Mr. Speaker, I have made no decision in this matter as of yet. As I reported last week to the hon. member, I have referred this matter to the RCMP and to my war crimes unit.

Obviously in light of the House of Lords decision this morning we are now reviewing that decision and in the coming weeks we will make a decision based on the report of the RCMP as well as the advice of my war crimes unit.

Human Rights November 23rd, 1998

Mr. Speaker, as the hon. member is probably aware, we are about to begin a broad review of the existing provisions of the Canadian Human Rights Act and I have every reason to believe that the ground of social condition will be one which many will suggest should be added to Canadian Human Rights Act. I look forward to that discussion and the hon. member's participation in that discussion when it happens.

Justice November 19th, 1998

Mr. Speaker, Canadians across this country know the names of Donald Marshall, David Milgaard and Guy Paul Morin. In fact, those names are a tragic reminder that at times our justice system does make mistakes. Because our system does make mistakes, it is important to have a mechanism to ensure that justice is ultimately done.

The existing mechanism is section 690 of the Criminal Code. I have indeed begun a public consultation into the operation of section 690 because I believe it is my obligation to ensure that we have the most transparent, timely, fair and efficient mechanism—

Mr. Speaker, I apologize for that description of the hon. member's question. The prosecutions that are taking place are taking place on the basis of due process of law. They are taking place and moving forward as any other prosecution would. At this point because there are prosecutions before the court, I have no intention of commenting on any particular case.

Young Offenders Act November 2nd, 1998

Mr. Speaker, my provincial colleague Mr. Ménard, the attorney general of Quebec, had the opportunity to share with his colleagues from across the country the approach taken in Quebec and its success.

All ministers around the table concluded that what is important and the challenge for me is to ensure there is sufficient flexibility within any reformed youth justice system to accommodate different approaches.

Mr. Speaker, my provincial and territorial colleagues and I had a very good discussion last week in relation to the reform of the youth justice system.

Coming out of that discussion are four things the provinces put on the table. First, they want a flexible regime. Second, they want additional resources. Third, they want a balanced regime. Fourth, they want additional consultations.

Mr. Speaker, the hon. member raises a very important and a very serious question.

The government is committed to working with law enforcement officials in the United States. In fact this morning I instructed my department to do whatever it can, including providing additional resources to work with officials in the United States to put a stop to this kind of horrendous violence.
