donation and transplantation system. To demonstrate this commitment, the Minister of Health announced on October 18, 2018, renewed funding of $3.3 million for the Canadian donation and transplant research program, CDTRP. This funding allows the CDTRP to continue its research to advance organ and tissue donation and transplantation in Canada. It is through research that we can increase the availability of transplants for Canadians and transform clinical outcomes for transplant patients from coast to coast. It is absolutely incredible what is being done in research institutions in Canada.

I had the opportunity to see the work being done in Toronto at the Peter Munk Cardiac Centre. They were working on keeping a cow's heart alive outside of the body for weeks, which would provide an opportunity to do external repairs to fix damaged organs and potentially allow for treatments that would not be possible implanted in a body. This is most promising research to be able to make best use of all the organs donated, as many get rejected due to defects or disease.

Our government is committed to supporting Bill C-316. We will collaborate with the provinces and territories upon royal assent to implement this legislation as quickly as possible to be in place for the beginning of the 2019 tax filing season.

Mr. Speaker, it is my honour to rise to speak to my private member's bill, Bill C-316, at third reading.

For those who may not be familiar with Bill C-316, it is a legislative proposal that would allow Canadians to indicate their interest in being an organ and tissue donor through their annual tax forms. It is just that simple.

Right now, the tax forms can only be used for the collection of taxes. This bill would create a legal exemption, just like that made for Elections Canada, to allow this important question to be added to the tax forms.

If we have any hope of getting these changes to the tax forms implemented in time for the 2019 tax year, we need to move this through both the House now and the Senate early next spring. If we miss that deadline, the Canada Revenue Agency, CRA, will not be able to implement the required changes for another year. We cannot let that happen. We need to get this done quickly.

This bill was unanimously supported at both second reading and committee, and has progressed from its first debate in the House to its last debate in just 23 sitting days. I think that is a record.

I do want to reiterate my sincere thanks to all the parties in the House for showing such support and offering their genuine co-operation to move this proposal forward so quickly. In particular, I must express a great debt of gratitude to the hon. member for Red Deer—Lacombe for the quick progress of this bill. The bill was not actually scheduled to be back for third reading debate until February 25 of next year, but the hon. member for Red Deer—Lacombe graciously traded his position in the PMB calendar with me to make this debate possible today and to further ensure that this legislation is passed. I know the member for Red Deer—Lacombe is a strong supporter of improving Canada's organ and tissue donation system, and his willingness to help prioritize this bill demonstrates that. His graciousness might be proven one day to have resulted in the saving of hundreds of lives. I sincerely thank the hon. member.

I also want to thank all of my colleagues on the health committee who have been vocal, determined and dedicated supporters of this bill. As I said in the health committee the other day, “I have referred to this bill several times as 'my bill', as it stands in my name, but I do want to say that this is really our bill.” It is our bill, because we worked together in committee as a single team to make it a reality. We found a shared goal and a sensible solution, and worked together to make it happen.

I also want to thank the government, yes, the government, for its allocation of $4 million in funding in the recent fall economic statement to facilitate the implementation of this legislation. Governments do not often commit funding ahead of legislation being passed, especially when for a private member's bill by an opposition member of Parliament. The fact that funding has been committed is very much appreciated and signifies an impressive willingness by the government to see this initiative happen.

I must also thank Mr. Terence Scheltema, my assistant here in Ottawa, for his tireless efforts throughout the entire process of this bill. Without him, this bill would not be before us today.

My final thanks go to my friend, Robert Sallows, a double-lung transplant recipient who recently passed away at the age of 31. He was, and always will be, a hero and a true inspiration.

At the health committee last week, we had an opportunity to hear from CRA officials. They told us that for this proposal to be in place for the 2019 tax season, the legislation needs to be passed by early spring. I think that is quite possible, again, thanks to people like the member for Red Deer—Lacombe.

A few other things became very clear in committee, and I want to talk about them for a moment. First of all, for this initiative to be most effective, the question about organ and tissue donation needs to be placed on the front of the tax form. The committee members made this very clear to the CRA. I was pleased that the CRA has acknowledged this as a priority of Parliament and committed to putting this on the front page.

I also think that the committee process was very informative and allowed the CRA to demonstrate its commitment to making this proposal a reality by working co-operatively with all provinces and territories on this matter.

The path ahead for the CRA will require a lot of work and dedication by many people to make sure this change happens smoothly. In advance, I want to thank all of the CRA employees who will work on this project for their dedication and persistence. I know there will be days of frustration as small details are worked out and circled back and forth in the consultation process with the provinces and territories. However, when the 2019 tax forms come out and thousands, perhaps millions, more donors register, they will know they have played a key role in saving the lives of some of their fellow Canadians. Therefore, I implore the people at the CRA to dig deep on those tough days and push forward to make sure that we get this done as soon as possible with the highest rate of effectiveness. Their work will have purpose and the results will be rewarding.

One other aspect I want to spend a few minutes on is something the bill does not directly address, but is a significant problem in Canada. Research has shown that as many as one in five potential organ and tissue donors has their final wish overturned by their families at their time of death. That is 20% of families who are overturning the wishes of their deceased loved ones. That is just sad. The decision by their families are robbing those in need of a life-saving transplant of a chance to live. To me, this is unconscionable and has to change. We can and must do better.

It is beyond my understanding how we can allow people to die at a rate of five a week, while at the same time burying, incinerating or putting to rest perfectly good organs every single day. My daughters know I want to be an organ donor, and they know I expect them to follow through on this wish.

As the Christmas holidays approach, families will gather in every corner of the country. I encourage willing organ donors to please speak to their families during this time, to make sure their families know that their final wish is to be an organ and tissue donor, and to let them know how they would feel if they were to find out the family failed to honour their wish.

Throughout my organ and tissue donation advocacy work, both here and in Alberta, I have been approached by many people who have donated the organs and tissues of their deceased loved ones. Every single one of them has made it clear to me that they found the ability to donate to someone in need as a very essential part of their grief and healing process. Their ability to find some good in a time of utter grief and loss was profound and everlasting. Without exception, they encouraged me to let other families know that sharing their loved one made accepting their loss so much easier.

Their loss has purpose, and their gift has brought unimaginable relief and joy to another family in need. By honouring the wishes of their loved ones, they have allowed grandparents, mothers, fathers, sisters and brothers to live. Their gift has meant that many parents have not had to see their children die. That is a legacy to leave for their loved ones.

We all have our own reasons for supporting this legislation. Some members in the House are living organ donors, the real heroes among us. Some members here have families in need of a life-saving transplant. Some members themselves, or their family members, have medical conditions that they know one day they might require their getting a life-saving transplant. Other members are able to love, laugh and live with loved ones because they got a life-saving transplant and are still with us here today.

No matter members' reasons for supporting the bill, it is very much appreciated.

I would like to compliment the member for Calgary Confederation for tabling this important legislation.

After considerable testimony, Bill C-316 has received the unanimous support of the committee. I hope that all MPs take that into consideration at a later date.

Thank you for the invitation to appear here before this committee and respond to your questions about Bill C-316 , an act to amend the Canada Revenue Agency Act regarding organ donations.

I'm Frank Vermaeten. I'm the assistant commissioner of the assessment, benefit and service branch of the Canada Revenue Agency.

My branch is responsible for administering key services on behalf of the CRA in support of tax and revenue generation programs. I'm accompanied today by my colleagues Sheila Barnard and Randy Hewlett.

Sheila Barnard is the manager of the legislation section in the individual returns directorate in my branch. Sheila is responsible for coordinating the implementation of the legislative changes affecting T1 returns.

Randy Hewlett is the director general of the legislative policy directorate, whose mandate is to manage the legislative and regulatory process within the agency. Randy's team also works with the provinces and territories to implement and administer provincial and territorial tax legislation.

Bill C-316 would enact a provision that would authorize the CRA to enter into an agreement with a provincial or territorial government to collect any information required for establishing or maintaining an organ donor registry in the province or territory.

Specifically, the CRA would collect and share personal information for individuals who wish to receive information from their provincial or territorial government on becoming an organ donor. The individual authorization to share personal information for this purpose would be collected with the income tax return.

I don't know if you recall, but a couple of years ago I was at this committee and I couldn't even speak because I had lost my voice. I'm getting there again, so it's bad timing, but I hope I can get through this.

Colleagues, it is my absolute pleasure to be here today to speak on my private member's bill, Bill C-316. Before I begin, I want to thank you all immensely for your unwavering support of this initiative. There is no question that we all share the common goal of improving our organ and tissue donation system here in Canada, so that Canadians no longer have to die awaiting a life-saving transplant.

As I have said before, this is not a political issue; this is a human issue, and our work on this issue is proof that when it really counts, we're able to leave our partisan stripes at the door. I also want to thank those who rose in the House to speak to this bill. I was moved by your kind words and your personal stories, and I think it's fair to say that many people had no idea how passionate we could all be about this issue.

Finally, I want to thank the analysts and the clerk for the work they have done on this issue. Your work on the committee report was excellent. You perfectly captured what we heard and what we want to see done, so I sincerely thank you.

As I mentioned in greater detail in my comments in the House during second reading, this bill would sensibly utilize the annual tax return process to allow Canadians to indicate their intention to consent to be organ donors. I have been afforded the opportunity to discuss my bill in greater detail with the Canada Revenue Agency, and I very much appreciate that collaborative gesture. I thank them for allowing time for me to meet with them.

This bill would enable the CRA to facilitate the registration of individuals with their respective provincial and territorial registries, but it will be the provinces and territories that will ultimately finalize the consent with those who wish to register.

This bill does not specify, at least at this point, the exact nature of the data collection process or the actual content that is to appear on the tax return. This bill is very narrowly focused on giving the CRA the legal exemption it requires to set up agreements with provincial and territorial partners, because existing legislation prohibits the use of tax returns for any purpose other than the collection of taxes, and of course allowing Elections Canada to pass on their information to them.

While I wanted to provide the CRA with a lot of working space and flexibility to implement the will of Parliament, I do have some concerns and I hope that we can put those to rest today when the CRA is up here and we're questioning them. I want to ensure that the CRA hears loud and clear that the expectation of Parliament is to have this addition made on the front page of the T1 tax returns in all provinces and territories. I also want it made clear that we expect people to have the option to tick a box on that front page—a call to action, if you will. We've all filled out forms before, and we know that unless there's a box to tick or a space to fill, we tend not to stop and read the fine print. We need to make sure that we have a front page that calls on tax filers to take a specific action to demonstrate their willingness to register.

I realize that the front page has very limited space, but it does have enough space to do what we all envision. In fact, the options I've offered would take less space than that afforded to Elections Canada on the front page. I think we can all agree that unless this initiative appears on the front page, we will lose a tremendous opportunity and dramatically reduce the impact of our work.

When it comes to the electronic filers, the e-filers, things should be quite simple, and of course the majority of Canadians, probably 90%, e-file. The CRA should make it a requirement of all tax software, which they certify annually, that the offer to consent appear prominently in the filing process. Based on residency, a tax filer should be afforded a secure connection to their own provincial or territorial registry to consent. A tax preparer should also have the option of requesting a consent package for those who are not physically filing their own return. We need to seize every opportunity to register as many as possible.

I should also mention here that I will be moving two minor amendments to my bill. These amendments are friendly amendments. They will simply change “organ donors” to “organ and tissue donors”. I believe, from my earlier discussions with colleagues and the chair, that this is not going to be an issue. We will ensure that we are not limiting ourselves from a legal perspective. I'll bring those motions forward during clause-by-clause.

I don't believe that we are intending any other amendments to the legislation, but I do welcome any that will help ensure we reach our goal to have more registered donors.

Of course, we will be hearing from the CRA officials, and I encourage my colleagues to implore a continued sense of urgency for implementation. It's always been my experience that a deadline focuses everyone and helps get the job done.

I believe that we could have this in place for the 2019 tax returns, but that would require everyone to continue pushing all involved in the process. This committee has shown its willingness to move quickly on the legislation, and I hope that those after us, meaning the CRA and of course the minister, are just as motivated to make this happen quickly, because once it leaves here, it's out of our hands.

We know that a Canadian dies almost every day awaiting a life-saving transplant. Every day sooner that we get this done means that we literally could save a life.

A while ago, the elections commissioner indicated to Parliament that if Parliament wanted to implement changes in time for the 2019 election, then legislation would have to be passed by a certain date. That was for changes to the elections laws. I would like to see the CRA provide a similar breakdown on their timelines to give us a sense of what needs to be done, and by when, for this to happen in 2019. This would be helpful for everyone in the process to have. It gives us a target to focus on.

