That's partly because the Commissioner of Official Languages has often hesitated to take legal action. As a result, the Federal Court has not been called upon as often as it could have been. However, I could have said that there was a time when the Federal Court's interpretations were liberal and generous. I am thinking in particular of the Gascon decision, which sort of “cut the legs from under” section 41 of the Official Languages Act.
