Public Safety committee  That's correct. In the Criminal Code, we, the government, defined “firearm part” and have added it to several offences—for example, trafficking in firearm parts or smuggling in firearm parts—and in some of the procedural parts of the Criminal Code as well. Sections 117.02, 117.04 and 117.05 are existing search and seizure provisions in the Criminal Code, so it's adding “firearm part” to those provisions to allow for the search and seizure of these parts.

Public Safety committee  The definition of “weapon” is set out in section 2 of the Criminal Code. It includes a firearm or anything that can cause bodily injury, I believe. My colleague might have something to add to that. This is an existing provision in the Criminal Code, and we are adding.... I keep saying “we”.

Public Safety committee  I think the issue of unfounded complaints is absolutely valid, as we've seen through the testimony from victims' groups, etc. My understanding of the intent of this amendment is to include the “unfounded” language within the revocation provision, which is far past the time a judge would look at an application, as well as the reliability of the evidence and the applicant, and deem that to be vexatious or unfounded at that time.

Public Safety committee  The definition of provincial court judge is being repealed from, I believe, section 112, but it's being integrated into the clauses for the red flag regime. It just moves the definition through the clauses. It's not being removed completely; it's being repealed and re-enacted in clauses 4 and 10.

It just adds it to the list of offences in paragraph (b) for which a mandatory order must be made following conviction of one of these offences.
