Public Safety April 28th, 2023

Madam Speaker, Canadians deserve to feel safe and to be safe.

Canadians deserve to feel and be safe. All governments have a role to play in this. We will not solve this problem with empty slogans and misinformation. We need to work together.

In March, the Minister of Justice met with provincial and territorial counterparts to address the problem of violent repeat offenders. After a very productive FPT, we agreed that our government would table legislation, and we look forward to working with all parties to get to the right solution on this.

Kajanan Chandrasekaram April 28th, 2023

Madam Speaker, last week, I called one of my favourite Canada summer jobs employers, Kajanan “KJ” Chandrasekaram of Bliss Stations, to inform him that his budding company has been approved for the program. I was devastated to learn from his brother of the untimely passing of KJ on April 18 at the young age of 26.

In 2018, KJ founded Bliss Stations, a dessert company based in Scarborough—Rouge Park. His passion and determination turned Bliss Stations into a burgeoning force at major events in Scarborough and beyond. He persisted during the COVID-19 pandemic and came out stronger. KJ sought to expand his business this summer by providing 12 young people with their first summer jobs.

I am heartbroken by the loss of KJ because of his infectious spirit of entrepreneurship, determination and sheer hard work. A life of promise was cut short, but I am told that his family will continue to build his dream. I ask members to join me in extending our condolences to KJ's family, friends and his team at Bliss Stations.

Budget Implementation Act, 2023, No. 1 April 27th, 2023

Madam Speaker, of course the issue of employment insurance is so critical to Canada, and to anyone who depends on a paycheque, which is the vast majority of Canadians. We know that any one of us could, at some point over the years, face the difficult challenge of applying for employment insurance.

During the pandemic, we were there for Canadians through the Canada employment response benefit. I recognize the member's concern with respect to the additional obligations under EI for the CERB shortfall, but we are confident we will ensure we will have a system that protects the most vulnerable, especially those who may be out of a job or temporarily see themselves seeking employment insurance because of seasonal employment and the like.

Budget Implementation Act, 2023, No. 1 April 27th, 2023

Madam Speaker, I do not think it is a bad thing for decisions regarding funding to be made by independent actors. I believe Parliament has a very important role in setting the agenda and terms of reference, and appointing custodians and managers to ensure the funds are managed. However, I believe that processes that are meant to adjudicate and allow funding to go to individuals and businesses ought to be managed independently of government and that it is wise for us to continue to do that. We have a civil service that does it. Oftentimes, we Crown corporations that do that. I believe that is probably a more prudent way to achieve the goals we are mutually trying to achieve.

Budget Implementation Act, 2023, No. 1 April 27th, 2023

Madam Speaker, let me say at the outset that the expenditures we are talking about are investments in our community, individuals and businesses. Just last week, the Prime Minister was in St. Thomas announcing a record investment in the auto sector with Volkswagen coming to Canada. It is the first European carmaker to set up shop here, which we believe is transformational. While we have some challenges with respect to the economy today, we are poised for long-term sustainable growth because of the investments we are making in individuals and businesses.

Budget Implementation Act, 2023, No. 1 April 27th, 2023

Madam Speaker, I am pleased to speak this afternoon to the budget implementation act. At the outset, let me acknowledge that we are gathered here on the traditional, unceded lands of the Algonquin people.

While talking about the budget, I want to preface it by outlining the current economic state of our country. After coming through the pandemic, Canada, while facing a number of headwinds, is in a very strong position. First and foremost, we continue to have the lowest debt-to-GDP ratio in the G7. We continue to have one of the lowest levels of unemployment in the G7, but also in Canadian history. We continue to lead in building a green economy that responds to the needs of the day, including addressing the existential threat of climate change.

In many ways, the pandemic taught us that the government can be there to support Canadians of all stripes, whether it be through supporting organizations that work on the front lines or supporting businesses through wage subsidies or emergency loans, which, in many ways, were lifelines for our businesses. On an individual level, the Canada emergency response benefit, or CERB, supported so many Canadians in getting to the other side of the pandemic.

As we look forward, we realize that the issues around inflation and increasing interest rates are a threat to our economy and, as a government, we have been addressing these issues head-on. We have one of the lowest rates of inflation among developed countries. Also, our rate of inflation has gone down to new lows, and we are confident that we will reach the 3% mark by the summer and be well into the 2% mark by next year. That should give us some confidence.