Finally, I would like to thank the government. That doesn't happen too often. I would like to thank the government for committing the funding to this initiative in the fall economic update just last week. Governments don't often commit funding ahead of legislation passing, especially when it's from a private member's bill and, for that matter, an opposition private member's bill. The fact that this funding has been committed is very much appreciated by me, and it signifies an impressive willingness from the government to see this happen.

I have referred to this bill several times as “my bill”, as it stands in my name, but I do want to say that this is really our bill. This is our committee's bill, because we all worked together as a single team to make this a reality. We found a shared goal and a sensible solution, and we all worked together to make this happen.

I'm very proud of all of you who were here along this process with me. We are getting closer every day, but there still remains a lot of work ahead. I must be honest in saying that I am a bit concerned that we don't yet have a clear, unambiguous commitment on some important implementation aspects. Hopefully, we will deal with that today with the CRA. Nonetheless, we've gone a long way in a short amount of time, and I'm very proud of all you guys. I have to thank you all for the work you've done on this.

Mr. Speaker, I am very honoured to rise to debate this matter. I am pleased as well to second this bill, brought to us by the hon. member for Sherwood Park—Fort Saskatchewan. It is the work of Senator Ataullahjan from the other place, the Senate, that led us here. I understand the bill passed with enormous support in the other place and I am hoping that it will have the same level of support here in this place.

Canada is a bit behind the times on this. I note, for example, that the Europeans have for quite some time had a convention entitled “Council of Europe Convention against Trafficking in Human Organs". The hon. member has already set out the cross-party support an initiative like that has had in this place for very many years, and it seems to me that the time has come to join the Europeans and other countries to deal with the scourge of trafficking in human organs this bill seeks to address.

I note that the bill “amends the Criminal Code to create new offences in relation to trafficking in human organs [and tissue]. It also amends the Immigration and Refugee Protection Act to provide that a permanent resident or foreign national is inadmissible to Canada if the Minister of Citizenship and Immigration is of the opinion that they have engaged in any activities relating to trafficking in human organs [or tissue].”

The hon. parliamentary secretary pointed out quite properly the difficulty sometimes of going after people in other jurisdictions. Of course, that has not stopped Canada dealing with sex trafficking, as has been pointed out, or “sex tourism” as it is called. We know that is the case. Also there is a section in Bill S-240 that would require any proceedings to be instituted only with the consent of the Attorney General, therefore making it likely that we could address these practical problems, to which he made reference, through that intermediary.

The scourge of organ trafficking is absolutely appalling and its exponential growth should cause concern for every member of this place. In her speech, the senator referred to situations that sound like horror movies. She cited the following:

Waking up in a weary haze in an unfamiliar house on the outskirts of Delhi, India, Khan was greeted by a stranger in a surgical mask and gloves. As he began to ask where he was and what had happened, he was told very curtly, “Your kidney has been removed.”

As another exposé published in the Haaretz newspaper indicates, thousands of Sudanese refugees living in Cairo have fallen victim to the illegal organ trade. These people are among the most desperate and easy prey for people who can simply push them aside, often by putting a mask with anaesthesia over their mouths, taking them to the back of a private clinic and removing organs, the most popular being kidneys, livers and others, and then sending them home after a while, still drugged, maybe unconscious, without the organ in question. Last year Professor Seán Columb of the University of Liverpool published a study showing a connection between the organ-harvesting industry and the societal exclusion of minorities and refugee groups in Cairo.

This is a huge problem. It has grown exponentially according to the experts, in part, as the parliamentary secretary pointed out, due to the fact that the demand has grown and the supply has become limited.

I feel that some practical steps have been taken recently in this place. The member for Calgary Confederation has introduced in the House Bill C-316, which would deal with information from tax records being used for an organ donor registry. That is another initiative I was proud to second and support. As the population ages, the demand will likely increase and these crimes by organized criminals will increase as well.

I do not want to spend much time on this bill. To me, it is a quintessential no-brainer. I want to join the Europeans. I want to join others around the world who are recognizing the scourge of organ trafficking and, as a Canadian, stand proudly with them and deal with this very real problem.

As my friend said earlier, we do not have a problem if we can come together, as other jurisdictions have, and say let us get this done in this Parliament to make a difference in people's lives right now.

Mr. Speaker, it is a pleasure for me to rise today to discuss another initiative dealing with the issue of human organs and organ transplantation. By my count, there are five initiatives that have been or are before us that deal in some sense with the issue of organ transplantation. There were private members' bills put forward by my colleagues from Edmonton Manning and Calgary Confederation; we have the motion before us tonight; and we also have a number of legislative initiatives, one of which I have sponsored and which deals with the issue of illicit organ harvesting. That is, organs taken without consent, which is obviously a very different issue but is one that might be worth reflecting on in the context of some of the discussion that is happening tonight.

What we are debating tonight is Motion No. 189, which says:

That the House: (a) reiterate its commitment to facilitate collaboration on an organ and tissue donation and transplantation system that gives Canadians timely and effective access to care, since every year more than 250 people, out of the 4,500 on waiting lists, die without receiving a transplant; and (b) urge the government to support national efforts with provincial and territorial authorities and stakeholders to increase organ and tissue donation rates in Canada through public education and awareness campaigns, ongoing communication and the exchange of information, including best practices.

It is important to underline that when we debate a motion, it is essentially the House of Commons participating in a communications exercise. That is, we are all together, expressing a sentiment through endorsing an idea. In plenty of cases and in this case, it is a thing worth doing, given the motion is before us. I am going to be voting in favour of this motion.

However, I will also challenge members that the primary objective that we should pursue, as legislators, is not just to look for opportunities to put forward communication pieces on vital issues like this, but to actually look for opportunities to change the law in ways that actively increase the rate of organ donation and also that compel the government to take specific action to move these things forward. If a motion is a way of starting a conversation, that can be very worthwhile, but if a motion is a substitute for legislative action then it is perhaps not desirable. What we need to be doing is looking for opportunities, as legislators, to legislate to take the vital steps that need to be taken now to move this issue forward. I certainly commend the mover of this. I am, again, pleased to support this motion. However, there is such an urgency when it comes to moving forward and addressing, as the motion says, the number of people on waiting lists who die without transplants, that legislative changes are urgently required.

I was pleased to speak in favour of and support a bill by my colleague, a concrete legislative initiative by the member for Edmonton Manning, that would have created a national organ donation registry. Unfortunately, this bill was voted down. It was one of the first private members' bills that was put forward in this Parliament and it was defeated. A national system of national collaboration, which is indirectly hinted at by this motion, would have made the concrete difference. It would have taken far more steps in the right direction than this motion does tonight. It is with regret that I note the defeat of that bill because, had it passed, it would be saving lives today as we speak.

We had another bill put forward, by my colleague from Calgary Confederation, and this added the very helpful step of saying that when persons fill out their income tax forms they should be able to indicate on there whether they wish to be an organ donor, so it would be another opportunity for people to give information and hopefully this would increase the number of people who are saying they would like to be an organ donor. Again, it is a legislative initiative concretely moving things forward, compelling the government to action instead of simply participating in a communications exercise.

These were both good bills. I was pleased to see Bill C-316 pass.

In light of where we are in the electoral cycle and that we are likely less than a year until the next election, members should be seized with the urgency of moving forward good private members' bills that are currently before committee.

Bill C-316 passed the House at second reading. From what I understand of the process, it will need to complete the committee study, complete third reading and make its way through the Senate. There is an urgency to moving that bill forward. If all we do in this Parliament is pass this motion but not pass legislative action, that will have been a failure, a missed opportunity. I hope we will all be able to work together on that legislative initiative.

I would note the mindset and strategy behind Bill C-316. I am reading a fairly well-known book called Nudge by two behavioural economists, Thaler and Sunstein. It talks about this idea of something called libertarian paternalism, which is that governments, businesses, institutions that are shaping the architecture within which people can make choices can preserve complete liberty for the individual while still aligning the circumstances of that choice to try and bring about a socially desirable outcome.

In the case of organ donation, many people likely do not sign their donor cards not because they are choosing not to be an organ donor, but because it is simply that they are not confronted with a situation where they have to make a choice either way. They might be willing to be an organ donor, but they are just not thinking of it, and then something happens to them and they have never gotten around to signing their donor card. The idea of thinking about the choice architecture is to create the conditions in which people still have complete liberty to decide where their organs are going, but the circumstances increase the chances that they will make a choice that is in a broader sense socially desirable.

In the case of Bill C-316, it is about putting people in situations where regularly they are seeing the choice option in front of them, a way of nudging people toward making the choice one way or the other. If someone does not want to be an organ donor, absolutely the individual should have that freedom. However, it is useful for the person to be given that choice in as many contexts as possible so he or she at least is given the greatest opportunity to say yes or no. Hopefully, the individual would say yes so that again we do not have people who are not organ donors even if they thought about it they would be willing to be an organ donor, but they just never got around to signing the card or having that question in front of them.

In the context of discussion about organ donation, I want to talk briefly about Bill C-350 and Bill S-240. Tomorrow night we are going to be debating Bill S-240, which is from the Senate. It would make it a criminal offence for someone to go abroad to receive an organ for which there has not been consent. This is such an important and obvious bill. There are countries, one country in particular, where organs are taken from people without consent, often because the people are seen as politically undesirable by the government.

Anecdotally, Canadians have a sense that some people in other countries will travel to receive an organ that was taken without consent. That should be a criminal offence because being complicit in this terrible practice of organ harvesting is wrong and Canada should do everything it can to try to stop that practice. We should note in that context as well that people who are in that situation face a level of desperation because they know they need an organ and they are on a wait-list. One thing we can do is address that act specifically and address the fact that some people might go abroad to receive an organ that was harvested without someone's consent. At the same time, we can work to increase the level of organ donation here in Canada so that people no longer find themselves in that desperate situation. We can and we should do both.

By passing legislation like Bill C-316, we can ensure that people do not have to be in the desperate situation where they are on a wait-list and even where they may make a choice that they would not make under other circumstances that ends up harming someone else's life in another part of the world. With that in mind, I am very hopeful that we will be able to move forward quickly on the legislative initiative in Bill C-316 as well as Bill S-240 which we will be debating tomorrow.

I am pleased to support this motion, but the House must do more to make the vision behind this issue a reality.

Mr. Speaker, I am honoured to rise and speak in support of Motion No. 189. It is a rare opportunity for me to say I agree with the member for Winnipeg North but this is a wonderful opportunity to do that.

Often we in the House find ourselves debating different issues that have great symbolic importance, financial importance or importance in regards to the safety of Canadians. However, when we talk about organ donation and its importance, this is literally a matter of life and death.

Over the past 12 years, I have been proud to support several motions, bills and studies that encourage Canadians to become organ donors. Specifically, during this Parliament, I think of Bill C-223, introduced by my hon. colleague from Edmonton Manning and Bill C-316, introduced by my hon. colleague from Calgary Confederation.

This is not, or at least it should not be, a partisan issue. However, I was dismayed to see the Liberal Party vote against Bill C-223, that I just referenced. This legislation would have established a Canadian organ donor registry and co-ordinated and promoted organ donation throughout Canada. I believe it was a good piece of legislation that unfortunately failed. At the very least, Bill C-223 should have been referred to the Standing Committee on Health for further study in order to receive input from expert witnesses.

Bill C-316, currently being studied by the Standing Committee on Health, was introduced by my colleague from Calgary Confederation. It would give Canadians the opportunity to sign up as organ donors on their annual income tax return. I hope that my colleagues on all sides of the House and in the other chamber will continue to support this common-sense measure that would give Canadians more opportunities to register as an organ donor and in the process save the lives of thousands of Canadians who are on a waiting list. Because time is of the essence, I hope that the Standing Committee on Health and the Senate will quickly move this legislation forward so it is actually in law before the end of this parliamentary term.

The motion today is as follows:

That the House: (a) reiterate its commitment to facilitate collaboration on an organ and tissue donation and transplantation system that gives Canadians timely and effective access to care, since every year more than 250 people, out of the 4,500 on waiting lists, die without receiving a transplant; and (b) urge the government to support national efforts with provincial and territorial authorities and stakeholders to increase organ and tissue donation rates in Canada through public education and awareness campaigns, ongoing communication and the exchange of information, including best practices.

It is a sad truth that while 90% of Canadians support organ donation, only 20% are registered. I am proud to say that the towns of New Hamburg and Baden in my riding of Kitchener-Conestoga have reached a level of 52% registration. They are tied for fifth place out of 170 communities, while New Dundee and Petersburg, also in my riding, are tied for eighth at 49%. Congratulations and many thanks to these four very engaged communities.

We need to do more as members of Parliament to encourage our constituents and all Canadians to register to become organ donors.

I am thankful that the Standing Committee on Health has recently completed a study on organ donation in Canada. I am proud of my Conservative colleagues on that committee who initiated this study. Members of our caucus are awaiting its final report.

