The Budget June 7th, 2011

Mr. Speaker, I would like to ask the NDP's finance critic whether, before making their decision, she or the members of her party had the opportunity to speak with Quebec's finance minister, Raymond Bachand, about what is in this budget and what was unfortunately not in the March budget, and that is the $2.2 billion for sales tax harmonization. Many of the members from Quebec are now NDP. I am wondering whether their caucus or the member herself spoke with these people before making a decision about the final vote. I am also wondering what the NDP is going to do. In Quebec, we are very satisfied that the government has finally listened to the arguments of the Bloc Québécois and granted $2.2 billion for sales tax harmonization in Quebec. This is very important to Quebec.

Speech from the Throne June 3rd, 2011

Mr. Speaker, like the hon. member for Bourassa, I would like to begin by warmly thanking the constituents in my riding of Richmond—Arthabaska for giving me a fourth mandate. Clearly, I would have preferred a different seat here, one that was closer. However, democracy being what it is, I will obviously roll up my sleeves and make sure that my colleagues and I will be heard and that the needs of our constituents will also be heard.

Like the hon. member for Bourassa, my question is about current events. Can the member who just spoke tell me why, exactly, the government still, to this day, has not announced compensation for those currently affected by the flooding in the Montérégie area?

Not only has no compensation for the people in the Montérégie area been announced, but no compensation has been paid yet to the people who had to deal with the flooding caused by high tides in the Gaspé months ago.

I would like to hear his response. How could this not be part of the Speech from the Throne? I hope to see something on it soon.

Agriculture March 23rd, 2011

Mr. Speaker, the Conservative budget does not address the needs of farmers in Quebec. The government is refusing to improve the income stabilization programs. It is not providing adequate compensation for the additional costs related to the management of specified risk materials. Furthermore, it is making $400 million in cuts to the agricultural sector, a sector that is very important to our regions.

How could the government present a budget that completely ignores the needs of agricultural producers in Quebec?

Democratic Representation Act March 22nd, 2011

Madam Speaker, I thank my hon. colleague. It is not complicated. On three separate occasions, the National Assembly moved a motion calling on the House to withdraw Bill C-12, which marginalizes Quebec. That means all 125 members, whether federalist or sovereignist. Indeed, there are two sovereignist parties and two federalist parties in the Quebec National Assembly. All of those members voted against Bill C-12.

Here in the House of Commons, there is only the Bloc Québécois, but fortunately, we represent most of Quebec. Overall in Quebec, nearly 90% of Quebec's elected representatives want Bill C-12 to be withdrawn. Unfortunately, a few Liberal and Conservative members from Quebec continue to toe their party line. I would like them to explain to Quebeckers how reducing Quebec's political weight in the House of Commons is a good thing. Those members are the only ones who would say so. That is indefensible in Quebec.

Democratic Representation Act March 22nd, 2011

Madam Speaker, the minister's remarks illustrate exactly what I am saying. He says that it is fortunate that there are Conservative members in Quebec who represent Quebec well. I do not think he heard the numbers that I read out. Regardless of party, 87% of members from Quebec, be it members in the National Assembly or here in the House of Commons, said no to Bill C-12. But what do the Conservative members from Quebec do? They stand up to try and feed us the minister's lines and make us believe that reducing Quebec's political weight in the House of Commons is a good thing.

He is telling us that the Conservative members from Quebec are in favour of the Senate. Ask Quebeckers what they think. In fact, that has already happened, and the vast majority of Quebeckers want to see the Senate abolished. Senators are appointed, not legitimately elected, and they represent no one and nothing.

If the Conservative members from Quebec want to come to Quebec during the election campaign and say that the Senate is wonderful and that it does a great job of representing us, they are welcome to do so. I would like to see that happen. The problem is that they do not represent Quebec's opinion. The Bloc is standing up for Quebec here.

Democratic Representation Act March 22nd, 2011

Mr. Speaker, I am pleased to take part in the debate on Bill C-12. This is the kind of bill where we tell ourselves how lucky we are that the Bloc is here. We represent the people of Quebec when we stand for election. In its hateful advertising, the Conservative Party is preparing for an election and attacking the Bloc Québécois from all sides. It is appropriating the foremost quality of the Bloc Québécois, being the representatives of their regions. When this kind of bill is introduced, one party stands up for Quebec in the House of Commons, and that is the Bloc Québécois.

There is a consensus in the National Assembly of Quebec, where no fewer than three motions have been passed by all parties—the Liberal Party, the Parti Québécois, the ADQ, Québec solidaire—to oppose this bill. Only one party here will rise to say no to Bill C-12: the Bloc Québécois.