As a steward of this economy, we have looked at our economy in a very different way than it has traditionally been viewed. We have made sure that our economy is very much linked to our environment. We do not decouple the issue. We believe that they are fundamentally related and we cannot, under any circumstances, decouple it. If we look at modern accounting practices, we will note that many companies are now reporting their environmental liability. As we go forward and as we see the impacts of climate change, whether it is floods or wildfires, we know that the environment plays a critical role in our long-term sustainability, directly linked to our economy.

In this budget, the Minister of Finance and her team worked very hard to put together some measures that will give individuals real support during the pandemic. As we know, in the fall economic statement we had very important measures that supported Canadians on affordability. First and foremost was the GST credit, and the second one was the $500 housing rebate for those in the lowest income brackets. Those were crucial in ensuring that affordability was maintained for the most vulnerable Canadians.

As we look forward, we are looking at a number of targeted initiatives, the critical one being the one-time grocery rebate, which will support 11 million Canadians in making ends meet. While we know that it is not a permanent fix, we do realize that in these most difficult times, we need to get Canadians to the other side of these economic threats. I believe this is a very smart way of addressing this issue.

With respect to predatory lending, when I was in my first year of law school, a professor by the name of Iain Ramsay was my contracts prof, and he was a highly respected professor at Osgoode. During our contracts class, his singular focus was on predatory lending. He did an enormous amount of research on the impacts of predatory lending on low-income Canadians, the cycle of debt that it brings individuals and, subsequently, young families into, and the systemic challenges of getting out of this debt. As a result, I learned a great deal about those who are dependent on payday loans, which can only be described as predatory.

I realize that this was over 20 years ago, so I am actually quite heartened and also somewhat disappointed that it took Canada this many years to get to the point where we are actually addressing this issue head-on, redefining the notion of criminal interest rates and ensuring that those who are dependent on payday loans, our most vulnerable, are supported. It is something that I believe is fundamentally important to the economy but also to those who may be struggling right now. In addition, we are cracking down on junk fees to ensure that businesses are transparent with the prices they are set to pay.

We are also looking to implement automatic tax filing for low-income Canadians. Every year, and I know my colleagues here will probably relate to this as well, we have a volunteer who, since I was elected in 2015, comes every February and offers up her time to do tax returns. In fact, even if we do not call her, she calls us. Every year, that service is full. She really does it as a service to her community, to those who are struggling and to those for whom the tax return is so critical to their income, whether it be the Canada child benefit, old age security, the guaranteed income supplement or other government entitlements. She is very diligent in getting this done, and there are literally thousands of tax preparers who do this out of the kindness of their hearts, to make sure they support other Canadians.

Automatic tax filing, in many ways, will ensure that those who are left outside of the ability to prepare their taxes or get the type of help that is provided by my office, and I am sure many of my colleagues' offices, are supported. I am very glad to confirm that automatic tax filing will be coming and is included in the budget implementation act.

We know that students have had a particularly difficult time. I interviewed for the summer leadership program that we have, and I am pleased to say that we have two students who are starting next week. As a government, we have over 150 students, with over 4,000 applications from students who have applied to our program. This is, I believe, our seventh year running this program. It is so good to see the quality of candidates who are coming forward, but when I speak to students, I know they are struggling. Whether it is through the youth constituency advisory council that I have or through the University of Toronto's Scarborough campus, which is located in my riding, or Centennial College, I hear from students about the issue of affordability. Oftentimes, it is the ability to pay the tuition or to make ends meet.

I believe there are many measures in here, including increased grants, that will enable students to ensure that their education is affordable. I often say that in our society education is our ultimate equalizer and the measures that we have in place will support students in attaining an education.

Canada National Parks Act April 21st, 2023

Mr. Speaker, I am absolutely delighted to speak today in support of Bill C-248, an act to amend the Canada National Parks Act, Ojibway national urban park of Canada. I would like to thank the member for Windsor West for his hard work in bringing us here. I also want to acknowledge the work of the member for Windsor—Tecumseh for his advocacy.

I was able to visit this park when I was in Windsor about two months ago, and I was quite impressed with the enormous efforts that have been undertaken by the community, including the Friends of Ojibway Prairie.