In addition to registering as a donor, it is important for individuals to discuss their decision to register with their families. They should let their families know about their decision and then register at beadonor.ca because in the final analysis, families of the deceased are not obligated to follow through but are much more likely to follow through if the discussion occurred beforehand. This decision could very well save a life and offer hope to someone waiting for an organ transplant.

Thousands of adults and children are counting on us and our fellow Canadians to give the gift of life. It is time that we as a nation close the gap between the need for life-saving and life-enhancing organs and the supply of organs that are available. Why not take steps now to make a difference? It will be someone's son, someone's daughter, someone's granddaughter who will be the recipient of someone's good decision to register to donate his or her organs.

We would all like to think we will live to be 80 or 100, but the reality is many of us will die long before that for a variety of reasons.

I came face to face with that reality seven and a half years ago, when my wife of nearly 40 years experienced a sudden intracranial hemorrhage on election night, May 2, 2011. Suddenly unconscious, rushed for medical treatment, surgery and life support, it became apparent that the bleeding could not be stopped, brain activity had totally ceased and death was imminent.

Conferring with my children, knowing Betty's wishes, that she had signed her licence to confirm her intentions to donate her organs, the decision, while not easy, was the right one, as we know that five people have had their lives extended and many more have benefited from the tissues donated.

Seven years ago, I stood in the chamber during a take-note debate about organ donation, just seven months following Betty's death, and I said these words:

I will return for a moment to that hospital. It was clear that Betty's physical life was over. Brain activity had stopped completely. We knew instinctively that the Betty we had come to know and love was no longer there. Her spirit was still very much alive but her body was only breathing with mechanical help. What to do?

Again, our faith has its foundation in the Christian scriptures, which uses many different metaphors for the physical body. It is referred to as a tent, a house, a temple, or even as clothing for the spirit within. So if the person who lived in that temple or...[who] occupied that house or camped in that tent was no longer here to need any of those things, why would we not share them with someone in need?

Why not help out one of those thousands of people who are currently on waiting lists for a specific organ? Many of those waiting are still in the prime of life. An organ donation can make the difference between life and death. Our decision, while not easy, was made lighter by knowing that someone else would possibly receive the gift of life even as we journeyed into our own grief and loss.

Was there a downside to...organ donation? Yes, there was. We had to prolong the inevitable by agreeing to multiple tests in order to determine if in fact the organs were healthy and suitable for transplant. There were detailed personal history questions in order to mitigate any risks to potential recipients.

Let me assure members of this House [of Commons]...that they can rely on the safety of organ transplants in this country. This is because of Canada's strong organ transplant community and Health Canada's work in establishing rigorous safety requirements through the implementation of the safety of human cells, tissue and organs for transplantation regulations.

Many times since Betty's death on May 4, 2011, two days following her intracranial hemorrhage, I have reflected on the reasons that I am able to move ahead in spite of my deep loss. I can say that two things come to mind: first, my total confidence in Christ's victory over death and in the power of the Resurrection and that I will see her again; and, second, my knowledge that five others have been given the gift of life through Betty's death.

There is a third reason. Two years following Betty's death, the amazing gift of my marriage to Darlene has given me renewed joy in my journey, and I am indeed grateful and blessed to have walked this journey.

As I said earlier, thousands of Canadians are on the waiting list for a life-saving transplant. I urge all Canadians to step up and register at beadonor.ca. We can do better than the 20% registration rate. I think we can even do better than the 52% rate that I referred to from my communities in Kitchener—Conestoga. Why not aim for at least a 75% registration rate? It will almost certainly save a life.

By supporting Bill C-316 and this motion, Motion No. 189, and, most important, people taking the time to register themselves, every one of us can make a positive difference.

Mr. Speaker, I am pleased to rise on Bill C-316 today. I sit on the health committee with the hon. member for Calgary Confederation, and if there is one thing I have learned about him, it is that he is dedicated and persistent when he has an issue he wants followed up. He has done a great job on this bill.

It is interesting that two of the last four speakers have said they have children who will need organ transplants. It just reminds me that we are all people, experiencing the same things everybody else in Canada experiences. We all have the same challenges. That is an incredible thing to have to face. I hope it works out well for both those members.

I would bet that if all 338 members could stand up and speak, they would all have stories about organ transplants. I have a story myself, which I will not go into, but it affects us all. It is critical that we do something about this. This is at least one step in the right direction, and I support it a hundred per cent.

It is almost embarrassing to me that Canada is in 18th place in the world in organ donation. It is almost not Canadian to be in 18th place, behind so many other countries. We should be doing much better. It would not take a lot to improve. A lot of it is just communication. A lot of it is focus.

In Spain, where they have twice the organ donation that we have, they have a very organized method. They educate doctors, and they have emergency rooms ready and available. They train people to improve the organ transplant success rate, as well as on the preservation of organs and so on. These are things we could do. They are not hard to do, and we should be doing them.

As one member said a little while ago, eight lives could be affected by one organ donor. Imagine, eight lives could be saved by one organ donor, and 75 lives could be affected one way or another. It is an incredible thing that we are so far behind.

I notice some of the members of the health committee are here today. In our committee, we have studied so many different diseases and health issues that could benefit from improved organ donation. For many of the subjects that we talk about, the only answer is organ donation, and here we are in 18th place in the world. It is hard to believe that we, as Canadians, accept that and continue on in that direction.

There are a lot of things we could do. We could expand the number of potential organ donors. We could change the rules to allow more people to donate organs, and we could educate our doctors in emergency rooms to these changes. That would help. We could have better transfer protocols. We could train doctors to help patients understand organ donation.

We heard at committee, over and over again, that it is difficult for a doctor who has worked so hard to save someone's life to then tell them that it might be a good idea to donate their organs. We heard that from doctors and health care providers. We could help doctors and the medical field in general to prepare patients for organ donation when the time comes.

A national registry is the key. We are not there yet, but hopefully we will get there. New technology could help preserve organs after they are harvested, so they last longer and can get to the people who need them the most. This is technology that we have within our reach. It is within our grasp. We can do it.

All of these things are very doable. They are very simple things to do, and would move us from 18th place closer to first place, which is where Canada should be. Canadians should not accept that we are in 18th place in this comparison. I do not accept it, and the member for Calgary Confederation certainly does not accept it.

I will be supporting Bill C-316, and I look forward to hearing about it at committee, hearing the pros and cons. I am sure there will be far more pros than cons, and perhaps we can find solutions to some of these problems I have listed and that some of the other members have talked about.

It should be easy to register. Just a little while ago, some of us checked our driver's licence to see if we were donors. I am a donor, but it is not on my licence. Maybe if something happened to me, it would not be known that I was a donor. It should be on my driver's licence. That is a simple thing we could do. It is on my health card. It says “donor” right on it, but it is not on my driver's licence. If the wrong card is picked to look at, somebody might lose. The opportunity to help eight people might be lost. I do not want that to happen.

That is really all I wanted to say. I want to say that I support Bill C-316. I congratulate the member. I know how determined and persistent he is on this, and he is right. All of us should accept the challenge to not accept that we are in 18th place in the world in organ donation. I look forward to the bill progressing through the system.

Mr. Speaker, it is my pleasure to speak today in support of the private member's bill sponsored by the member for Calgary Confederation to streamline organ donation. I want to thank the member for his work on the bill, as well as his hard work in helping to create the organ donation registry in our home province of Alberta when we served in the provincial legislature together. I had the opportunity to speak to both his provincial bill and now to the federal bill, hoping that we will see similar results in passing both of them.

Almost every Canadian has heard about someone whose life was impacted by organ donation, whether in the media or through personal connections. The organ donation of one person can save up to eight people, and a tissue donation can impact more than 70 people. Of course, even more people than that are impacted as families get to keep their loved ones alive longer because of donation. However, only a quarter of Canadians are registered to donate.

Our organ donation rate is among the lowest in the world. Currently, almost 5,000 Canadians are waiting for a transplant on which their lives depend. Sadly, about 260 Canadians lose their lives every year while waiting for a transplant that, sadly, never happens. That is about five deaths per week, or one death about every 30 hours, that could be prevented if they had a viable donor. Ninety per cent of Canadians say that they support organ and tissue donation. However, in practice, less than 20% have actually made plans and registered to donate.

In the past 10 years, the number of deceased organ donors has gone up by 42%. The number of people needing a transplant has also gone up in that time. Therefore, a more effective method is needed in order to increase the size of the organ donor base in Canada. The proposal of the member for Calgary Confederation is so simple and yet so smart. Implementing it could mean a huge increase in the number of organ donations in Canada, and my friend is proposing to add an option on tax revenue forms, where people can declare whether they would like to register to be an organ or tissue donor. If they check yes, their names and information are given to their provincial government and added to an organ donor database.

Almost every Canadian fills out these forms annually. Making registration for organ and tissue donors easier will save more lives. It will be the same process for everyone, no matter what province they live in. There is no need to create new computer and database systems, because the existing system can do that job.

This method will reach the most potential donors at the lowest cost. It will also help identify organ donors when someone dies outside of his or her province of residence. The new system proposed by the member for Calgary Confederation will be more efficient at identifying donors, resulting in more lives being saved.

Earlier this year, our country suffered a horrible tragedy when 15 young men and one young woman from the Humboldt Broncos hockey team died after a bus crash. After that tragedy, there was a spike in the number of people who signed up to become organ donors. I wish it had not taken such an unfortunate accident to encourage people to become organ donors. However, I am glad to see organ donation on the rise.

The current process to register to become an organ donor in my province of Alberta involves going online to put one's name on the organ donation registry. This was spearheaded by the member for Calgary Confederation while he was a member of the legislative assembly, and it is so great to see him work so hard to continue this good work on a national scale here in Parliament.

It is so important to have the registry, and the number of organ donors has risen since it was implemented in 2013, but it is just not front of mind for most people. With so many things going on in our lives, we do not always remember to complete this type of task. Bringing the option of organ donation right to Canadians instead of waiting for Canadians to come to a website will no doubt result in an increase in the number of registered donors in Canada.

Currently, the only proactive approach by governments is to register Canadians via the driver's licence registration process. However, the percentage of Canadians with a driver's licence is dropping in every age category. While young Canadians are our future donors and they have the healthiest organs, less than 70% of 19-year-olds obtain a driver's licence. This indicates a 20% drop from the previous generation.

In Canada, only 1,600 people are added to organ transplant waiting lists each and every year. On top of that, there is also a limited time in which organs can be viable for transplant to a matching donor on the waiting list. It is typically less than a day after death. With the continuous decline of driver's licence registrations, Bill C-316 is a sensible solution to gather more donors, decrease the numbers of Canadian patients on donation wait-lists and, ultimately, save more lives.

Kidney donations are the most common organ transplant in Canada, followed by the liver, lungs and heart. A study done by Canadian Blood Services examining organ transplants between 2006 and 2015 found that transplants benefit both patients and provincial health services. According to the study, “Kidney transplantation is the best therapy for patients with end-stage kidney disease. Compared to dialysis, it can more than double a patient's life expectancy. Although the data in this section speaks primarily to the benefits of kidney transplantation, other types of transplantations, such as lung, heart and liver, are also beneficial.”

The same study found that transplants can save governments money because of reduced hospital stays. It is estimated that Ontario alone already loses approximately $100 million every year to support the care of those on the waiting list for a donated kidney. The study states:

Liver, heart and lung transplants may also reduce costs for governments. Although there is limited information on the cost avoidance associated with the transplantation of organs other than kidneys, a U.K. report states, “there is some evidence that the care of patients with life-threatening organ failure may involve many days or weeks of in-hospital care, including significant time in intensive care (which is very expensive), that would be avoided if transplantation had taken place.”

It is evident that organ and tissue donation benefits patients, families and taxpayers because of decreased health care costs. However, other countries are far ahead of Canada in terms of successful transplants. As I said earlier, Canada has a low organ donation rate. Figures from 2015 show that only 1% of Canadians who die in hospital donate their organs. We lag behind many other countries, including the United States, in registered donors.

In Europe, many countries have opt-out organ donation systems. This means that all citizens are automatically registered as organ donors and have to deregister themselves if they do not wish to be a donor. It is because of this system that Spain leads the world in the number of registered donors.

However, the system proposed by the member for Calgary Confederation achieves a happy medium. It will reach almost all adult Canadians without being heavy-handed. Canadians do not want the government telling them what to do. With the tax form system, Canadians can decide for themselves what they want to happen to their bodies. This would be a most convenient system for potential donors.

Additionally, it would be practically free to implement, because it would utilize existing documents. This system is economical for taxpayers and would ultimately help to save more lives.

