Mr. Speaker, the hon. member knows full well that the provision that is being discussed is a provision that exists presently in the Criminal Code of Canada. I point the hon. member to the fact that there continues to be regional variation in sentencing under the Criminal Code.

Mr. Speaker, I am sure the hon. member knows, being a former advocate himself, that a similar provision has existed in the Criminal Code for some time. I am sure he also knows that the provision of that section in the Criminal Code has not prevented regional variation in sentencing.

Mr. Speaker, not only have we listened to the views and concerns of Quebec, we have learned from the model of Quebec. The new youth justice legislation acknowledges diverse approaches to the challenges of youth crime. In fact, I think if the hon. member carefully reads the youth justice act he will find that there is no attempt to impose uniformity of sentencing across the country.

In fact, what I would do is call upon the hon. member and all those wherever they live in the country who care about the challenges of youth justice to understand that the proposed youth justice legislation represents a balanced approach, understands the diversity of approach in the country and will permit Quebec to continue to deal with young offenders in the way it always has.

In fact, as the hon. member knows, our youth justice strategy is an integrated and balanced strategy that acknowledges the fact that this country incarcerates too many young people. Our strategy, when implemented, will ensure that fewer young people are incarcerated needlessly in this country.

Mr. Speaker, this party, this government, has respect for the rule of law. We along with attorneys general in provinces such as British Columbia and Alberta understand that the correct approach is to defend the existing law, which we believe to be constitutional.

Mr. Speaker, the answer is loud and clear. It is too bad that members of the Reform Party do not stop their scaremongering in terms of this issue and act a little more responsibly.
Our position on child pornography and the constitutionality of the section in question is clear. The hon. member should read our factum. This matter is before the courts now. We believe the law to be constitutional and we, along with the attorney general of British Columbia, are defending that law.