I suspect that most of what I will say will be more of a reflection on the Rouge National Urban Park, which I am very proud to represent. This is how I want to frame it. On any given week, we have opposition day motions, and we have question period for around five hours. There is an enormous amount of back-and-forth among all the parties, and sometimes it is questionable as to what we are doing here and what this place really means.

After the seven and a half years I have been here, if I were to leave this place tomorrow or if I were to leave this place five years from now, the single most important thing that I would take away with me is the creation of Rouge National Urban Park.

I suspect the member for Windsor West is probably on a very similar journey to the one I am on. The reason is that this was a monumental achievement for us locally, for those of us who represented the Rouge park or, in this case, the Ojibway national park. It is monumental because, when we look back 30, 40 or 50 years from now, we will see that we were creating an enormous gem protecting our wildlife, protecting our natural habitat and ensuring there is ecological integrity in the hearts of some of the most densely populated places in all of Canada and North America.

As I look at the Rouge National Urban Park taking shape today, I often think of how we got there. I want to pay respect to a number of people who have been instrumental. I want to start off with Lois James, who, as members may know, was known as the mother of the Rouge. She unfortunately passed away several years ago.

We have tried to mark her success in so many ways, but the absolute legacy that she left is the park itself. Starting with her, and continuing with generations of activists who were inspired by her, we have managed to bring something very special to the greater Toronto area. We now have 79.1 square kilometres of protected space, with some of the most incredible wildlife protected, including the Carolinian forest. We have hundreds of endangered species, ecological areas and farms, which really do speak to the vibrancy of the park.

We had to do a balancing act to ensure that an established urban area could support a national park. Starting with Lois James, we went through the seventies and eighties, as the city of Toronto was sprawling. Scarborough was at that time a city of its own. It was sprawling, and there were enormous pressures for development because of shortages in housing.

We had activists. We had common citizens, including people who were principals, gardeners, students and people such as my friends Glenda Bearmaker, Jim Robb, Kevin O'Connor and others, who basically said that enough was enough. They saw that we had the historical Rouge River going through one of the most beautiful parts of the city, and if we were going to put development right in the centre of it, we would lose it and the ecological benefits that stemmed from it. People stood in front of bulldozers. There are stories of citizens who stood in front of bulldozers and said that enough was enough. They did not want to have development at the cost of the environment and the land.

I think the enormous sacrifices of the individuals there led us to the park today. I always say, with the member for Scarborough—Guildwood, that in many ways we are here as the last leg of this long marathon, but what we did was inconsequential compared to the work of the community itself, the fights the member for Nunavut was talking about and the enormous strides our community made.

Then, I look at all the people since then, the kids, the schools and the community. There will not be a week that goes by from now until the fall when we are not doing a tree planting. I, for example, am doing a “walk in the park”, as I call it, in the Rouge National Urban Park next Sunday, and there will be tree planting and a community cleanup tomorrow for Earth Day. There are tree-planting opportunities across the Rouge park that are done by organizations such as the Friends of the Rouge Watershed and Forests Ontario to ensure that the park is vibrant.

The unique nature of the Rouge park also means that we have active working farms with people who are recognized as heritage farmers. Farmers have farmed the area for a couple of hundred years. They have a form of tenure that allows them to continue until their demise, and we have new vibrant businesses that are taking shape, including what I am told is a microbrewery that is coming to the park.

Of course, this is all situated on the traditional lands of many indigenous nations, including the Mississaugas of the Credit. There are also the Huron-Wendat, who have a long history, including areas of the park where their history dates back over 10,000 years. The park itself is managed with enormous guidance from the indigenous circle that is part of the operations of the park, and there are regular and ongoing consultations that really allow the park to be sensitive.

There is one thing I have believed a park should do, and I am going to put it out there, because it is something that is quite important. I have had many conversations on this, and I hope at some point it will happen. The Rouge National Urban Park is the single largest display of the federal government within the greater Toronto area, and as such, I believe there is a need for more reflection on reconciliation at the park. For example, there is a need for a truth and reconciliation trail that would enable those who are visiting the park to be able to recognize the long and painful history of indigenous people in Canada, but particularly in the region.

Also, I think there is a greater need to ensure that we use the park to bring people back to nature and bring people back to what is, I think, most important, and probably the most important threat this country and this world are facing today.