Many of us do not like to think about it, but we never know when or if we will need an organ donation. Our lives could change in an instant. Many families have been put in a position where they have to wait for life-saving organs or tissue to become available. This is an incredibly nerve-racking wait. Often, families do not know whether the donations will come in time.

In Edmonton right now, a young girl from Okotoks is waiting to receive a number of life-saving organs. Thousands of other Canadians are in the exact same situation. The wait is agonizing for these families. I would like us as parliamentarians to do everything we can to decrease the number of families in this situation.

Mr. Speaker, Bill C-316 would be a great amendment to the Canada Revenue Agency Act. As I have said, it would reach more Canadians, increase the number of donors, save taxpayers money and ultimately save more lives. This is a sensible solution to our problem of low donor numbers. It is a very straightforward private member's bill, and I am pleased to support it today. I urge all members of this House to consider supporting Bill C-316.

I want to thank my friend, the member for Calgary Confederation, for bringing this bill forward. I also want to thank him for all the work he has done on organ donation, both here and in Alberta. He was instrumental in bringing in Alberta's organ donation registry, and he has stayed true to his word to continue to fight right here in Parliament for strong organ donation access.

I hope the next time we all do our taxes, we see the option of becoming an organ donor right there on the forms.

Mr. Speaker, it is with enormous pleasure that I stand here today to speak in support of Bill C-316, an act to amend the Canada Revenue Agency Act, organ donors. This initiative was brought forward by my friend and colleague, the member for Calgary Confederation. The member has worked tirelessly in this Parliament to get this organ donor bill passed.

There are some issues that transcend party lines and this bill is certainly one of them. We have a responsibility to support one another when something as simple as an adjustment on our tax form can save the lives of hundreds and thousands of Canadians.

Canada is a nation that has much to be proud of, but where organ donation is concerned, too many Canadians are dying while on the wait-list. Although 90% of Canadians support organ donation, less than 20% have made plans to donate. According to global comparison statistics from the Council of Europe, Canada has a donors per million people rate of 20:1. This low ratio places us 18th internationally in organ donation, behind Italy with a donor rate of 24:7 and the U.S. with a rate of 30:8. Spain has the highest national donors per million people rate at 43.8. This is a ratio that we should set our sights on as a country.

We have the opportunity to drastically change the lives of individuals and their families.

In a 2016 study, the health committee found that close to 4,500 people were on the wait-list, and a staggering 6% of people died while waiting for an organ. Furthermore, according to the data, while about two-thirds of people on the wait-list received an organ, that meant that one-third of people on the wait-list did not receive an organ. This wait-list is ever-increasing. It is estimated that over 1,600 Canadians are added to it every year.

While true that the number of organ donors has increased over the past decade, they are not increasing at a high enough rate to meet the demand. People are still dying needlessly because there are not enough donors on the list. We must make every effort to ensure that every Canadian who needs an organ can be matched with someone who can and is willing to donate an organ.

Again, these deaths are not because Canadians do not support organ donation, but rather opportunities and infrastructure are missing. This is not something we can hope will get better without action, and many people and organizations have worked determinedly over the years to address this.

The current version of Bill C-316, as tabled by my colleague from Calgary Confederation, builds on legislative and advocacy work done over the past 20 years around creating a system of organ donation.

Similar legislation has been introduced numerous times since 1999.

Lou Sekora, a Liberal MP, introduced a bill calling for the establishment of a national organ donation registry in 1999 and again in 2000. Judy Wasylycia-Leis, the former NDP MP from Winnipeg South, introduced legislation on this topic in 2002, 2003 and again in 2008. Malcolm Allen, a NDP MP from Welland, introduced similar legislation in 2009 and 2013. In 2016, my colleague from Edmonton Manning reintroduced legislation calling for the establishment of a national organ donor registry. Now we are once again presented with an opportunity from my colleague, the member for Calgary Confederation. That equals nine times over the past 20 years that this has been introduced by people from all political parties. This many attempts over the past two decades clearly demonstrates that there is a huge void this bill can fill.

We should do better, we need to do better and we can do better.

In February 2016, I stood in the House with the other MPs from the NDP caucus and the Conservative caucus who unanimously voted yea for the earlier version of this bill, Bill C-223, which was a private member's bill put forward by the member from Edmonton-Manning. MPs have worked tirelessly to get legislation in place that facilitates organ donation and once again to encourage all MPs to vote in favour of this important legislation. Indeed, along with many of my colleagues here, I look forward to and will work toward a day when every Canadian in need of an organ has access to one.

It is not a stretch to say that this incarnation, Bill C-316, is the ninth version of a long line of attempts to get some legislation put in place around this very important subject. Let us ensure that we do not have to sit here for a 10th. Let us put partisan blindness aside and stop letting it get in the way of good legislation.

A piecemeal approach with different programs in different provinces was the exact reason why we asked for the creation of a pan-Canadian organ donor program in the first place. Federal legislation is needed to fill the legislative void on this subject. We need to pass this. This is not a simple matter of provincial jurisdiction. We need a centralized list of people waiting for an organ. By way of this legislation, we are simply looking for co-operation in the service of people who sent us here, Canadians.

Many organizations have repeatedly asked for a national strategy and national oversight of the organ donation system.

Dr. Lori West, the director of the pan-Canadian National Transplant Research Program, aptly said, “we cannot afford to be stymied by the makeup of our country. We can turn it to our benefit and really use those sorts of strategies to get where we want to go.”

The Kidney Foundation of Canada stated, “[We] recommend that the federal government take steps to improve Canada’s Organ and Tissue Donation and Transplantation system and save more lives by: Implementing a national strategy and oversight to ensure every potential deceased donor is identified and that every person awaiting transplant has equitable access to organ transplantation across the country.”

Dr. Philip Halloran, who is a professor of medicine at the University of Alberta, stated, “Donations in Canada are not performing at the standard that our colleagues in the United States are performing and there isn’t really any excuse except organization and accountability.”

The testimony from these experts underscores once again that there is a dire need for federal legislation and oversight over this very critical issue.

Once again, I want to urge my colleagues to support this bill and a commitment to progressive co-operation and getting results for Canadians.

Mr. Speaker, the Government of Canada recognizes the value of organ and tissue donation and transplantation, and has an important role to play in protecting the health and safety of Canadians. We all recognize that more work is needed to address the chronic shortages of organ and tissue donations for transplantation across the country. It is only by working together that we will continue to improve the organ and tissue donation and transplantation system, and ensure that Canadians have timely and effective access to care.

The Canadian Transplant Society notes that more than 1,600 Canadians are added to organ wait lists every year. That is because transplants are often the only treatment for end-stage organ failure. In addition to treating conditions like cornea blindness, diabetes, and birth defects, organ transplants and tissue and organ donations can also help burn victims recover, remove the need for long-time dialysis, reduce amputations, repair childhood heart problems, assist in heart bypass surgery and heart failure, replace cystic fibrosis diseased lungs with healthy ones and provide a new cosmetic solution for disfigured facial accident victims.

We know that transplants both improve the quality of life of their recipients and also save lives.

The government recognizes that too many Canadians are on organ wait lists. In 2017, more than 4,333 people were waiting for transplants across Canada. That said, over the past decade the number of deceased organ donors has gone up by 42%. While that is encouraging, unfortunately, the number of people needing a transplant has also gone up in that time. In many ways, we not making the progress we need and many people are continuing to suffer and are dying waiting for a donor organ.

As our population ages, the need for transplants will only increase. Any one of us could one day find ourselves in need of a donation. I just want to tell a private story. This is very close to my heart. I did not know this when my boys were born, but both of them have a very serious heart defect that will ultimately require them at this point in time to have a transplant. Obviously, I am very excited about the technological changes in medical services today and I am hopeful maybe that will not be the case. However, I am mindful that both of my boys may need a transplant in their future. This is an issue that is very close to my heart.

That is why the Government of Canada continues to work with Canadian Blood Services and the provinces and territories to help increase organ donation rates and raise public awareness about organ donation across Canada. People need to know that registering to donate is not complicated and that registration can be done at any time. It is not necessary to wait until death. In fact, that is often too late, especially if loved ones are not aware of your wishes.

Living donors who are the age of majority and in good health can donate a kidney, part of their liver, a lobe of their lung and continue to lead full and rewarding lives. What could be more rewarding than saving someone's life? We know that one donor can potentially save as many as eight lives and improve the quality of life for up to 75 people.

I want to tell a personal story. In my riding we had a wonderful teacher and outstanding member of our Ahmadiyya Muslim community who died suddenly of a brain haemorrhage. The family and she had decided to donate her organs if she died, and their decision saved the lives of eight members of our community. Those community members would not be living if it had not been for her tragedy. Thus, from one family's tragedy, eight other families have been blessed to have their loved ones still with them.

This is a huge gift, not only for the individuals with serious health problems who are direct beneficiaries of donations, but as I mentioned, also countless family members and our whole community at large. Their lives are also transformed with these miracles of life.

As I stated earlier, the government recognizes the value of organ and tissue donation and transplantation and has an important role to play in protecting the health and safety of Canadians. The Minister of Health is working with the provinces and territories to facilitate collaboration on an organ and tissue donation and transplantation system that gives Canadians timely and effective access to care. Canadians can be assured that we are committed to improving the organ and tissue donation and transplantation system.

In collaboration with provinces, territories and key stakeholders, we are establishing leading practices, strengthening professional education and raising awareness to improve organ and tissue donation. The Government of Canada also continues to work with Canadian Blood Services and our provincial and territorial partners to increase the donation rates of blood and blood components because we need to raise public awareness about that all across Canada. The need for blood donations is also great.

There is a constant demand. People do not realize that it takes five donors to save someone who needs heart surgery; 50 donors to help just one person in a serious car accident; and eight donors a week to help someone going through treatment for leukemia. I am sure many members are aware of people in their communities who have been dealing with that disease. This is why it is so crucial to get the message out that it is in everyone to donate.

Canadians can count on the government to continue to improve the organ and tissue donation and transplantation system. To demonstrate this commitment, the Minister of Health announced on October 18, renewed funding of $3.3 million for the Canadian Donation and Transplant Research Program.

This funding also allows the CDTRP, Canadian Donation and Transplant Research Program, to continue its research to advance organ and tissue donation and transplantation in Canada. It is through research that we can increase the availability of transplants for Canadians and transform clinical outcomes for transplant patients from coast to coast.

Our government is committed to supporting the organ and tissue donation and transplantation needs of Canadians and is looking closely at Bill C-316 and other opportunities to determine how best to support that objective.

Mr. Speaker, I am pleased to rise today to speak to the private member's bill of the member for Calgary Confederation, Bill C-316. The member is to be commended for his work and advocacy to facilitate organ donation in Canada. I fully support what the member is trying to accomplish with Bill C-316 and co-seconded the bill, and will vote in favour of it at second reading.

In light of a chronic shortage throughout Canada, there can be little doubt that measures must be taken to increase the number of organ and tissue donations available for transplantation. Bill C-316 would enact a provision that would authorize the Canada Revenue Agency to enter into an agreement with a province or territory regarding the collection and disclosure of information required for establishing or maintaining an organ donor registry in the province or territory. This would give Canadians an additional opportunity to become organ donors; as such, it is likely to increase the number of donors across the country over time.

In the spring of 2018, the House of Commons Standing Committee on Health, HESA, of which I am a member with the hon. member, examined the status of Canada's organ and tissue donation procurement system. The committee heard from numerous witnesses, who shared their insights on how the federal government could strengthen Canada's organ donation and transplantation system. The committee tabled its report on this study on September 25, 2018. Among the seven recommendations made, recommendation number 4 reads as follows:

That the Government of Canada identify and create opportunities for Canadians to register as organ donors through access points for federal programs and services in collaboration with provincial and territorial organ donation programs.

This is exactly what Bill C-316 would do by making the Canada Revenue Agency, which interacts with millions of Canadians every year, an additional vehicle in the organ donation ecosystem.

It was no surprise to hear witnesses express support for Bill C-316 during the committee's study. According to the Canadian Transplant Society, more than 1,600 Canadians are added to the organ wait-list every year. While 90% of Canadians support organ and tissue donation, fewer than 20% of Canadians plan to donate their organs or tissue.

There is no question that more must be done to address the serious need for organs and tissue available for donation. In 2017, more than 4,333 people were waiting for transplants across Canada. These are our relatives, friends, neighbours and colleagues. That same year, 2,979 organs were transplanted. However, hundreds of Canadians could no longer wait. In 2017, 242 people died while waiting for a transplant.