As well, according to a survey, over 70% of the population of Quebec, no small proportion, is opposed to Bill C-12. And still only the Bloc Québécois rises in the House to reject this bill. It is always quite bizarre to see the Quebec members from other federalist political parties trying to justify the desire to marginalize Quebec by imposing Bill C-12. We are quite shocked to have before the House a bill like this one.

Bill C-12 is not a tangible expression of the recognition of the Quebec nation. The Conservative Party said that it recognizes the Quebec nation within Canada, as the Bloc Québécois called for, but after that came nothing. No measure has been agreed to in the House to truly recognize the Quebec nation. Insult is then added to injury by presenting a bill like this.

Bill C-12 is a flat denial of the existence of the Quebec nation, which marginalizes its representation in federal institutions, in the House of Commons. Proportion of the population cannot be the only factor in determining the representation of each of the regions of Canada. If that were the case, Prince Edward Island, where there are four members of Parliament, could not have that many members, because its population is approximately equivalent to the population of the Central Quebec region, where I come from. The Bloc Québécois is not opposed to Prince Edward Island having representation in every area. That is reasonable. That province can have four members, even though its population is not particularly large.

In Quebec, they do the same thing. Of the 125 members of the Quebec National Assembly, one represents the Magdalen Islands. They are not very big, Mr. Speaker. I hope you have had a chance to visit this magnificent area. Not a lot of people live there, but the countryside is absolutely fabulous. These are islands, and Quebec decided there would be a member to represent the people living there. If only mathematical considerations were taken into account, there would certainly not be a member for the Magdalen Islands, or four federal members for Prince Edward Island. The mathematical argument to increase the representation of Ontario, Alberta and British Columbia and reduce Quebec’s political weight does not hold water.

One factor that ought to be crucial in this debate is the recognition of the Quebec nation, which means it should have the political weight needed to make its voice heard in federal institutions. I could also mention the two founding peoples argument. Everyone knows it, but the only party that recognizes these facts is the Bloc Québécois.

The Quebec nation was not really recognized in the House of Commons, despite all the pious wishes and attempts to pretend they did so. In actual fact, the federalist parties in the House attach very little significance to this recognition. I remember the defeat of the Bloc motion in the House criticizing the harmful effects for Quebec of the Conservative government's Bill C-12, which would increase the number of seats for Ontario, Alberta and British Columbia but provide nothing for Quebec.

The Bloc motion was debated on its opposition day in April 2010.

The Conservatives’ bill will have the effect of marginalizing the Quebec nation in the Canadian whole by reducing its political weight in the House of Commons. From 36% of the seats in 1867, Quebec’s representation in the House would be reduced to 22.7% in 2014, which is just around the corner. Statistics show that if Quebec has only 22.7% of the seats in the House, it will actually be below its demographic weight within Canada.

As I was saying earlier, the members of the Quebec National Assembly have voted unanimously for the withdrawal of this kind of bill. They have done so three times because the message was not getting through. It was not because they enjoy adopting unanimous motions saying the same thing. It was because the message was not being heard by the Conservative government.

If the recognition of the Quebec nation has any real significance for the federalist parties in this House, they should have opposed this disastrous reform and supported our motion. The Bloc Québécois continues to say that the government must withdraw its bill and guarantee Quebec that it will have 25% of the seats in the House of Commons. That is a minimum, given the numerous concessions made by Quebec over the past 150 years or so, and particularly since Quebec must have the tools that will allow it to protect its distinctiveness.

As I said, the Quebec National Assembly unanimously demanded that this legislation be withdrawn. I think it is worth revisiting the issue. At the time, it was Bill C-56, which became the legislation that is now before us, namely Bill C-12, and which, if passed, will give 26 additional seats to English Canada and none to Quebec. That is why all elected members of the National Assembly and the then 49 Bloc Québécois members, who accounted for two thirds of elected Quebec members in the House of Commons, demanded that this bill be withdrawn. In all, 87% of the elected members of the Quebec nation demand this withdrawal.

As I mentioned, there are other members of the House who are Quebeckers and who represent other parties. That is what happens in a democracy and I have no problems with that. I am asking them to stand up for Quebec, to ensure that Quebec's voice is heard. Again, 87% of elected representatives from Quebec are opposed to this bill, more than 70% of Quebeckers are also opposed to it, as well as all the members of the National Assembly. What more does a Quebec member of Parliament need to oppose this type of legislation?

In Quebec, a former Liberal minister of intergovernmental affairs, Benoît Pelletier, expressed his government's position in 2007, at Maisonneuve en direct, a well-known radio show in Quebec, regarding the reforms to the number of seats in the House of Commons. I will quote him. I know that other colleagues have also quoted him, but since I have some time left, I think it is worth repeating.

