I have not conducted a thorough investigation that could provide a basis for a conclusion that there has been abuse. What I can say is that, from a principled point of view, the more exceptions you have, the closer you are to the old situation where there was no control at all on decisions of public authorities as to the procurement process. I think there is potential for abuse, certainly, if the position is that there is no review at all once the national security exception is invoked.
I cannot say for sure that there has been abuse. In fact, that's the role of the court or tribunal to decide, but if the court or tribunal has no jurisdiction, then how can we know whether there has been abuse or not?