To address this situation, the attitudes and behaviours of Canadians must change. Individuals need to be informed that it is not complicated to register to be an organ and tissue donor. Individuals can register at any time. It is not necessary to wait until the end of one's life to become a donor, nor is age necessarily an impediment. We know that one donor can potentially save as many as eight lives and improve the quality of life for up to 75 people. This became clear to Canadians recently, following the terrible tragedy that hit the Humboldt Broncos. After the accident, it was revealed that one of the victims had registered to be an organ donor and went on to save six lives. This prompted Canadians from all walks of life, young and old, to become donors themselves. Registrations skyrocketed across the country.

The government recognizes both the importance of donations and the role the transplantation of organs and tissues plays in the protection of the health and safety of Canadians. Canadians can be assured that we are committed to improving the organ and tissue donation and transplantation system in collaboration with provinces and territories and key stakeholders.

From 2008 to 2009 and from 2017 to 2018, provinces and territories, excluding Quebec, and the federal government provided over $70 million in funding to Canadian Blood Services to play a role in coordinating the organ and tissue donation and transplantation system by focusing on four areas: developing and implementing a national strategic plan, including a mandate, roles and responsibilities in a nationally coordinated system; establishing leading practices, professional education, knowledge translation, and public education and awareness campaigns; enhancing system performance reporting, including public reporting; and developing and maintaining interprovincial organ-sharing programs through the Canadian Transplant Registry. During this period, Quebec also contributed $845,000 per year to Canadian Blood Services to participate in certain elements of its program.

At the moment, only a fraction of Canadians are registered donors, despite it being easy to become one. Depending on where people live, there are different ways to register and decide what they want to donate. Of course, if Canadians opt to become organ and tissue donors, it is important to discuss this decision with those closest to them. People must ensure that family and friends are aware of their wishes.

For many Canadians it may just be a matter of becoming more aware and taking a step that could dramatically change the lives of thousands of Canadians facing health crises.

It is only by working together that we will continue to improve the organ and tissue donation and transplantation system and ensure that Canadians have timely and effective access to care. Rest assured that the government will continue to assist on the important issue of organ and tissue donation and the transplantation needs of Canadians.

Mr. Speaker, it is my pleasure to rise today to speak to Motion No. 189, which seeks to improve the organ and tissue donation system here in Canada.

This is a very timely issue for debate in the House, in a week that has seen the tabling of the health committee's report on organ donation, the second reading of my private member's bill on organ donation, and now Motion No. 189 on organ donation. It has truly been an organ donation week here in the House.

Like the hon. member for Thérèse-De Blainville, I am a long-time advocate of organ and tissue donation in Canada. I have heard many triumphant and also tragic stories related to organ and tissue donation.

As a former MLA, I had a bill pass in the Alberta legislature that resulted in the creation of the Alberta organ and tissue donation registry.

However, more work needs to be done to get Canadians on board, so I introduced another bill just this week here in the House of Commons. That bill proposes to amend the annual income tax return to ask Canadians if they wish to become organ and tissue donors. It has the potential to register millions more donors.

Over 90% of Canadians support organ and tissue donation, but just over 20% of Canadians are registered. We need to do better. We can do better.

I am honoured to have the member for Thérèse-De Blainville as an official seconder of my bill, and I certainly will be supporting his initiative here with Motion No. 189.

Also, on Tuesday of this week, the House of Commons Standing Committee on Health presented an important report regarding organ and tissue donation. The report is an accumulation of the work we did together after I proposed a study at committee.

I must note that the committee did an amazing job of working together toward a common goal. I must thank all hon. committee members for allowing this study to happen. This non-partisan effort, along with the tremendous expert testimony that we received, made the report a fair and accurate representation of the study we undertook.

I would like to take a moment to highlight some of the key items from the report, as they speak directly in support of Motion No. 189.

We found that the federal government could help by first, supporting the adoption of best practices in organ donation and transplantation across all jurisdictions; second, investing in national public education and awareness campaigns to promote a conversation among family members regarding organ donation; third, creating more opportunities for Canadians to register their decisions regarding organ donation; and fourth, providing sustained funding for research and data collection to ensure that organ transplantation results in improved health outcomes for Canadians.

The health committee quickly agreed on a number of key recommendations after listening to these key stakeholders and experts.

The first recommendation from the health committee is that the Government of Canada provide the Canadian Blood Services with sustained funding to strengthen and expand upon existing interprovincial organ donation and transplantation-sharing programs; develop a sustained national multimedia public awareness campaign to promote organ donation, and promote the adoption of best practices in organ donation and transplantation across the country.

The second recommendation is that the health minister establish a working group with provincial and territorial ministers of health to examine best practices in organ donation legislation across the country, such as the adoption of mandatory referral of any potential organ donor, and to identify any barriers to the implementation of these best practices.

Our third recommendation is that the Government of Canada identify and create opportunities for Canadians to register as organ donors through access points for federal programs and services, in collaboration with provincial and territorial organ donation programs. Of course, I have to note that this particular recommendation directly supports my Bill C-316 and my efforts to amend the annual tax return so that Canadians can register as donors.

The fourth recommendation of our health committee is that the Government of Canada provide information and education to Canadians regarding organ donation as part of its efforts to promote organ donation registration through federal programs and service access points.

Our fifth recommendation is that the Government of Canada continue to provide funding for organ donation and transplantation research through its networks of centres of excellence program.

Finally, the sixth is that the Canadian Institute for Health Information and Canadian Blood Services work together to develop a national data collection system to monitor outcomes in organ donation to support research and systems improvement.

Improving the transplant system in Canada is not a political issue; it is a human issue. I believe we have a united House when it comes to dealing with this issue of organ donation, and I firmly believe that we can improve the system. We have the potential to save hundreds of lives and improve the quality of the lives of many Canadians in every community of this great country. Inaction or delays in making necessary improvements will cost lives and money. It is a known fact that life-saving transplants save us costs in our our medical system because they remove the dependence of thousands of people from costly treatments and hospitalizations. This leaves more resources for other challenges to be addressed.

I recognize that in Canada, because organ and tissue donor registries are a provincial jurisdiction, we face some unique challenges in implementing change. That said, I also believe that where there is a will there is a way. I believe that Canada can move from being a country with one of the worst organ-donation rates in the world to one of the best. I believe that Canadians will register in greater numbers if we make the process easier and more convenient. I believe we need to be innovative in how we reach potential donors and how we educate and inform potential donors. I also believe that we need to do a great deal more work to make sure that families respect the wishes of their family members. The number of people who want to donate but have that decision overruled by their surviving families is shocking. One study suggests that one in five donors does not have his or her relatives respect his or her wishes to donate. We need to open up the discussion in Canada so that we do not bury perfectly good organs every day while other people in our community face death daily, waiting for a life-saving transplant.

In closing, I would again like to thank my colleagues from all parties for their support on this issue that is so close to my heart. I want to thank them for their non-partisan and collaborative support to improve the lives of so many Canadians. I believe we can achieve some great things here if we all continue to pull in the same direction. For this reason, I am proud to be a strong supporter of Motion No. 189.

Mr. Speaker, I am very pleased to rise today in the House to speak in favour of Motion No. 189, regarding organ and tissue donation.

I would like to begin my speech by thanking the member for Thérèse-De Blainville for moving this motion and for his ongoing efforts on this file. I would also like to thank the member for Calgary Confederation for his years of work on this file and, more recently, for introducing Bill C-316.

I want to take this opportunity to draw attention to the most recent report of the Standing Committee on Health, entitled “Organ Donation in Canada”. This unanimous report is the ideal example of how members from all parties can work together to improve Canadians' health. Organ donation is an impartial and non-partisan issue. I would like to thank all members of the Standing Committee on Health for their hard work. In particular, I want to thank the member for Calgary Confederation for raising this issue three years ago. Organ and tissue donation is a Canadian concern, and I hope we will not forget that as we continue this debate.

The Standing Committee on Health made several recommendations to the federal government in its recent report, including that the government provide Canadian Blood Services with greater funding in order to expand upon interprovincial programs and develop an awareness campaign. The committee also recommended that the Minister of Health establish a federal-provincial working group to examine best practices across the country and that the federal government consider the feasibility of a presumed consent system for organ donation.

Along those same lines, I would like to thank all the groups, organizations and Canadians who have reached out to the health committee and to other members of Parliament to highlight the importance of this issue. This is a national issue that needs be addressed. Being an organ donor can save up to as many as eight lives and can improve the quality of life for up to 75 people, without counting the family and loved ones of those awaiting treatment. Organ and tissue donation play a large role in the Canadian health care system and are truly life-changing. I would like to take this opportunity to encourage all Canadians to visit BeADonor.ca and register.

With respect to statistics, more than 1,600 people are added to the organ donor wait-list each year. With respect to the demand on our health care system, over 75% of Canadians on the organ donor list are in need of a kidney transplant, 10% need a liver, 6% need lungs and 4% are waiting for a heart. This is a tremendous need. Considering only 1% of deaths in hospitals end up being organ donors, more needs to be done to increase the number of possible donors across the country.

When most people think of organ donation and of being an organ donor, most Canadians think of organ donation as happening after death. However, living organ donation is also an important part of our medical system. Living organ donation can include a kidney, part of the liver or a lobe of the lung. British Columbia and Alberta have the highest living donor rates in Canada, coming in at 20 living donors per million people. Often overlooked, I would encourage all Canadians to further inform themselves on becoming a living donor.

Another uniquely Canadian concern is the differences between provincial systems. Different registration systems, registration rates, medical practices and education frameworks make the Canadian organ donor system we have now extremely fragmented. Where one lives should not impact ones access to health care, but that is the reality in Canada. Whether it be palliative care, surgery wait times, prescription medication access or organ donation rates, the lack of consistency between our provinces leaves many Canadians without the care they need and without the opportunities other Canadians may have access to. Where people live should not have an effect on their quality of care.

Internationally, there are a number of models we could look to for best practices. Canada has what is called an opt-in system, meaning people do not become listed as organ donors until they register through their respective province. This has led to less than 25% of Canadians being registered as organ donors, which is a stark contrast to the figure of 90% of Canadians who are in favour of organ donation.

Another very popular organ donation system would be the opt-out model, wherein people are considered to be organ donors unless they officially opt out. As we can imagine, this leads to much higher donor rates, such as in Spain, which has an opt-out model. In less than a decade the country passed from having 15 donors per million to 40 donors per million, and had more than 4,600 organ transplants in 2016 alone. This is in comparison with the 21 per million donor rate and the 2,835 organ transplants in Canada in the same year.

This system has been brought up on numerous occasions. I have heard from many Canadians who believe that an opt-out model would lead to a drastic increase in organ donation figures. Today, in Ontario, there are over 1,500 people waiting for life-saving organs. Even more shocking is that every three days, someone in Ontario will die because they have not received an organ.

For example, Health Canada's website shows that in 2016, 4,500 Canadians were waiting for organ transplants, 2,800 organs were transplanted, and 260 people died waiting for a transplant. That means 260 lives were lost because of the shortage of organs in Canada. That is simply unacceptable.

However, simply having a national consensus is half the battle. Family refusal rates can be detrimental to organ donation numbers and, as such, I would encourage every family to have the conversation. Organ donation saves lives and being aware of a loved one's intention is of the utmost importance.

We have heard some discussion already about how important it is for family members to know of a loved one's choice to be an organ donor. They should have those conversations before the difficult time when a loved one has passed and the family is left to carry out that person's wishes. It is a good idea to do that. Sometimes people think they are too old to be donors, but that is not the case, because the oldest tissue donor was 102. It is never too late to become a donor. I believe the oldest organ donor was in his nineties, so it is certainly something people should consider and it is never too late to change their minds and get on the list.

When it comes to organ donor best practices, Ontario, B.C. and Quebec have some excellent practices, not just in making sure that organs can be used but in the technology they are using to do organ transplants. We can see how a tragedy like the one in Humboldt resulted in 16 deaths, but one of the people was an organ donor and was able to save eight lives. Not only that, but the attention that news of that got encouraged others to take the time to become an organ donor. If people are watching, I would encourage them to go online to beadonor.ca and sign up now. It does not take very long, but it could make a difference to someone's life.

Motion No. 189 is definitely in line with both my colleague's private member's bill, Bill C-316, as well as with all the testimony heard at committee. All of the parties have expressed their support for further improvements in this area and, as such, I will be supporting Motion No. 189. I would encourage my colleagues on all sides of the House to do the same. I want to thank members on both sides for bringing this issue forward. I love to see examples of parliamentarians working together in a positive way for positive outcomes for Canadians.

Mr. Speaker, I am very pleased to rise in the House today to speak in support of C-316, an act to amend the Canada Revenue Agency Act (organ donors). I am also proud to be one of its seconders.

I want to begin by thanking and commending the member for Calgary Confederation for his work in preparing this bill and helping to do two things: one to help Parliament, the government, and Canadians who engage in an important conversation about organ donating; and also to suggest a way to improve the lives of people so that more people can inherit that gift of life through organ transplants.