Mr. Pelletier said:

I appreciate that the House is based on proportional representation. But I wonder whether there might be special measures to protect Quebec, which represents the main linguistic minority in Canada, is a founding province of Canada and is losing demographic weight...Why could Quebec not be accommodated because of its status as a nation and a national minority within Canada?

In conclusion, as I mentioned just a few moments ago, Quebec's weight in the house keeps decreasing. In 1931, Quebec had 65 seats and its population accounted for 27.70% of Canada's. Even then, we had fewer seats by percentage, 26.53%, and it is the same story now. Now, Quebec has 75 seats and our population is not proportionally represented in the House. Any self-respecting Quebecker who is sitting in the House of Commons must rise and declare loud and clear that he or she plans on voting against Bill C-12.

Citizen's Arrest and Self-defence Act March 21st, 2011

Mr. Speaker, I think the hon. member has hit the nail on the head. He has been here long enough to know that the Conservative government always tends to adopt populist measures, especially when it comes to justice.

It was easy, especially given the bill he himself introduced and the bill introduced by the NDP, to move very quickly to resolve the problem in the Criminal Code. We see that. That is why we agree with sending Bill C-60 to committee. There are changes we can make without unravelling everything.

However, to introduce this populist measure is to suggest that this is what people want and that the government will move forward with it without considering the consequences. In wanting to resolve a situation involving Mr. X, in this case Mr. Chen, the government is using a bazooka when all it really needed to do was to make a very quick change by passing either the bill introduced by my colleague or the one—

Citizen's Arrest and Self-defence Act March 21st, 2011

Mr. Speaker, I thank the member for his question.

Let me come back to the famous delicate balance that is needed when it comes to self-defence. I concluded my speech rather quickly a moment ago, talking about my own experience.

The government is playing around with the issue of self-defence by removing the whole notion of necessity. Everyone knows we have the right to defend ourselves and that that is enshrined in the Criminal Code, but that only the necessary force can be used.

I want to come back to my previous example. The thieves were in my parents' house. I managed to chase them away by screaming “I have a gun”. It was not true, but they did not know that. Fortunately, they believed me. When I saw them running through the neighbour's yard, I noticed there were three of them. I was glad that I had not come out swinging and that I had not tried to fight with them. I was with my spouse at the time and I did not want to leave her alone.

However, if I had had a gun and had decided to shoot the thieves as they were running away through the neighbour's yard, I do not think I would have been using necessary force or that I could have argued that it was necessary to kill someone who had entered my parents' home. If the thieves had entered the room I was in and jumped me, or started hitting me or my spouse, I think I could have used necessary force in that case.

That is the difference. The problem lies in identifying what the government wants to do with Bill C-60.

Citizen's Arrest and Self-defence Act March 21st, 2011

Mr. Speaker, it is my pleasure to rise today to speak to Bill C-60, An Act to amend the Criminal Code (citizen's arrest and the defences of property and persons).

I will summarize what the bill is all about. The bill amends the Criminal Code to enable a person who owns or has lawful possession of property, or persons authorized by them, to arrest within a reasonable time a person whom they find committing a criminal offence on or in relation to that property. Bill C-60 also amends the Criminal Code to simplify the provisions relating to the defences of property and persons.

More succinctly, the bill significantly broadens the notion of self-defence and slightly broadens that of citizen's arrest.

I have had the opportunity to review some of the speeches about Bill C-60. One of my colleagues also talked about this bill.

It will come as no surprise that the Bloc Québécois supports sending Bill C-60 to committee. Today, we have heard that the scope of the bill raises certain questions. I will talk about the notion of self defence a little later. There are many questions about the problems that could be created by Bill C-60.

A Liberal member said that when an event gets a lot of media coverage, parliamentarians immediately want to solve the problem, which is quite commendable. Everyone in the House undoubtedly acts out of good faith when it comes to solving a justice-related or other problem. However, we must ensure that the scope of these laws does not give rise to other problems. That is what we fear with Bill C-60.

Two members introduced private member's bills to address citizen's arrest. In the Toronto area, the owner of a convenience store took the law into his own hands and was arrested. The public believed that the arrest made no sense because the owner of the convenience store had acted in good faith to protect himself and his property.

Bills were introduced in this regard. Then, the Conservatives introduced a bill on the same topic but with a much larger scope that also addresses the issue of self-defence.

For the Bloc Québécois, defending oneself and one's property, within reasonable limits, is a fundamental right. We do not see any problem with this. It is already permitted by law, but the law is too restrictive. Mr. Chen's case is a good example.

Bloc members support a legislative amendment that would enable honest citizens to defend themselves, their property and others. However, we do not want to implement a populist approach reminiscent of the wild west. No one here was alive during that time, but we have all seen movies in which people take justice into their own hands. Clearly, we do not want violence to escalate in such a manner or we could find ourselves in a situation where the lives of individuals and groups are endangered.

