[Telecommunications Act, December 1st, 2022]

Madam Speaker, clause 2 of the bill would enable the government to issue orders to force users of telecommunications services to use products or services that do not come from certain providers, including Huawei.

Does that mean that a person who has already bought a Huawei cellphone, because that is a product, will not be able to use it anymore and will have to buy a new phone much sooner than they expected?

What is more, since decisions will be made by order, does that mean that, under this bill, the government will be using orders to govern in this area instead of going through parliamentarians?

Mr. Speaker, I have so many questions.

We agree on the principle of the bill, but I do have to wonder about the precautionary principle. Since 2017, the Chinese government has required Chinese companies to hand over any information they collect to its intelligence service. Despite this, the federal government continues to award contracts to Chinese companies like Nuctech, for example.

That was a very important contract, I might add. Nuctech was being asked to install x-ray machines in embassies, precisely where our information must be protected. Information from the embassy could have easily been passed on.

My question for my colleague is this. We currently have an interesting bill before us, although it needs improvement. Should the precautionary principle not be applied more systematically, along with the recommendations made by the Standing Committee on Government Operations and Estimates in its June 2021 report?

[Vanier Cup, November 29th, 2022]

Mr. Speaker, Quebec City lives for football. I am talking about Laval University's Rouge et Or team, which went for the win and brought home its 11th Vanier Cup. I have to mention Kevin Mital's standout performance, which earned him the Hec Crighton Trophy as Canada's top university player. I also want to congratulate head coach Glen Constantin on his 10th Vanier Cup victory.

The Vanier Cup is not the only win for schools in the Quebec City area. There were victories at all levels. The Séminaire Saint‑François Blizzard won the Juvenile Division 1 Bol d'Or, and the Limoilou Titans won the College Division 1 Bol d'Or. No doubt about it, the best football is played in Quebec, with all due respect to my colleagues.

This success is due to the incredible teamwork of the coaches, players, support staff and parents. We are so proud of the Rouge et Or, the Blizzard and the Limoilou Titans.

Well done.

Mr. Speaker, this piece of legislation is intended primarily for the private sector. It is virtually silent on the subject of the public sector's duties and obligations. As things stand, it is up to victims to fight tooth and nail to prove that fraudulent activity occurred and that they themselves are not new fraudsters. This applies to all levels of government.

I would like my colleague to comment on public sector accountability for cleaning up fraud victims' records when the fraud was caused by the public sector's weak identity verification methods.

Madam Speaker, my colleague from Selkirk—Interlake—Eastman mentioned some things that are not covered by Bill C-27. The law they have in Europe right now requires businesses to have two ways to identify individuals, but the trend is moving toward having three.

Does my colleague think that Bill C-27 should also legislate on the number of methods of identification that businesses should be required to use? It does not do so right now, which is why we need to carefully study it in committee.

Madam Speaker, I would like to take 15 seconds to congratulate my colleague on delivering half his speech in French. He has improved by leaps and bounds in less than a year.

Now, the moment we have all been waiting for, my question. Quebec has a law that protects its citizens' privacy, law 25. We talked about it earlier. In the early 2000s, PIPEDA's paragraph 26(2)(b) stated that the Governor in Council would, by order, respect Quebec's legislation. Essentially, the federal act would not apply with respect to personal information about individuals' property or their civil rights. In other words, the act would leave matters under Quebec's jurisdiction alone. Even though Quebec's law 25 already complies with EU expectations, Bill C‑27 contains no clause guaranteeing that the federal government will respect the application of Quebec's law.

My question is simple. Will my colleague work to ensure that the federal government respects Quebec's law 25 and that there will be an order to that effect?

Madam Speaker, I fully understand the stress the Canadian financial sector is feeling.

Unless we tighten the rules, Canada will not meet the European Union's expectations, which means Canada's financial sector could lose all or part of very important European markets. There is less pressure in Quebec because, thanks to its own legislation, it is already compliant.

Despite the pressure, the bill must be properly drafted. Is my colleague concerned that pressure from the financial sector could lead to a situation in committee where words and time are more limited?

[Criminal Code, November 24th, 2022]

Mr. Speaker, I appreciated my colleague's speech, particularly when she mentioned the importance of reviewing how judges are appointed and avoiding any partisan lists.

Part of what I understand about this bill is that it is designed to avoid or reduce delays. There have been delays that have resulted in major cases being dismissed because of the Jordan decision. Again, it is nice to harness technology, but if there are not enough judges to hear cases, the issues stemming from the Jordan decision will continue.

I am wondering if my colleague has any suggestions for the government so that we do not see a repeat of issues that have occurred in the past as a result of the lack of judges.

Mr. Speaker, approximately 80% of communication is non-verbal. An individual can say something and their face and movements will convey something different. Although video conferencing allows people to see each other, part of the message is lost because of the framing, lighting or other factors. Conversely, the message can also be amplified for the same and other reasons. It can lead to misinterpretation, both in the case of jury selection or the reaction of suspects.

I would like to know if, in cases such as the ones I described, my colleague could provide some solutions to avoid judicial mistakes being made because of the misinterpretation of non-verbal clues.

Mr. Speaker, today's technology enables us to do things that used to be much harder to do. My colleague mentioned this in her speech, particularly with regard to court delays.

Does my colleague believe that this bill makes sufficient improvements to ensure that fewer cases are thrown out because of the Jordan decision?