This is no less than a matter of life and death. As a United Church of Canada minister, I have had the privilege of helping families in the most difficult times of their lives. Those times have involved people who have lost loved ones, often tragically and unexpectedly, who were searching for solace and meaning in the face of often unspeakable grief. I have also worked with individuals who were waiting for life-saving, or life improving, surgery that involved receiving an organ or tissue from either a living person or one who had just died, but whose organs could go on living in their body, giving them a second chance at living a full life.

I do have a bias on this topic. I am unabashedly in favour of finding ways to open the conversation about organ donation and finding ways to make it as easy as possible for this to happen across our country.

An organ donation is called the gift of life. However, for me there are two gifts happening simultaneously. One, obviously for the recipient, whose life may be well saved by the donation, but also another, the gift for the donor and their family. In my experience, the donor and his or her family often receive as much, or even more, benefit from the organ donation. For the family, it often helps to make sense and give meaning in the midst of a tragic loss.

I was 11 years old when Dr. Christiaan Barnard performed the world's first human-to-human heart transplant in Cape Town, South Africa. I can still remember watching the news that night and being absolutely overwhelmed at that possibility. He transplanted the heart of Denise Darvall, who had died from a head injury, into the chest of Louis Washkansky. While he only lived for 18 days following the surgery, he regained consciousness and taught his medical team important lessons about the immune system and anti-rejection drugs. The second patient, whose transplant happened 50 years ago this year, lived for nineteen months, and opened up the possibility for heart patients around the world to have hope for a healthy, happy, full and long life.

We have come a long way since then. Modem medicine now allows for transplantation of organs including the heart, kidneys, liver, lungs, pancreas, intestine, skin and thymus. Tissues that may be transplanted include bones, tendons, muscles, corneas, heart valves and veins. Medicine continues to grow and offer life-changing opportunities for people suffering from many afflictions. To change lives, it takes the willingness of people to donate their organs or tissue, and it takes systems that facilitate that in the most humane and efficient ways possible.

This bill quite simply would amend the Canada Revenue Agency Act to authorize the Canada Revenue Agency to enter into an agreement with a province or a territory regarding the collection and disclosure of information required for establishing or maintaining an organ donor registry in that province or territory.

During the other speeches I double-checked my own status. I first checked my Ontario licence to see if I was a donor, and it was not there. Then I checked my health card, only because I was prompted when I got to the website for the Ontario government. It is not an easy process. An easier process is to check a box when we are filing our income tax return. It is not difficult.

Our government recognizes the value of organ and tissue donation and transplantation, establishing leading practices, strengthening professional education and raising awareness. We have invested money with Canadian Blood Services and in research as well, but more can be done. This is quite a simple way to expand the gift of life, to get better health outcomes. I encourage all members to support sending this bill to committee, where it can be both studied and perhaps even improved.

My hope is that the committee will recognize that provinces and territories could use help to register consent for organ and tissue donation, especially organ and tissue donation after death, post-mortem, at a time when it is easy to do. Believe it or not, doing taxes is not that hard. It is not that stressful.

People can take that moment when they are filing their taxes and take just a second to check the box and do it. However, being the kind of person I am, I want to push even a bit further to ask whether that is the only place the federal government can help. Perhaps the committee could consider in all respects where Service Canada encounters Canadians, such as when people get a passport, which is surely less stressful than filing income taxes. The committee has some work to do on this bill. I support it fully and I suspect that we will be able to find a way for the federal government to efficiently and humanely help people make this decision in a timely way.

Ensuring that we register advance directives is critical. It is one way to relieve the pressure on a family. In an emergency room when a family is dealing with a life-and-death situation when someone has been brought in after a car accident and the family is told at that moment that the person they perhaps loved the most in the world is dead or is about to die, and they are being asked to give permission for organ donation, it is a confusing time. As a pastor, I have often stepped in to help families when physicians or nurses are trying to remain neutral. My job as a pastor is to help them deal with that death, and I know that one way to deal with it is to make sure that life comes out of darkness and death. That is the way we can do it, by helping a family. If we can avoid having to do it at that time of urgent care in a hospital when someone has died and someone else is facing a tragic decision, then we should do it. It is a matter of life and death and we have the power. We do not often, in the House, get to save lives. We are not first responders. In this bill, we have a chance to save lives and we should take it. Ensuring that there is a safe, good, efficient way to register advance directives is part of our mandate as members of this House of Commons, and this bill would accomplish that.

We all have stories about this. A couple of years ago, I read a story that came out of a school shooting during a wave of violence. This particular story happened in Paducah, Kentucky. Several children died in a school shooting. Afterward, a reporter asked the mother of one of the little girls who had been shot what her thoughts had been as she raced to the hospital. She said she kept praying over and over again, “Lord, let my daughter live.” The reporter continued, “What happened when you found out that your daughter was dead?” The mother responded, “I started praying they would be able to use her organs so that others could live.” Indeed, that came about. What happened was that this little girl's heart was given to a man who desperately needed a transplant. Months later, the mother went to see him. She was introduced to the man and asked for one thing: Could she put her head against his chest to hear her daughter's heart beating again? This act was a gift to both families. It was a gift to a mother who had lost a daughter and a gift to a man who had new life: a little girl's heart beating and beating and beating.

In the House, we have a chance to make that kind of a difference. We can send this bill to committee, we can make sure it gets passed and we can save a life.

Mr. Speaker, I am pleased to rise tonight to speak in support of the private member's bill brought forth by the member for Calgary Confederation, Bill C-316.

This legislation would amend the Canada Revenue Agency Act to allow Canadians to use their annual income tax returns to register as organ and tissue donors. The agency would be able to enter into agreements with provincial and territorial governments to collect this valuable information, which would then be passed on to the provinces and the territories and be used for the purpose of establishing or even maintaining their organ donor registries.

No information would be passed along to an individual's province or territory of residence unless that individual had authorized the Canada Revenue Agency to do so in the income tax return. As a result, respect for the privacy of Canadians would continue to be of the utmost importance under the bill.

Bill C-316 seeks to address a very serious problem within our health care system facing many Canadians.

Canadian Blood Services estimates 4,500 people across this country are on wait-lists every year to get critical organ transplants that have the potential to save lives. Unfortunately, these organ transplants are not always readily available and the consequences are devastating. To this effect, Canadian Blood Services also reports that on average, 250 Canadians die each year waiting for a transplant. It could be someone's mom, dad, grandma or grandfather.

In 2016 alone, over 4,500 people were waiting for transplants but only 2,835 organs were transplanted. Two hundred and sixty people died that year while waiting for organ transplants. These tragic losses are totally unacceptable and Canadians recognize this major problem. However we can fix this problem and make change for the better. We need to take action to help as many Canadians as possible receive the potentially life-saving organ and tissue transplants that they desperately need.

One of the primary goals of the bill is to give Canadians an annual opportunity to register as organ and tissue donors in a way that is totally simple and cost effective. Provinces and territories would still have the constitutional authority over the establishment and the maintenance of these organ donor registries.

The bill would also allow provincial and territorial governments to use existing resources within the Canada Revenue Agency to assist in the collection of organ donor information in a way that respects the privacy of all Canadians.

The bill is so important because it would make it easier for all Canadians to register as organ donors by simply including the information on their income tax returns.

The Canadian Transplant Society states that while over 90% of Canadians support organ and tissue donation, fewer than 20% of Canadians have actually made plans to donate. For Canadians who wish to register as organ and tissue donors, the process should not be complicated. Canadians should be able to indicate their choice to be an organ or tissue donor in a way that is clear and accessible for all Canadians. Bill C-316 seeks to support this objective for the sake of both organ donors and the thousands of Canadians waiting for critical organ transplants each and every year.

Bill C-316 represents a sensible solution that has the potential to help thousands of Canadians in need and benefit the lives of many more.

Tonight I would like to share two stories with the House, one of an organ recipient and the other of an organ donor family.

Shammi Rathwell is a constituent of mine in Saskatoon—Grasswood. I have known Shammi and her husband, George, for many years. Shammi was 42 years old when her doctor detected a heart murmur. Medication did not fix the issue, and after open-heart surgery to repair a valve, it was determined that the only option to correct this issue was a heart transplant. Shammi, in September 1991, went on the list. She was fortunate. Two months later, she was called.

To quote Shammi, “From the beginning, my transplant went very well. I did have a brief rejection early, but once that was resolved, I have been able to live a full and productive life. It will be 17 years this coming November. I have watched my girls grow, become educated. In fact, one just got married, and I can't wait someday to be a grandmother. I am so thankful to my donor for the gift of life. The family must have been in deep grief and yet made the decision to donate the organ which saved my life. I don't know who my donor family is, but I think of them very often and thank them every day.”

The second story I want to share with members deals with the tragic accident of the Humboldt Bronco bus this past April that claimed the lives of 16 people.

Logan Boulet was one of the players who died in that accident on Friday night, but the story of this heroic 21-year-old certainly needs to be told. Just the summer before, in Lethbridge, a mentor of Logan's, an athletic trainer named Rick, suddenly passed away. Logan found out that Rick had signed the donor registry earlier in Alberta. He decided then that when he turned 21, he too would respect Rick and follow him to sign the registry in Alberta.

When this tragic accident happened on April 6, his parents, Bernadine and Toby, who I spoke with at length last night in Lethbridge, knew to carry out the wishes of their only son, Logan. Saturday morning, in the hospital in Saskatoon, Bernadine had one simple request. Her request was to hear Logan's heartbeat for the final time. She laid her head on his chest before the doctors proceeded with the successful organ recovery.

Even though Logan has passed, Bernadine and Toby know that their son's heart is beating somewhere today in Canada. The Boulet story will be told many times, not only in this country but in the world, as both parents have agreed to speak about their ordeal to help others better understand the importance of organ and tissue donations. They, by the way, fully endorse Bill C-316.

Since Logan's tragic passing, almost 100,000 Canadians have registered to become organ donors. It is clear that Logan's selfless decision to become an organ donor has made a lasting impression in this country.

Let us spin ahead to next year, April 7, 2019, which is exactly one year after the passing of Logan Boulet in the RUH hospital in Saskatoon. The Canadian Transplant Society will proclaim “wear green shirt day” in Canada. Green, of course, is the colour of the Humboldt Broncos, the team he played for in the Saskatchewan Junior Hockey League. “Wear green shirt day” will be in recognition of Logan, along with many other organ donors in this country.

It is clear that the benefits organ donors provide to people in need is invaluable, and this bill would offer a simple solution that would help provide these benefits to as many Canadians as possible.

Mr. Speaker, I rise today to speak to Bill C-316, an act to amend the Canada Revenue Agency Act (organ donors). I would like to once again express my congratulations and thanks to the hon. member for Calgary Confederation for all his hard work on this issue.

This legislation would give authority to the federal government to coordinate with the provinces and territories to allow Canadians to register as organ donors through their federal tax filings.

Canada's New Democrats will be supporting this measure, because we believe that it will help to increase registration rates. Organ donation registration has been proven to be transaction based, and tax filings represent a transaction that millions of Canadians engage in every year.

Indeed, this legislation aligns closely with the NDP's long-standing advocacy and legislative work around organ donation.

For over a decade, New Democrats have been working to create a pan-Canadian organ donor registry to coordinate and promote organ donation throughout Canada. Legislation to create such a registry has been introduced by New Democrat MPs on five occasions: in 2002, 2003, 2008, 2009 and 2013.

Unfortunately, our federal government over the last 16 years has not been able to muster the will to implement this policy.

In February 2016, the Conservative member for Edmonton Manning, whose own son has been the recipient of three donated livers, reintroduced this private member's legislation, Bill C-223, with the unanimous support of the NDP. Unfortunately, the Liberal government voted to block that bipartisan effort. Canada's New Democrats were profoundly disappointed to see the Liberals rush to this determination without even sending the bill to committee for study.

One donor can save up to eight lives and benefit more than 75 people. However, at 18 donors per million people, Canada's current donation rate puts us in the lower third of developed countries. In fact, Canadians are currently dying on wait-lists because our organ donation rate is so low. In 2016, there were 4,500 Canadians on the recipient wait-list, and 260 died waiting for a transplant.

In order to address this unacceptable shortfall, the House of Commons Standing Cornmittee on Health agreed to study Canada's organ and tissue donation procurement system in March 2016, once again as a result of the initiative of my hon. colleague from Calgary Confederation.

As part of this study, the committee heard from a range of witnesses, including representatives from Canadian Blood Services, provincial organ donation and procurement organizations, researchers, health care providers and charities. The committee learned that although some jurisdictions in Canada are considered centres of excellence in organ donation and transplantation, others lack the resources and capacity to adopt best practices in this area.

