It's a tough test. I have tried to identify some problems related to the Charter of Rights and Freedoms. For example, does this bill violate section 20?
Even if that were the case, you would also have to check whether this is justified under section 1. There are other considerations as well, including minimal or no impairment, and even how important the objective is. To be consistent, it is important to acknowledge that, even if the court recognized in Nguyen that the objective was sufficiently important, this would likely no longer be the case now.
