With respect to the specific amendment, the difficulty is that the RCMP would not have any control over, if we published based on the criteria here, any individual using the Internet to try to identify victims.

It says that under no circumstance must the information in the database be used to identify a victim. So anybody in the public can take the information here, go on the Internet, and try to do media searches and so forth.

Justice committee  I would add only that I think that's a proper interpretation of how the RCMP would exercise its obligations, which is to only.... The act is very clear: it must contain only information that has previously been disclosed. The consequence of the amendment might actually create operational challenges for the RCMP to operationalize the bill.

Justice committee  I would just add as a point of clarification that the national sex offender registry database already exists, and there are 36,000 names in that database. There's a single national database for people who have been convicted of a designated offence and who are required to register.

Justice committee  Our understanding of transmission data—I mean, it’s very clearly spelled out in the proposed legislation already. It clearly indicates that the content of transmission, which “does not reveal the substance, meaning, or purpose of the communication”, is to be disclosed to police and you can't get a product order for that or use that provision to get that information.

Justice committee  Correct. All of the provisions within the proposed legislation include prior judicial authorization. Transmission data and our understanding of how it would be applied is a modern equivalent to phone-call information in terms of the origin and the type. It includes a little bit more insofar as the size and the type, but pretty much everything else is…but the direction, the date, time, the origin, destination—those are the things we would normally get with an order for telephone information.
