The other thing the shippers talked about was the ability of the railroads to apply extra fees for demurrage. That was one of the things they talked about, whereas there's no countervailing ability for the shippers to seek damages from or have some kind of penalty on the part of the railroads.
Essentially this bill creates a penalty, but the penalty is really a tax. If you have this agreement and you fail, you pay the government, and then you go off to court and decide how much between you. It's really a way for the government to tax the railroads for failing to live up to their agreements. It may be an incentive for the railroads to live up to their agreements, but it's not going to solve the whole problem, because you're still going to have a dispute between the shipper and the railroad.
