This latest amendment, if I'm right, October 1, 2010, is when you first tabled this, and we don't know when the drafters looked at it, but the amendments to section 130 looked as if they were 2009. I'm going to go way out on a limb and think that the drafters had the most current version of the Criminal Code in front of them when they were helping you. I'm also going to assume they suggested this subsection 130.1. The best information you have is what you have.

I asked the DOJ officials by e-mail to respond, and their response is that it was drafted that way because it not only deals with the circumstance of an offence under section 130, and they have in quotes, “and another offence”; therefore, it is somewhat distinct from section 130, so it should be in a separate provision in there.