As a result, the rate of donors varies significantly by region in Canada. In 2013, Quebec had the most deceased donors, with 20.2 per million population. Manitoba and Saskatchewan, on the other hand, had only 7.2 per million. British Columbia is Canada's living donor capital, with 28 living donors per million people.

The committee also heard that limited public awareness and public discourse about organ donation mean there are also challenges related to consent for organ donation in Canada. In addition, witnesses called for more research and better data collection across Canada to help identify potential organ donors within healthcare systems and improve treatment outcomes for transplant patients.

New Democrats hope that the committee's report, tabled earlier today, and its seven recommendations will place a renewed focus on the need for federal leadership to improve Canada's organ and tissue donation system.

In particular, we are pleased that the report contains a recommendation calling for study of a presumed consent or opt-out system for organ donation, an idea that New Democrats believe could make a huge difference in the number of organs available to save lives. Unlike Canada's current opt-in system, an opt-out approach would automatically register all citizens for organ donation unless they choose to indicate otherwise.

Countries with opt-out systems consistently record higher donation rates than opt-in countries. Indeed, this approach has helped to make Spain a world leader in organ donation over the past 25 years. In Austria, the donor rate quadrupled after instituting opt-out legislation, and similar regulations in Belgium doubled kidney donations.

I would be remiss not to mention that during the committee's study, it became clear that there is tremendous confusion over whether gay men are eligible to be organ donors in Canada.

One could be forgiven for confusion on this point, since sexually active gay men are currently banned from donating blood in Canada. However, under regulations first enacted in 2007, men who have sex with men are eligible to be organ donors on a case-by-case basis. Apparently in our country, one can take a gay man's heart but not his blood.

Helen Kennedy, executive director of the LGBTQ2 advocacy organization Egale Canada, has described this approach as outrageous.

Dr. Paul MacPherson, an HIV researcher with the Ottawa Hospital Research Institute's chronic disease program, has been clear that this ban does not match the science.

For men in stable long-term relationships, the risks associated with blood donation are exactly the same as those for a heterosexual couple. Given this, Canada should adopt a blood donor policy that is evidence-based, gender neutral and behaviour-based.

Although, by this standard, Canada's organ donation system also perpetuates harmful stereotypes based on risk categories that cannot be justified by the science. This policy leads to confusion for potential donors and an inconsistent application of the rules, which can have immensely tragic consequences.

When the Prime Minister spoke to Egale Canada this past May, he appeared to agree that the rules for blood and organ donation needed to be changed. In fact, he named “discrimination in blood and organ donation” as among the next frontiers of the LGBTQ2 movement.

However, it is difficult to comprehend the Prime Minister's call for advocacy when it is already within his power to end this discriminatory federal policy. In fact, in the last election, the Liberal Party pledged to end the ban on gay men donating blood, saying that this policy ignored scientific evidence and must end. Instead, the Liberal government simply reduced the celibacy period from five years to one year. This perpetuates discrimination against gay men. The New Democrats call for it to end now.

It is time for the Liberal government to finally live up to its word by ensuring Canada's blood and organ donation policies are truly non-discriminatory and based on science.

I wish to conclude my remarks today by strongly encouraging all Canadians to register as organ donors and to discuss their wishes with their loved ones. One donor can save up to eight lives through organ donation and enhance the lives of up to 75 more through the gift of tissue. There is always the potential to be a donor, so people should not let anything stop them from registering.

Each potential donor is evaluated on a case-by-case basis. Current or past medical history does not prevent anyone from registering. Individuals with serious illnesses can also sometimes be organ and tissue donors.

All major religions support organ and tissue donation or respect an individual's choice. Age alone is not a barrier to being a donor. Therefore, I ask people to please consider giving the gift of life.

I wish to reiterate the NDP's support for the vital initiative before us today and affirm our commitment to ensuring every Canadian who needs an organ or tissue transplant receives it. No one should ever die because the call did not come in time.

Mr. Speaker, I just put on my “Be a Donor” ribbon and assume I am allowed to wear it in the House.

I am pleased to rise today to speak in favour of Bill C-316. I want to applaud the member for Calgary Confederation for all of his tireless efforts on improving organ donations across Canada, first in Alberta and now here in the House of Commons.

Organ donation rates across the country are, quite frankly, pathetic. Here in Ontario, more than 85% of residents are in favour of organ donation, but only one in three Ontario residents has registered his or her consent to donate. This trend is similar across the country. There is clearly a disconnect between people's wishes and their actions and, sadly, without an individual registering in advance, the family is often faced with this decision at a time of crisis, dealing with the loss of a loved one when so many emotions are in play. Too often we have not discussed our wishes with our loved ones.

We know that health care delivery is a provincial responsibility and I applaud the member for finding a way to engage the federal government in this important issue while still respecting our constitutional jurisdictions. This bill would make it easier to gather information: a simple check mark on one's income tax return and, voilà, the information is passed on to the province of residence. A province can choose not to participate in the program if it so wishes. This is so important because while our provincial counterparts have made tremendous strides to raise awareness and registration rates, we are still not seeing donor registration rates rising as they should.

In 2012, when I was an Oakville town councillor, I was part of a group of Oakville residents who formed the Oakville Be a Donor group. It grew out of a call from Oakville resident Jennifer Malabar, who challenged the mayor and council to register as organ donors. Jennifer developed a kidney disease while pregnant with her first child, Arya.

Facing an eight-year wait for a kidney transplant or the prospect of dialysis, Jenn was the recipient of a kidney from her husband Hitesh Patel, on their wedding anniversary no less. Hitesh later joined me for the Courage Polar Bear Dip wearing a Be a Donor T-shirt to raise awareness for organ donation. They later welcomed their second child, Sage, and the family continues to thrive.

Through the Oakville Be a Donor group, I met the most amazing people: Bev Cathro, who donated her kidney to her young daughter, and Ron Newman, affectionately known as the “Dialysis Dude”, who received a kidney transplant and lived dialysis free for many years, but is now back on dialysis as he waits for another donor. Ron continues to advocate and also organizes the Halton Kidney Walk every year.

Julie Pehar, whose experience was a different one, came to our group having lost a loved one and having made the decision to donate his organs.

Sarah Taylor and Keith Childerhose is a love story that played out as Keith struggled to breathe. In need of a lung transplant, Sarah took to social media to publicize Keith's challenges. They appeared in the news as Keith waited for a double lung transplant.

Keith was failing quickly and was on life support. He had been living with diffuse panbronchiolitis from the age of 25 and had been fighting the disease for 15 years. This severe and rare disease caused fluid to continually build up in his lungs, similar to cystic fibrosis. On life support, the news came that Keith was heading into a 10-hour surgery as a donor had been found. In one of the most touching photos ever taken, with Keith hooked up to an IV and tubes, looking into each other's eyes, Keith touched Sarah's nose as she touched his hand.

The good news is that the surgery was a success and brought much-needed attention to the need for organ donation. In a lovely twist to the story, the two were engaged, then won a wedding package and were married in 2013. As wonderful as Keith's and Sarah's story is, sadly, across our country there are too many stories like Keith's that do not have a happy ending.

Our Oakville Be a Donor group gathered together the Interfaith Council of Halton, community leaders and politicians to create a poster to be displayed around town. How pleased I was recently to visit the Halton police station and see our poster still hanging on the walls of the offices.

Despite our efforts to raise awareness, registration rates across Canada are dismal. I want to share some statistics from the Ontario Be a Donor website. In Ontario, there are over 1,500 people waiting for a life-saving organ transplant. This is their only treatment option and every three days someone will die because they did not get their transplant in time.

One donor can save up to eight lives through organ donation and enhance the lives of up to 75 people through the gift of tissue. Age alone does not disqualify someone from becoming a donor. The oldest organ donor was over 90, and the oldest tissue donor was over 100. There is always the potential to be a donor, and it should not stop someone from registering. Anyone over the age of 16 can register.

Current or past medical history does not prevent someone from registering to be a donor. Individuals with serious illnesses can sometimes be organ or tissue donors. Each potential donor is evaluated on a case-by-case basis.

All major religions support organ and tissue donation or respect an individual's choice.

Organ and tissue donation does not impact funeral plans. An open-casket funeral is possible.

Right now, there are over 1,100 people in Ontario waiting for a kidney and 252 people waiting for a liver, and 46 of those on the wait-list are under the age 17.

When we register, we give hope to the thousands of Canadians waiting for a transplant. Those on the transplant wait list are often living with organ failure, like my friend Ron Newman. Tissue donors can enhance the lives of recovering burn victims, help restore sight and allow people to walk again. Transplants not only save lives, they return recipients to productive lives.

As I speak today in support of Bill C-316, I want to remember my friend Bob Hepburn. Bob was a generous and kind soul, a teacher-librarian who was a role model for hundreds of students at Abbey Park High School in Oakville and best friend to Tim Robertson. Bob was generous beyond words, so much so that he was twice a living donor, once donating his bone marrow and another time his kidney. Bob died quite suddenly a few months ago, and those to whom he had given the gift of life came to his funeral.

I thank my colleague across the floor, the member for Calgary Confederation. I know that this is an issue he has been committed to for years. I am proud to call him a friend and even prouder to have been asked to be a seconder of this bill. It is my sincere hope that Canadians will soon have another simple option to register as donors on their income tax returns, thanks to his private member's bill.

Those who are watching today should talk to their loved ones about their wishes and go online and register today. In Ontario, they can go to www.beadonor.ca right now. It only takes two minutes to register.

I ask all members of this House for their support for Bill C-316. This bill would create a simple way for Canadians to register as organ donors. It is my sincere hope that when Canadians file their income taxes in the near future, they can just click on a box to have the federal government notify their province of residence of their wish to register.

I will continue from where I left off, Mr. Speaker.

The Humboldt Broncos tragedy last spring highlighted the issue across Canada when Logan Boulet signed up as an organ donor just weeks before his tragic death. This incredibly kind gesture prompted thousands more to register, but it is still not enough. While over 90% of Canadians say that they support organ donation, only 25% are registered. In the meantime, hundreds die every year waiting for a donor. Sadly, Canada has one of the lowest donation rates in the world. A single organ donor can save up to eight people and a single tissue donor can help up to 75 individuals.

My bill, Bill C-316, proposes a very simple, very effective method to increase the size of the organ donor base here in Canada. It would also help update existing databases, but most important it would save lives. I am proposing that we use the annual tax form to ask Canadians if they would like to become a registered organ donor and if they consent to have this information passed to their provincial government for addition to its existing organ donor registries.

Before I go further, I must thank the 20 members of Parliament from all parties in the House who have stepped forward to officially second my bill. I will just let that sink in. There are members from all political parties in this House who have signed on as official seconders to this bill. That is a rare occurrence indeed. This extraordinary non-partisan approach demonstrates how a sensible idea can bring us together as a House to improve the lives of all Canadians. This collaborative approach has extended to the health committee, the committee that I serve on along with nine other colleagues of mine who have been extremely supportive of improving the organ and tissue donation situation here in Canada, and I deeply appreciate the support on this issue and with this bill.

This is not a political issue; it is a human issue. Any one of us could be in need of donor organs or tissues at any time. Just asking this simple question could increase the number of donors. Just recently, donor registration jumped up 15% in British Columbia when drivers were asked directly at licensing locations across the province if they wanted to be donors. It jumped up 15%, so we can imagine what we can do on a national scale.

Tax forms, by law, are restricted to collecting data for the purposes of taxation only. This is why we need to amend the law to allow for this common-sense approach to a national problem. My bill is modelled on the successful inclusion on the tax form of the question asking Canadians if they want Elections Canada to be kept informed of their current information. My bill has been crafted in keeping with this successful precedent.

Other initiatives to improve organ donation have been voted down in the past here in this House of Commons, as some felt the proposals were an infringement on provincial jurisdiction. My bill would not infringe on the provincial responsibility of managing donor lists; it would just support their existing work. My proposal is so simple and could be implemented so quickly. The federal government, via the Canada Revenue Agency, already successfully shares data every day with all the provinces and territories via encrypted networks with strong and reliable privacy safeguards. In addition, the existing infrastructure would support this change at virtually no cost. The CRA already shares dozens of data fields of information on every taxpayer with the provinces and territories and this would simply be one more data exchange. The tax form is a way to update this information annually via a legally binding document. It would allow for provincial lists to remain current and relevant.

While some methods used by the provinces such as driver's licences and health care cards help register donors, as they do, none has as far a reach as the tax form.

The existing voluntary online method of registering is neither proactive nor fully effective. For example, those who move from one province to another rarely update their information. The tax form approach overcomes these common problems.

