The notion of “demonstrable need” was introduced by the Senate in clause 39.1, which refers to information assessment. In this case, you would like to introduce it in clause 37.1. What is the difference? I agree in principle, but I want to understand why you want to introduce it there, when the Senate has already done so in clause 39.1.