I want to also acknowledge the work of Parks Canada's Andrew Campbell, who is the lead for Ontario, as well as Omar McDadl, who is the superintendent of the park. In the minister's office we have Joshua Swift, Kate and Jamie MacDonald, who have been incredible. There is also Janet Sumner of Wildlands as well as both former minister McKenna and the current Minister of Environment and Climate Change.

In closing, I think what the member for Windsor West is doing in collaboration with this community and many of the community members who are part of the Friends of the Ojibway Prairie is creating a legacy. It is not his legacy, but a legacy for all Canadians for future generations, where we can look back and say this is what we did in eight, 10 or 12 years of being here; we are protecting the land and making sure there is green space, and we are building a better Canada for all of us.

Questions on the Order Paper April 21st, 2023

Mr. Speaker, on October 28, 2022, the Supreme Court of Canada struck down two elements of the Criminal Code relating to the obligation to comply with Canada’s sex offender registry. At that time, the Minister of Justice indicated that he would look at the options responsibly and was clear that victims and the safety of Canadians would always be priorities in this matter.

Officials from Justice Canada and Public Safety Canada have engaged with provincial and territorial officials and law enforcement through existing fora to discuss the implications of the judgment and possible avenues for a potential legislative response. Specifically, the issue was discussed on October 31 and November 14, 2022, by the Coordinating Committee of Senior Officials, CCSO, High-Risk Offenders Working Group, membership in which is open to all jurisdictions.

The minister’s office has consulted the following organizations: Action Canada for Sexual Health & Rights; Association Québécoise Plaidoyer-Victimes; Barbra Schlifer Commemorative Clinic; Benjamin Roebuck, Federal Ombudsperson for Victims of Crime; Canadian Association of Chiefs of Police; Canadian Association of Crown Counsel; Canadian Association of Elizabeth Fry Societies; Canadian Centre for Child Protection; Canadian Centre for Gender and Sexual Diversity; Canadian Federation of University Women Circles of Support and Accountability; Ottawa Criminal Trial Lawyers’ Association; DisAbled Women’s Network Canada; Egale Canada; Ending Violence Association of Canada; Fédération des femmes du Québec; Fédération des maisons d’hébergement pour femmes; National Council of Women of Canada; Native Women's Association of Canada; Newfoundland Sexual Assault Crisis and Prevention Centre; Nova Scotia Public Prosecution Service; Ontario Council of Agencies Serving Immigrants (National Alliance for Racialized, Refugee, and Immigrant Women); South Asian Women’s Community Centre; The Criminal Lawyers’ Association; The National Association of Women And The Law; West Coast Legal Education and Action Fund; and Women’s Legal Education and Action Fund.

Eid al-Fitr April 21st, 2023

Mr. Speaker, I rise today to wish my Muslim friends and neighbours Eid al-Fitr. During Eid, Muslims are encouraged to forgive and seek forgiveness, as well as generously sharing their blessings with those less fortunate. Eid al-Fitr symbolizes the virtues of patience, piety, godliness and fortitude. It is a time to reflect, spend time with loved ones, show grace for the blessings in their lives and celebrate fresh beginnings.

Ultimately, it is a celebration of and reward for the spiritual discipline exercised by worshippers during the holy month of Ramadan. During this month, I want to thank the Islamic Institute of Toronto, Masjid AI-Jannah and Spiritual Society Canada for their warm welcome to prayers. I also want to acknowledge the enormous contributions of the Muslim Welfare Centre of Toronto for its ongoing fight to ensure food security in our community and beyond.

To all those who will be celebrating today in Scarborough—Rouge Park and across Canada, Eid Mubarak.

Criminal Code March 22nd, 2023

Madam Speaker, let me begin by acknowledging that we are gathered here on the traditional unceded lands of the Algonquin Anishinabe people.

I am pleased to join in the debate today as we progress to the second reading of Bill C-283, regarding addiction treatment in penitentiaries. I thank the member for Kelowna—Lake Country for her advocacy on this important issue and for her hard work. As the member has noted, this bill aims to expand sentencing options to help address the root causes of criminal offending through treatment.

Our government is committed to protecting the health and safety of all Canadians, including those who are incarcerated and struggling with substance abuse issues. As my colleagues would agree, these issues cannot be addressed in isolation. Substance use is a social and health issue that intersects clearly with systemic racism and inequities. That is what I would like to focus on today.