As legislators and as people who want to defend their families and their property, we do not want to create other, more serious problems and we do not want to contribute to an increase in violence. Certain provisions in the current bill could give rise, in the short to medium term, to situations that neither the public nor the police would want.

Bill C-60 was introduced in response to the incident in Toronto that I mentioned earlier. A business owner was arrested and taken to court for catching and detaining a man who had robbed him. This arrest of an honest citizen, who had repeatedly asked for police help without any response, outraged the public.

Two private member's bills were introduced immediately following this incident, and then Bill C-60 was introduced. Bill C-60 includes the vision of the political parties that introduced the private member's bills to address the issue of citizen's arrest. The Conservative government introduced a bill that seeks to amend the self-defence provisions of the Criminal Code.

Questions are being raised about the changes to the Criminal Code. The deputy chief of the Halifax Regional Police urged the federal government to caution the public about making citizen's arrests, because we want to prevent well-intentioned individuals from committing crimes themselves. He also pointed out that an arrest carries risks that a citizen has little chance of responding to as well as a police officer can. It is not our job to take on the role of vigilante. However, out of necessity, there are some situations in which citizens must be allowed to arrest someone who is in the process of committing a crime or harming property, a loved one or even a stranger. We even have a duty to intervene when we see someone in danger. We cannot stand by and do nothing, even if there is clearly a risk in intervening. It could jeopardize the life of the victim or our own life. Necessary force must be used. The changes made to self-defence with Bill C-60 could cause problems. Some situations that are currently illegal could become legal. We are not convinced that this would be desirable for the well-being of the community. Some situations covered by Bill C-60 were discussed by those who spoke before me, but I would like to give some examples.

There is a spat between neighbours: John is unhappy because he lent Jim his lawnmower and has not gotten it back yet. So he starts to threaten Jim and his family. He may even go as far as to threaten to kill them. Jim does not want to take any chances and decides to kill John before he attacks Jim or his family. When Jim is arrested, he tells the police that he could not guarantee his own or his family's safety because of the threats they had received. This may seem like an exaggerated, ridiculous example, but if we just look at what happens in court or read a newspaper, we will see a number of similar examples where people are trying to justify what they have done, even if their actions are unforgivable. How does one prove that John truly endangered the lives of Jim and his family? It will never happen, because one person killed the other.

Or consider this scenario: someone steals a pack of cigarettes from a convenience store. The cashier has a firearm under the counter and if he pulls it out, any number of things could happen: he could accidentally kill the man who stole the pack of cigarettes just by pointing the gun at him; he could say to himself that the man is a thief so he is allowed to take the law into his own hands and he decides to shoot; or the thief takes off and the other man decides to shoot and seriously injures or kills him because he wanted to stop him. We do not know whether he intended to kill the thief or not, but we do know that he pulled the trigger. I would remind hon. members that the man stole a pack of cigarettes. The shopkeeper may also decide to kill him because he has been robbed too many times and the police do not act quickly enough. So he pulls the trigger and kills the thief.

In either scenario, society does not win. Indeed, there is always a delicate balance that must be struck between going too far—even if one's intentions are good in proposing reforms that could have a negative impact—and taking action to protect one's property, one's family or unknown individuals. A balance must be struck. There is no doubt that the Criminal Code does have some shortcomings at this time, as we saw with the example of the shopkeeper, but the committee needs to examine certain things much more thoroughly.

In closing, situations like this often come up. When I was a teenager and still living at home, thieves broke into my parent's house. I was in the basement with my girlfriend at the time, and no one else was home.

When I woke up, I heard voices, so I knew there was more than one thief in the house. To scare them away, I told them I had a firearm. They ran away, but I definitely would have had a problem if I really had had a weapon and had decided to fire on them when they were running away across the lawn. That is why we must not go too far.

Citizen's Arrest and Self-defence Act March 7th, 2011

Mr. Speaker, my colleague from Marc-Aurèle-Fortin is absolutely correct. For people who do not have a background in law, it is very helpful to be provided with real, concrete examples of what has happened in similar situations. At the beginning of his speech, he referred to certain private member's bills that have been introduced and that deal with these type of situations. For example, in the Toronto area, the owner of a convenience store had to use force to restrain a thief. As a result, members introduced bills.

The member for Marc-Aurèle-Fortin brought up certain problems that exist in Bill C-60. I would like him to explain the difference between the bills introduced by private members and the bill introduced by the government so that people like me, who do not have a background in law, can understand. He has said that the private members' bills are simpler. I would like to know what specific problems he sees with Bill C-60.