As the federal government would simply be collecting the data and passing it to the provinces, we would not be opening the jurisdictional can of worms. The federal government would not be encroaching on provincial jurisdiction because we are not setting up a federal registry. We would provide the information to the province and it would use the information as it sees fit. The provinces would still maintain their own lists. We would just be supplying them with data for that purpose.

When someone dies, the tax department is often one of the first government agencies to be notified. This too would help update provincial registries and keep them current. This is a huge opportunity for the House to show leadership in organ and tissue donation efforts.

Stakeholders have been universally supportive of the bill, and the thousands of affected families with loved ones on waiting lists will welcome this additional help. One stakeholder, the Ontario Trillium Gift of Life Network, is the largest registry in Canada. Its CEO, Ronnie Gavsie, says:

...we would support creating an opportunity for Canadians, when filing their income tax returns, to register their consent for organ and tissue donation.... The online income tax return becomes a gateway and an annual reminder to drive Canadians to organ and tissue donor registration.

We share with you the goal of substantially improving awareness of organ and tissue donation and improving health for Canadians by increasing the number of life-saving transplants.

The federal agency responsible for organ donation is Canadian Blood Services and its vice-president, Dr. Isra Levy, said:

Just like our colleagues, we support a transactional touchpoint that will raise the awareness, especially if it leads to the conversation.... But for sure this is something to be welcomed.

Elizabeth Myles of the Kidney Foundation of Canada has written to the Prime Minister expressing the foundation's support for this change. Dr. Amit Garg of the Canadian Society of Nephrology, a society of physicians and scientists specializing in the care of kidney disease, and Dr. West of the Canadian National Transplant Research Program also expressed their strong support for the bill. The list goes on. Support for this legislation reaches far and wide across the country, into every community.

The health committee just tabled a report on organ donation this very morning in the House, with a number of key recommendations. The committee wanted to know what role the federal government could play in strengthening Canada's organ donor donation and transplantation system. One of the key recommendations in the report deals directly with the debate we are having right now. If this bill is passed, it would go a long way toward fulfilling that key recommendation. We have the opportunity to leverage the resources of the federal government to help our provincial and territorial partners improve their registries, and I hope we do.

I and, most importantly, 4,600 Canadians awaiting life-saving transplant hope we can count on all MPs to support the bill.

I want to deeply thank a particular individual, a friend, Mr. Robert Sallows of Calgary. Robert received a double lung transplant 13 and a half years ago, at the age of 17, which granted him a new lease on life. Since having the transplant he has been very active within Alberta and Canada, raising organ and tissue donation awareness. He helped me immensely with the passage of my bill in the Alberta legislature, which created the Alberta organ donor registry. Sadly, Robert has recently entered the palliative care process. I want him to know that his determination, his struggle and his advocacy for organ and tissue donation have provided me with so much inspiration and motivation to improve the lives of others in need of a transplant.

Mr. Speaker, for those who may not already know, I have been a long-time advocate of organ and tissue donation in Canada. In fact, a few years ago I passed a bill in the Alberta legislature as an MLA, resulting in the creation of the Alberta Organ and Tissue Donation Registry. It also put in place a strong and robust education and awareness program that included adding donor hearts to our Alberta driver's licences.

One is to you, Dr. Lori West, regarding your presentation and the document you provided. First, thank you for your great work in research as well. You mentioned here that you have a solid track record of success, which you do. One thing in particular, I noticed here, is that you uncovered the legal, social, institutional, and professional challenges that contribute to the family veto of previously registered intent to donate. I would like you to elaborate on that. Are we seeing many situations in which families are vetoing the wishes of the potential donor?

Good afternoon, everyone.

Thank you for inviting me today.

Thank you, Mr. Chair and committee members, for dedicating your time to addressing the many challenges of organ donation and transplantation in Canada.

Like Dr. Kneteman, I am part of medical teams. I am a pediatric heart transplant physician and a scientist in transplant immunology, so I can bring that expertise to our conversation today.

We really applaud your efforts in convening this study on what we can do across the country, as a country, for the tens of thousands of Canadians whose lives can be saved or improved with a cell or organ transplant.

We also thank you for inviting the Canadian National Transplant Research Program to be part of this discussion. We appreciate the importance of the opportunity to inform you about our program and our successes and to provide suggestions for what the federal government might do to increase donations, increase access to transplantation, and improve transplant outcomes.

I think all of us here today understand the life-saving and economic benefits of transplantation. We all recognize the importance of Canadians registering their intent to one day become an organ donor, should the occasion arise. Last month's tragedy in Humboldt certainly was evidence of that, inspiring more than 100,000 Canadians across the country to register online to become organ donors.

However, even with increasing numbers of Canadians being aware of the importance of organ donation, last year in Canada we had fewer than 800 deceased donors and only about 500 living donors. There are 4,500 Canadians officially on the wait-list, and I think it's really important to recognize—and this isn't necessarily generally recognized—that thousands more Canadians could be added to the wait-list. The wait-list numbers really don't reflect the true impact of this problem. This is not a niche area. Tens of thousands of Canadians could benefit from transplantation if there were any hope of finding a donor, so many Canadians who are in need never make it onto wait-lists. I think we need to bear in mind that this is a much bigger problem than what is reflected in those numbers alone.

Our system is falling short of its potential to transform lives in Canada despite the gains that have been made in recent years to return patients suffering from many types of chronic diseases, malignancies, and organ failure back to good health. Furthermore, once a person receives a transplant, we need to optimize the long-term transplant outcomes so that retransplantation isn't needed, which of course further accentuates the difficulties of finding sufficient organ donors so that transplantation can become truly a cure for these diseases.

I think it's important to recognize—and certainly we believe also—that this is solvable. This challenge is not impossible. Canada has the technologies, the people, the resources, the researchers, and the assets to solve this problem. It's not like a problem about which we would say “if only we knew this” or “we didn't know that”. This is a solvable problem. We can take much information from places in which there have been successes around the world, and I know we do, and that has been part of the discussion.

Increasing donation and increasing access to transplantation require a strong national partnership at many levels. It starts with having strong and well-funded provincial organ donation agencies, as you heard about on Monday from a number of individuals from different provinces. It requires clear linkages with health charities and with patient groups, creative partnerships with Canadian biotechnology and the pharma industry, and a well-funded national health delivery policy and coordinating agency through Canadian Blood Services, as will be noted by Dr. Kneteman and as was discussed by Isra Levy on Monday. Also critical is a strong and independent national research network that can provide the evidence, the evaluation of evidence and strategy, new knowledge, and new discoveries that will have rapid impact.

To this point, in 2013 the Canadian government, through the Canadian Institutes of Health Research, funded the Canadian National Transplant Research Program, the CNTRP, the goals of which were to put together a framework of research to unite donation and transplantation researchers across the country and across the many disciplines that make up this very complex landscape. Only in that way can we really have high and realistic hopes of moving forward.

This initiative was a result of strong partnerships among several CIHR institutes, including Infection and Immunity; Cancer Research; Nutrition, Metabolism and Diabetes; and Gender and Health; as well as our ethics office and many of our partners who you are hearing from or will have heard from, such as the Kidney Foundation of Canada, the Canadian Liver Foundation, Canadian Blood Services, les Fonds de recherche du Québec - Santé, Genome BC, Cystic Fibrosis Canada, Astellas Pharma, and several others.

What we've created in Canada now is a national research structure that is unique in the world. It unites bone marrow transplant researchers, donation researchers, and solid organ transplant researchers. There is actually no other program like it globally, and it has really become the envy of our international collaborators and partners.

I'll give you a few examples of our major accomplishments over the last five years, because I think they may help inform some of the ideas and proposals that you're thinking about in your discussions in this committee.

The CNTRP has linked researchers at 31 academic institutions and universities across Canada with central leadership provided by the University of Alberta and the Université de Montréal. We've brought together more than 150 investigators, more than 200 trainees, and more than 200 collaborators focused solely on these issues. We're supporting more than 75 tightly interlinked national-based studies that link donation, solid organ transplantation, and bone marrow transplantation together, importantly bringing the science and the clinical research together with health economics, health law experts, ethics researchers, and policy experts. On the hard sciences side, we are linking these with relevant areas in chemistry and engineering. On the humanities side, we are linking them with social scientists, policy scientists, and with machine-learning and artificial intelligence experts. All of these have an important role to play in moving this kind of work forward to have real impact on what we are considering.

We've brought patients and families into our structure as key research partners. Having the public as part of these research efforts ensures not only that we are addressing their priorities but also that we, within a research framework, are accountable to the financers of research. This helps us to evaluate the impacts and propose new projects that are directly influenced by the patient priorities.

We've launched and are supporting the world's largest clinical study in deceased donation with our ODO partners. The study is ongoing and it is transforming donation research in Canada and around the world, with many important international partners.

We've launched national trials using these new—you may have heard about them—“organ in a box” ex vivo perfusion devices. These take organs, and instead of putting them in a bucket of ice and moving them from place to place, keep them alive, functioning, and in much better condition for transplantation. This means that, with the geographical realities of Canada, we can deal with these things and move things around. These are all very creative approaches that are needed in order to really impact these questions.

We're also proposing international strategies to address transplant tourism and organ trafficking, and looking at factors that impair both access to transplantation and outcomes across the full age span, as well as integrating sex- and gender-focused research and, importantly, equity across various diverse groups.

We're addressing issues that impact access and outcomes for Canada's rural, remote, and indigenous populations and other vulnerable groups that are often overlooked.

After five years, the CNTRP has demonstrated the power of creative collaboration, and this has been emulated by several new health research networks both in Canada, such as for antimicrobial resistance and Lyme disease, and importantly, around the world including the British Transplantation Society, the Transplantation Society of Australia and New Zealand, the organization in Germany, and so on, which are asking how they too can build national networks that can have this kind of power on outcomes.

The CIHR and its partners have recently provided support for a three-year extension of our basic infrastructure, but the challenge is to find sustained funding to support this important research and to grow this network.

To this end, we're proposing ideas that were impossible five years ago. We're proposing a larger vision to fulfill every transplant donation, every donation opportunity in Canada, to not miss any, to basically get rid of the waiting list, and to turn transplantation into a cure. We call this our "one transplant for life” challenge, which we've included in the materials for you.

We believe that the CNTRP can help integrate, execute, and evaluate strategies and ideas being discussed by your committee, and we're eager to work with you.

We'd provide abundant multidisciplinary expertise, and we can bring relevant partners to the table to continue to work with you on these issues. We know we could help with some of the examples that were proposed by Ronnie Gavsie on Monday and that will be proposed today, such as a public education campaign, working with CBS to evaluate a national death audit program, and so on.

Of major importance, as I conclude, is support for Bill C-316, which is a real example of the creative nature that's needed to look at why we cannot afford to be stymied by the makeup of our country. We can turn it to our benefit and really use those sorts of strategies to get where we want to go.

In conclusion, we think this is a perfect opportunity to move forward. We're very excited about this committee's attention to these issues, and we thank you again for allowing us to present today.

Mr. Speaker, I am pleased to present a petition in support of my private member's bill, Bill C-316. The bill asks that Canadians be able to register as organ donors through their annual tax returns. While 90% of Canadians support being an organ donor, only 25% are registered.

April is BeADonor month, which aims to raise awareness of organ and tissue donation. Ironically, April is also the deadline for filing taxes.

Becoming an organ donor is the easiest way to save a life of a fellow human being. By raising awareness and making registering easier, we can save more lives.

Mr. Speaker, I am rising to table petition e-642, my first electronic petition, signed by 2,252 people in support of the member for Calgary Confederation's private member's bill, Bill C-316.

I want to take a moment to thank Shauna Rivait, who is the initiator of the petition. She worked extremely hard to get this many people to support her and to support the member for Calgary Confederation by signing this petition. It is very important. She has a personal connection to this, as do many people who signed the petition. Her father lived for 10 extra years thanks to a double lung transplant. Her sister, unfortunately, passed away.

I want to thank Shauna and all those who signed it. I also want to thank the government members for giving consideration to this bill. I will be going back to every single person who signed this petition to thank them for supporting my colleague in this endeavour.

moved for leave to introduce Bill C-316, An Act to amend the Canada Revenue Agency Act (organ donors).

Mr. Speaker, I rise today to introduce a bill that would assist the provinces in growing and maintaining their organ donor registries. Four thousand six hundred Canadians are currently awaiting a transplant, and we can help.

My bill would ask Canadians, on their annual tax return, if they consent to having their provincial or territorial government inform of their desire to be added to their organ donor registry. The bill would be a sensible, cost-effective way of using an existing and legally binding document to annually update organ donor registries throughout the country. It would respect provincial jurisdictions and utilize existing privacy and information-sharing agreements. It would have the potential to save many lives.

I want to thank the hon. member for Calgary Shepard for seconding my bill. I look forward to having support across all parties.
