Here again, we have this same vague and ill-defined notion of independence, regarding which there is no case law. What is worse is that an individual we might be investigating, having heard that this is the case—indeed, we often call these people ahead of time to get their reactions or their comments—could, following a first report, expect that there would be a series of others. He could then ask to obtain the material ahead of time so as to prevent its publication. This concerns us greatly.
