In compliance with both pieces of legislation, Mr. Speaker, the Access to Information Act on the one hand, and the Privacy Act on the other.

When a piece of information is considered personal information, the consent of the individual concerned must absolutely be obtained before it may be disclosed and made public. It is in this context that the Treasury Board Secretariat has issued an opinion to all departments, and it is now up to them to apply it as they see fit.

Mr. Speaker, the hon. member for St. Albert is asking the same question as last week, so my response will be exactly the same.

There are two pieces of legislation that we in this parliament must respect, and that departments and ministers must respect. One is the Privacy Act and the other one is the Access to Information Act.

We must always strike a balance between the two: the right to information on the one hand, and the right to protection of privacy on the other. This is the gist of the advice given by the Secretary of the Treasury Board to our government departments.

Mr. Speaker, I think it is very clear that the information commissioner and the privacy commissioner could speak out and tell parliamentarians what they think about the system.

What I am telling the hon. member is that here we have two pieces of legislation. One is the Privacy Act and the other one is the Access to Information Act. We have to respect both. We have to consider personal information.

The supreme court decision is telling us that in cases of doubt, privacy should prevail. This is what we apply right now.

Mr. Speaker, what is very clear is that the departments must respect both laws. There is the Access to Information Act, but there is also the Privacy Act, and both are very important and very dear to the hearts of Canadians.

All that we have done is clarify the supreme court decision that we must pay very particular attention to personal information belonging to the minister.

This was the purpose of making clarifications to assist departments in processing requests.

Volunteers December 5th, 2001

Mr. Speaker, this morning the Prime Minister of Canada signed an accord with the volunteer sector and announced funding of $50 million over five years for the Canada volunteerism initiative.

This accord will help enhance our relationship with the volunteer sector, a relationship of co-operation, trust and partnership.

We all value the contribution of volunteers in our communities. I would encourage all members of parliament to volunteer themselves and to support voluntary organizations in their communities.
