Since the discussion paper was tabled in the spring that outlined the proposal in this legislation, the government has taken the key message to not give the ability to amend the Species at Risk Act or issue exemptions to the jeopardy clause quite seriously. They've removed that from the proposal.
The legislation as written would still allow a project listed under the building Canada strong act to lead to a jeopardy finding with no restraint. The project could still go ahead even if it would cause the extinction of a species.
The government has attempted to assuage these concerns, but I'm not feeling particularly comforted that the way this bill is being passed will protect, for example, the southern resident killer whale or, in Manitoba, the woodland caribou, which are being protected through impact assessment conditions issued to the Lynn Lake gold project.