The Minister of Public Safety's December 2021 mandate letter reaffirmed the requirement to continue to combat systemic racism and discrimination in the criminal justice system. This includes supporting work to address systemic racism and the overrepresentation of Black, indigenous and racialized Canadians within the criminal justice system.

The Minister of Justice and Attorney General of Canada introduced Bill C-5, an act to amend the Criminal Code and the Controlled Drugs and Substances Act, last December. It received royal assent, and we are hopeful that it will make a significant impact in our criminal justice system in addressing these issues. Bill C-5 aims to restore judicial discretion to impose fit sentences and to address overincarceration rates among indigenous and Black persons, and members of marginalized communities who are overrepresented among those convicted of certain drug- and firearm-related offences. Harms related to substance use would be treated as a health and social use rather a criminal one.

The Minister of Public Safety, in concert with the provincial and territorial colleagues, addressed many of these important matters head-on at recent meetings of ministers responsible for justice and public safety. Work is under way to implement the United Nations Declaration on the Rights of Indigenous Peoples Act, across the country and within provincial and territorial jurisdictions. Excellent collaboration continues with the FPT working group on the development of the indigenous justice strategy and in addressing systemic discrimination and overrepresentation of indigenous persons within the criminal justice system.

The ministers also affirmed, in light of the James Smith Cree Nation tragedy last year, the need to work with indigenous leaders to ensure their communities are safe and supported. The ministers agreed to collaborate on the development and implement of the Canada's Black justice strategy to address anti-Black racism and discrimination within Canada's policing and criminal justice system.

Another key priority was the ongoing opioid crisis. Again, substance use is a public health issue that must be balanced with public safety. In practice, that means diverting individuals away from the criminal justice system at an early stage, through rehabilitative and treatment programs or increased use of conditional sentences.

Our government is very much seized with the work to both build safer communities and help break the cycle of substance-related harms by addressing the root causes of criminality. On its surface, Bill C-283 appears to have the same goals. It proposes to offer offenders the possibility of serving all or part of their sentences in a designated addiction treatment facility.

Let us examine some of the bill's unfortunate oversights and exceptions. Proposed section 743.11 would stipulate that those whose offences carry a maximum penalty of 14 years' imprisonment or life in prison, and those who have committed offences resulting in bodily harm, involving a weapon, or drug trafficking or production, would not be eligible to serve their sentences in a designated addiction treatment facility. This is a problem.

With respect to overrepresentation, Bill C-283 runs counter to our goals. We know that indigenous and Black persons are overrepresented in federal penitentiaries. According to the data, over 68% of indigenous women in custody are serving a federal sentence of more than 10 years. Black offenders represent the largest proportion, 42%, of offenders convicted of importing or exporting drugs.

Overall, Black and indigenous persons tend to be subject to longer sentences, and I invite members opposite to look at the Auditor General's report on corrections, released late last year, which talked about systemic racism. It is, therefore, clear that Bill C-283 would exclude some of the most vulnerable and overrepresented members of the custody population, those who, in fact, may be most directly in need of treatment and rehabilitation.

In addition, proposed paragraph 743.11(1)(a) of the bill would require the offender to show evidence of repeated good behaviour in order to indicate that substance use has contributed to their actions. Here is yet another barrier to accessing treatment for incarcerated people. Not everyone who needs support and services may have a history or a pattern of behaviour: for example, those who have only recently begun using opioids.

This could also represent a prohibitively expensive burden for offenders who do not have the means to provide submissions established in their history or repeated behaviour. Bill C-283 would therefore not only make those individuals ineligible for treatment, through no fault of their own, but also create significant issues of inequity, with BIPOC and socio-economically disadvantaged offenders being denied services at a disproportionate rate.

This bill flies in the face of the Minister of Public Safety's December 2021 mandate letter, which reaffirmed the need to continue to combat systemic racism and discrimination in the criminal justice system. It is also misaligned with Correctional Service Canada's commitment to addressing the overincarceration of indigenous peoples. Again, that is why our government introduced Bill C-5, to treat harms related to substance use as a health and social issue and not a criminal one. Ultimately, the measures in Bill C-5 will help address overincarceration rates among indigenous and racialized persons convicted of certain drug- and firearms-related offences. In contrast, Bill C-283 would undermine these goals.

Despite its veneer of concern for the health and safety of offenders who use substances, this bill is not designed to help those who need it the most. I encourage all members to join me in voicing their concerns about this bill.
