Neither of them. It will be the Director of Public Prosecutions. The file will be sent to the DPP, who will assess whether there's a reasonable chance of conviction and whether it's in the public interest to file charges. If so, he will apprise the Commissioner of Canada Elections to proceed with filing charges before the court.
