Subclause 12(2) is as written in BQ‑5, and then you would add an additional subclause 12(3). You're adding, as opposed to just substituting. That's the point.
If you look at BQ‑5 and (2), if that's adopted, that's as written there, and, if LIB‑4 is also adopted, that (2) becomes a (3).
